As of today Tuesday August 25, health PLEX made two unauthorize transactions from my bank accountOne for $and another for $I do not owe them any money and they were told they have no authorization to take money out of my bank account

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below 1: I have two doctor's notes that confirm I should not engage in any core training until my back has completely healedMy back is nowhere close to being healed2: I presently receive massages from [redacted] in [redacted] (as referred by my physician), NY as they are part of an acupuncture package I purchased and working well to keep my back from getting worseI cannot change this routine, nor would my doctor back this change up3: I became angry (NOT vulger) with the owner of Healthplex Fitness when he spoke loudly over me, refusing to listen to me as I attempted to articulate the reasoning behind my need to opt out of the training as supported by my two doctorsIt was difficult getting my message across to someone who spoke loudly over me and told me how unqualified my own doctors were in making such a determinationI had no choice but to hang up on him4: I would no more feel comfortable (or safe) walking into Healthplex for a massage than I would for a personal training session or even a short workout on their equipmentThey have successfully intimidated me to the point that I will never walk into that establishment again.5: I need a FULL REFUND, minus the one session I had with the trainer that resulted in the back spasms I had to go to the doctor for in the first placeThis is the only fair and equitable way to resolve this Regards, [redacted]

I am writing in response to the complaint filed by [redacted] (ID number [redacted] ) on 11/23/I have enclosed a copy of the signed contract initiated by [redacted] on 11/10/It clearly states in the Personal Training Agreement all sessions are nonrefundable and non-transferable, Unfortunately, when Mrs [redacted] called us on 11/22/and spoke with myself and the owner, we were unable to extend her much information as she became immediately hostile and vulgar on the telephoneWe did offer to put all sessions on hold until [redacted] felt up to using themWe do have a working relationship with [redacted] NY and all of our certified personal trainers carry a Functional Movement CertificationIf we were able to communicate more with [redacted] we could of extended her a few other optionsWe would be happy to convert her training package over to massageWe have two fantastic licensed massage therapists on staffThe total number of massages at would be and we would like to offer an additional complimentary massages valued at as a good faith gestureThank you very much for your help in resolving thisHappy Holidays to you and your familyBest Regards, Vallen MOffice Manger HealthPlex Fitness Center

I am writing in response to the complaint made by Mrs***I have attached a copy of the certified mailed envelope received from Mrs*** as well as a copy of her contractHer cancellation was received on October 3, which according to her contract is not days in advanceIn good faith we
honored Mrs***s' request to cancel and lessened the term to daysShe incurred accurately Novembers billing according to contract and cancellation termsWe believe we have already credited her a credit by early termination of the account; she was not billed for DecemberIf Mrs*** would like we would offer to extend her another month's use of the facility at no costWe are greatly disappointed things have turned out this way and appreciate your help getting this settledThank you for your timeSincerely, Vallen MOffice Manger

