On March 23, *** *** was notified by IMortgage that there was an issue with the wood floor that was installed at this property*** *** immediately contacted the installer and through investigation it was found that the starter row was not glued down with the moisture blocking glue that the rest of the floor was glued down withEven though *** *** was no longer with Higginbotham Custom Homes he agreed to have this problem fixedWood floor installer agreed to fix the issue whatever they may be. On April 18, *** Munn the consultant also did an inspection and moisture test of the floor and his report supported the findings that the starter row was not glued down properly*** told *** that the State of Florida is a right to cure state and to this date we have been denied the right to cure the wood floor issues*** said he now didn't want it repaired and wanted the entire floor replacedWe disagreed and requested a follow up meeting at the property. On May 1, we met at the property with wood floor installer and we agreed to have the wood floor that *** picked out to be tested*** the installer tested the wood floor and found that the material has no water blocking capabilities on the bottom, sides or top like standard wood floors haveWood floors have some sort of water repelling capabilitiesThis floor had noneMay 8, these findings were sent to ***. On May 9, Due to not hearing what he wanted to hear, *** began legal threats and additional threats with Revdex.com, State of Florida, etc... On May 19, we received a letter from ***'s attorneyWe instantly requested a meeting at the property with *** and his attorney. On May 31, we received an email stating that *** denied meeting us at the property with his attorney. Since May 31, we have made several attempts to rectify the situation in which all have been denied by ***The most recent offer to rectify the situation and make *** happy include the following:Owner will have all contents removed in the areas where wood floors are to be removedOnce contents are removed, owner will send photo documentation showing areas re free and clear of contents. HCH will remove all woods floors. Owner will have a moisture bearing membrane installed*** *** will inspect the moisture bearing membrane to ensure it was installed properlyOnce *** *** approves moisture bearing membrane, Owner will provide tile, setting materials and grout for new tile floors. HCH will install owner supplied tile floorsHCH will agree to install 6"x 24" rectified edge tilesAny size larger will be at additional costOnce tile is installed HCH will grout the new tile floorDoes not include new quarter round or shoe mold. Owner agrees to not walk on or have anyone else walk on floors during the installation processTiles need a minimum of hours to set and dry. *** *** will inspect floors once tile and grout is installed. Due to the numerous threats by owner in previous emails, HCH requests that this agreement be put in writing and signed off by all parties before work is to commenceAgreement must include waiver of liability to HCH from owner. Currently the owner has demanded that we install a Detriment flooring system prior to installing the tile floorHCH does not have an installer that is trained or certified to install such a system, HCH requested that if the *** wants this then he would be responsible to have this installed*** has declined to have this product that he is demanding to be install it. HCH presented another moisture blocking product that we could apply in which *** also declined
