Response:

The original contract with **. [redacted] of JT Roofing, Siding and Masonry was July 5, 2013. The contract consisted of removing damaged roof and deck from rear of house, repairing damaged roof and chimney, repairing small garden roof and installing new deck. The contract included removing all refuse and permit fees. The total was $14,170. [redacted] was given a $5,000 check, which is what he asked for to get the job going. Originally the plan was to remove the old deck with the roof on it and put up the new deck , and then repair the roof and chimney. [redacted] came to us and said he now felt it was better to repair the roofs and chimney first, so as not to scratch up or damage the new deck. We were okay with that. [redacted] made the first phase of the job to be tearing off the old roof, installing new paper and shingles and repairing the chimney and the part of the roof where the old deck roof was attached, reason being there was going to be no roof on the new deck. Also included in the first phase was the removal of the old damaged deck and roof while the dumpster was still in the driveway. The dumpster was in place by July 10, 2013. Two of [redacted]'s workers started doing the job the next day. The family went away to a softball tournament for our daughter and returned the 15th of July. When I saw [redacted] after work he said the roof was not in as bad a shape as thought and just putting shingles over the existing roof would be okay and it would save money by not having to tear off the old roof. Also by this time [redacted] had torn off the roof and railings of the old deck. When I noticed that only one side of the roof was newly shingled I contacted [redacted] and he indicated that there was something called a valley on the other side and it was going to be difficult to shingle that side. I also indicated to him the rear of the roof where the old deck was tied in was not completed. The capping was not completed, it did not match the other three sides of the house as it was supposed to, there was no rain gutter and the chimney had not been repaired. I need to mention that even though we were away I would keep in contact with [redacted] in case any problems came up. It was at that time that I realized there was something wrong because [redacted] would not remember our conversations. [redacted] indicated that there was no problem, the work was going to be finished as it was supposed to be and that by the time we got back from the next tournament which we left for on July 17th and returned July 22nd. While at the tournament I kept in contact with [redacted] started becoming belligerent with what work was supposed to be done on the job. [redacted] stated that to do any more work he needed more money. I told him he had not finished what was supposed to be completed in the first phase and there was no way I would be able to give him any more money without him completing the work. Now according to [redacted] himself, the workers had put in less than 3 days. When we returned I saw the state of the job, contacted [redacted] on the phone and told him of my displeasure. He assured me he was no con artist or liar and that he would finish that phase of the job. His workers had indicated to me that [redacted] drank so while I was having that conversation with him I indeed asked him about his drinking and his problem with remembering things. He admitted to me he did have a problem and I told him I understand and I want to work together with him to try to complete this. ( He is a local contractor who came recommended ). He asked me to leave a "punch list" hanging on the door when we left for yet another softball tournament and that while we were gone on this tournament in Virginia the work would be completed. It consisted of finish shingling the other half of the roof, animal cap on top of chimney, cap board under soffet, installing rear gutter and finish demo on the floor of the 6X25 deck that was left. While on the trip I got a hold of [redacted], told him I left the list, he indicated to me that he had a job on Thursday and Friday but would be there with the guys to finish, not to worry. I told [redacted] that when we returned from tournament that he and I would sit down, make a list of everything that was supposed to be completely done in the next phase, and we would have two copies that we would both sign so that we would not have any more of these problems with his forgetfulness and at this time I would be able to give him another $5,000 which is the amount he was asking for to do more work. I checked in with [redacted] again a few days later to make sure there were no problems when my oldest daughter who was at home, stated that no one had shown up. [redacted] once again became very combative and extremely difficult saying no work was going to be done until he received more money. I told [redacted] there was no way I could do that, that he had not held to his word and agreement. The work I want [redacted] to complete is the things listed from the punch list that I indicated. The information I am giving you is from our end on what we were dealing with and you have to understand [redacted] was constantly either changing work to be done or not remembering conversations so it was really difficult to deal with. We tried to keep it very simple with [redacted] by keeping to the agreement but he was constantly changing things; "it would be cheaper doing it this way, it would be better this way" and then not remembering having the conversations. He even insisted that it was going to be difficult to tie-in to the "valley" on the second half of the roof and that meant that he wasn't going to do it and that I should know that. If there is any other information needed, please contact me. I tried to do the best I could in explaining the situation. Thank you.[redacted]

Review: [redacted]

I am rejecting this response because:As I stated the original contract that totaled $14,170 consisted of [redacted] removing the damaged roof, both front and back side of rear dwelling and replacing that roof. Also repairing small garden roof and removing damaged deck from rear of house and installing a new deck. As I also stated the deck was supposed to be removed and replaced first originally and [redacted] indicated that it would be better to do the roofing and chimney work first so that new deck would not be scratched up or damaged while doing the roofing and chimney work, which we agreed to. [redacted] was given the first $5,000 and that was going to cover what [redacted] was calling the first phase which consisted of removing the old roof, installing new paper and shingles, repairing the garden roof and chimney and the removal of the old deck due to the fact that the dumpster would be in the driveway. To this point I have tried to be very reasonable and civilized but if this is the approach **. [redacted] wants to make an issue of the work that he did, so be it. Yes, he did remove the roof over the old deck. He did remove some of the handrails and columns from the surface of the old deck Since this procedure has started, I have removed the rest of the old deck that was contracted to be taken out. The "cut ridge and installed 30" ridge vent and end caps" as described is only 25" and was installed dented and damaged. On top of that, the old roof was never removed as per our contract because [redacted] insisted that the existing shingles were only scratched and nothing went completely through the shingles. Only one side of the roof was re-shingled leaving the other side unfinished as in my complaint. The white pine fascia board is incorrectly installed, the vinyl soffet that was used is not new, it was my old soffet material that was removed from my old damaged deck. The fascia board that was wrapped was supposed to match the other three sides of the house. It looks horrendous, not even close to the pattern of the other three sides of the house. It was put in with the fascia board on an inward angle instead of flush and it was wrapped flat and on the ends just pounded in with a hammer. The cap board under the soffet was not wrapped, the gutter was not installed and the animal cap was not placed on top of chimney are the other things not completed stated in my complaint. [redacted] makes no mention of these. The remark that [redacted] made that he removed all refuse I find to be an insult. My wife and daughter spent a good part of two days picking up all of the debris that was left strewn all over our yard and driveway. I would also like to note that the rest of the new shingles that were delivered to the job site for the roof that did not get done were removed by [redacted] and his crew. I would like to point out that the remainder of the $14,170 that we contracted for the job ($9,170 that was left) after the $5,000 given to [redacted] for the first phase, was to be used for building the new deck which was going to be approximately 25 feet by 18 feet. So the idea that [redacted] states that the money ran out is pretty outlandish. $360 for a canister, $199 for a permit, some new shingles and two and a half days pay for two men (who actually did the work) DOES NOT ADD UP TO RUNNING OUT OF MONEY. By going through the Revdex.com, we tried to give [redacted] a chance to come back and complete the roof and other things as contracted or should I say as told to us that would be done in the first phase. I have a feeling that's not going to happen. At the very least we hope unsuspecting and vulnerable home owners see this and do not fall prey as we have. Even though we still have sympathy for [redacted] and his problem, it unfortunately seems things will have to be legally taken further to resolve this situation.

Regards,

Ed Murphy