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.   After going over the email that [redacted] compose in response to my initial complaint I notice a lot of the information she stated is incorrect Health Plex is trying to make a defamation of my character. This just proves once again how shady they are there. In health Plex email they stated I have been training with Robert K[redacted] on a regular basis for over 6 months, that is a very false statement Rob has not been employed with them for even 6 months. Rob started his employment with the company the week of March 23rd, he was not assigned to me until April 22nd. I please ask you to look into his employment records to prove that they have giving you false information, as I kept records the whole time during my contract.  I started my training February 16th with Matt. Health Plex states in their second paragraph that "I never voice my complaints regarding my program" this again is a false statement. After two weeks with Matt I went to Mike (which is one of the managers) telling him how unhappy I was with Matt. I addressed all of my concerns  that I had. Mike told me he would give me another trainer to meet my agreement. I was then assigned to Zach, I had two sessions with Zack before he was no longer employed with Health Plex. I was then assigned to Jared, I had one session with him before he was no longer employed. They then threw me into group sessions when I voice my opinion again! They told me that they had some difficulties with the staff and ask for my patients. Mike then took me as his own client, in those times he still continued to throw me into some group training and with other trainers. The last 3 weeks of my contract I was assigned Rob. When my sessions were coming to a end Rob asked me if I was going to renew. I then AGAIN voice my concerns to why I did not want to renew. He assured me that I would only have him as a trainer ,would give me more of a set schedule and make a work out plan for me. I agreed to sign another 3 month contract with him, as he did live up to the agreement he promised.  Continuing in the email Health Plex writes I had a "financial problem arise" and they had agreed to be courteous and lesson her payments to $225 for a time with the agreement the total balance was paid full" That is ANOTHER false statement. Never have I ever had that conversation. I work a full time job with doctors in cardiology, I have more than one bank account, my savings account alone shows that I am well off, my credit is excellent, I have always paid off my credit cards in full every time, I live at home with no "real" expensive. I am willing to give any information/documents you need to prove the company gave ANOTHER false statement.  August 2nd I realize that in July they charged my bank account 3 times of  $225 when they were only authorized to take out one payment of $225. As you can see in my contract. Monday morning I called to discuss this matter. [redacted] told me I was wrong and that I I would have to show them my bank statement to prove it. I was at work at that time and could not leave to bring it to her. I called back and asked to send it via email. I never heard back from her once I sent it. I called again the next morning and she told me she would only refund one payment because my contract was for 450 a month, I then asked if I could come in to look at the contract with her,as I knew she was wrong. She told me she would leave it with Mike to go over with me, I went in there on 3 separate occasions to look at this contract ,Mike would apologize each time saying "Sorry I don't have the keys and [redacted] locked it up." I went in August 17th the day they were having new clients come in to sign up, I voice my opinion on how disappointed I was with the way they were handling my overcharges as it was two weeks later. Mike then told me that health Plex were wrong and that they were looking at the wrong contract and would refund me the rest of my money.   The email stated that I closed out the contract please look at the document as it will show my last payment under contract was August 1st which was pages. I did not close my contract.   Before health Plex refunded all of my money Mike tried to double talk me and told me I was all paid up as I responded with "I know I am all paid up ,the problem was health Plex still owe me money that they overcharged me in July", which they did end up refunding me when they realize they were looking at the wrong contract.   At this time I decided not to renew my contract as I could see at that time billing has been a long term issue with them. They handled my over charges  unprofessionally, they gave me a hard time for no reason even though I show them proof. When they realize I was not renewing they started to tell me I still owe them money but if I renewed that they could forget about the $450 and only charge me $225 in my new contract I told them I was all paid up and I will not pay them any more money as they had no reason to charge me. I alerted my bank at that time that I was not authorizing any more money to come out of my bank account from them, as I showed  my bank my contract and saw I was all payed  up.  Monday the 24th my bank called me alerting me Health Plex took out money from my account. They made two transaction and asked me to come in and fill out paperwork to put it in as fraud. Another false statement in her email [redacted] said she tried to contact me Wednesday August 19th about payments due, untrue because that night I went in and talked to Mike and he told me the next day he would talk to [redacted] about these "charges" . Thursday August 20th she calls me where in the voicemail she does not state she was going to take out $675 from my account. I called her back and Amy said she had already left for the day, I left a message for her to call me back Friday the 21st. By the afternoon I have not heard back from her so I reached out again and was told she was out for the whole day Friday. Monday the 24th is when they took the money from my account.   I'm willing to reach out to my phone company to get records so you can see all the times I have tried to resolve this matter with them. I also have a voicemail saved where it does not say she was taking money from my account. I really hope this business gets a full investigation for their dishonesty and scam. You would think going through this issues all managers would be on the same page but every single time I would get different answers from them as I'm sure you will see.  They have not once tried to reach out to me to resolve this matter all I got was a threatening email to drop this complaint with the Revdex.com which I refuse to do as I know I am 100% right. I followed all the terms of my contract. Them stealing $675 from my account is wrong. I hope something can be done as the email they wrote was false,not one thing in it was true.         Regards,   [redacted]

If we were able to communicate more with [redacted] we could of extended her a few other options. We would be happy to convert her training package over to massage. We have two fantastic licensed massage therapists on staff. The total number of massages at 900 would be 11 and we would like to offer an additional 2 complimentary massages valued at 170.00 as a good faith gesture.
