April 30, 2013 sales representative [redacted] came to my home selling ADT security systems. They were offering free security systems installed free, monitoring services police fire emergency service with extended limited warranty for $36.99 per month and no payment for the first 30 days. I already had a system and was not really looking for a new company he sold me wen he said it included my garage door another motion detector and 2 key chains. I had one motion detector already in the basement, Mr. [redacted] went down stairs looked at it and ensured it could be connected to the new system. On the contract he originally wrote for the installer to arm 3 doors 1 motion 1 key chain. I questioned the connection of the other detector and why he didn't write it on the contract and also he told me 2 key chains and wrote 1. He stated the installer would automatically connect the detector he didn't have to write it down but he did change the key chains to 2.
May 1, 2013, [redacted] come to my home to install the new alarm system. My husband was at home to let her in and because I am the person that conduct all of our business he called me for [redacted] to answer the questions she had. She asked me which alarm system did I want installed I had no idea I asked what was the difference. The only difference she told me was one system had the wires outside and the other had them inside, having them inside was much safer and no one could cut the wires. If that's the only difference the price is the same install the one inside and she did. I got another call about the motion detector being connected, she stated she couldn't connect it cause it wasn't compatible with the system beside the fact Mr. [redacted] didn't write it on the contract to be done. She also only had one key chain said it wasn't written on her copy of the contract because he did change my copy and the copy he had she gave me the other key chain the next day. [redacted] installed the Simon XT Security System.
After going back and forth with [redacted] and [redacted] about my second motion detector, May 15, 2013, [redacted] came and installed the motion detector in the basement.
May 10, 2013 or so I get a bill for $36.99. I call ADT to see why I wasn't suppose to get a bill for the first 30 days they waive the bill noting it must have been a promotion from the company that sold me the service. The next bill was for $36.99 I paid the bill. In July I get a bill for $45.99 plus $9.00 past due from the previous bill. I called to inquire about the rate increase, I was told it was the amount of my contract that I signed. My response I didn't sign a contract for that amount my bill was for the correct amount the last bill, that's when I was told J & C National Security had just submitted the contract to them in that amount. I requested a copy of the contract and the original contract was changed and my signature was used as if I agreed to it. This contract is fraudulent.
August 6, 2013, I went to the company to get clarification and my bill corrected along with my original contract. I spoke with [redacted] General Manager who was very reluctant to give me her name. Ms. [redacted] proceeded to tell me they are authorized to change my contract at anytime. My husband signed a paper showing [redacted] installed a Simon XT system 3 door sensors 1 motion detector 1 key chain rate of $37.99. According to Ms. [redacted] that gave them the right to change my rate, nothing on that paper (that she wouldn't give me a copy of)state we have the right to alter your contract without informing you. She also stated [redacted] should have verbally told me my rate would be higher that did not happen and it was not authorized. I was told because I was not physically in the home at the time of installation I cant say what was said. She also stated they would have to come back and change the system she was not going to just give me a $300.00 device and already giving me a free system. No device was specified on original contract.
