Review: I purchased a 2002 mazda proteige 5 for 2650.00 and paid 335.00 in reg and trans fees. For three weeks later it to break down and find that it had a blown head at the time of purchase.I was told after it broke down that I bought a car that wasn't even ready yet.....Then how and why did they sell it to me???

Product_Or_Service: car

Desired Settlement: DesiredSettlementID: Refund

I want my 2650.00 and 335.00 back I also had to have someone else tow it their shop to be possibly worked on, so that I don't get charged storage while we wait for results in claim, from jacks chevron. I also purchased the oxygen sensor which I wasn't responsible for, for $160.91. And I feel I should get some kind of compensation because the car has still not even passed smog.... I feel I deserve a fair decision on this vehicle. Iwas hurried the day I bought the car was told that if I didn't co.

Initial Business Response

On 10/18/2013 [redacted] came in and wanted to buy a 2002 Mazda Protégé that we had that was a LEIN SALE car. We explained at that time that we didn't know the any history on the vehicle other than when it was towed in an that it was an AS IS VEHICLE because it was a LEIN SALE CAR. We would smog the vehicle but it wasn't ready to go at that time because it had a check engine light. She insisted she needed the car so we scanned car and determined that it needed the heater circuit O2 sensor was bad. She said she would pay for part and we agreed to install part for free. We cleared codes and informed her she would need to drive it for a few days to reset monitors. She took car and came back a couple of days later. We scanned car and found that two monitors had not run so she took car again to drive some more. Never once did she complain that the car was not running properly. On 11-8-2013 she called and said car had broken down so we towed vehicle into our shop. Upon diagnosis we found no water in cooling system. Further check found timing belt broke. Vehicle was driven until it overheated due to no water in system which is what broke timing belt. Advised customer further tear down required to further check. She asked if you would put a new or used motor in at our cost. We once again informed her that the vehicle was a LEIN SALE car and that there was no warranty. When the car was sold it had 158945 miles on it when towed in it had 159898 miles on it so she drove vehicle for 953 miles with no complaints. We do not feel that we are response for any repairs or motor replacement because vehicle quit working due to customer not check fluids. At the time it was sold and for 953 miles vehicle ran fine. And a month's time of driving.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

Because they are lieing. I have witneses that I was told if I wanted to buy the car I had to hurry because someone else was going to buy the car at five o'clock. I went to look at another car at this time and they NEVER warned me!! If the car was ready then why did they push the car on me? Also the car did have water in it!! My friend and I made sure of it. And I did complain about it. They instructed me three times to keep driving. Also at time of purchase jacks daughter and employee said they were taking care of the smog. I am a single mom and I feel they are responsible to replace because the car was pushed on me to buy. If said case is true they should not have had forsale signs on it at all until it had been gone over by one of the macanics. I was taken for granted because I was a female alone, and my daughter. They changed the sensor before I had even agreed to purchase the car and still changed it and charged me.

Final Business Response

Ms. [redacted] seems to be missing a very important point to this complaint. I will again state THIS IS A LEIN SALE VEHICLE. The vehicle was sold AS IS. We are not required to smog this vehicle due to it is a LEIN SALE VEHICLE. The vehicle just needed the drive cycles set an it would have passed smog. She drove the vehicle for a 1000 miles. She drove it until it got hot, due to no water in the cooling system, and damaged the motor.

Review: I purchased lein sale used car from Jack's service for $1200. It was towed back to him and he junked it without telling me and won't refund the money.

I purchased a used vehicle from Jack's Service on 6/15/13 for $1200. It was a 1999 Red mOnte Carlo. I tried to register the car in my name a couple of days later and he (Jack) did not give a bill of sale. This was a lein sale vehicle also. Therefore I returned to jack and he gave me a bill of sale, but it had the wrong date on it. So again I returned to jack. Finally I received the correct paperwork. When I got to DMV the women told me the fees were over $480 because the registration is 2 yrs old. So I waited to register the car and I went to talk to Jack about the cost for reg. He was NO help at all. He said he does not deal with that reg. stuff and I had no choice but to leave. Then approximately 2-3 days later I was pulled over for the expired reg. and arrested for Driving on a Susup license the car was towed and it went back to Jack's. When talking to the manager he I explained that I could not pay any storage or tow fees again and that I don't feel I should have to since he did not provide me with the proper paperwork to get the car registered. He said just get the car registered and we would work something out. A couple of week later I did attempt to have the car registered and the women stated the car had been junked. Therefore I could not even own the car since it was junked by another place. When I went to him with this information he said that he had it junked and he was not going to give me my money back either. He said that it was my fault I never registered the car so he junked it. He never notified me of the intent to junk it either. Now I am taking him to small claims court. Desired Settlement: I plan to recover my $1200 plus the money I had to pay for a mechanic to look at it $150, and the bail money I paid to get out of jail when I was pulled over that day it was towed $2000. Making a total of $3700.

Case # [redacted]

To Whom It May Concern,

Ms [redacted] did buy a 1999 Chevy Monte Carlo from us. At the time of purchase she was informed that there was fees owed on the vehicle to DMV. We didn't know the amount owed she would have to deal with DMV, we don't pay for the back fees owed and she was fine with that because the vehicle was so cheap. Also the vehicle had expired tags on it at the time of purchase. The vehicle was a lein sale vehicle and she was given all the lein sale documents at the time of purchase. She did come back a week or so later and was given a bill of sale even though she already had all the lein sale paperwork. On June 30th, 2013 she was pulled over for no registration, narcotics and for driving on a suspended license. When the new lein sale paper work was started it came up again registered to the former owner not [redacted]. Which means she did not take care of the paper work at DMV, or even start the paperwork with DMV. The lein was filled again and we held the car for another 30 plus days per lein sale requirements. Ms [redacted] stopped in several times and was informed that the lein had been filed an she needed to go to DMV an get the paperwork finished and contact Sutter Creek Police Department to get a release to get the vehicle out of impound. She did nothing! She states she tried to get it registered but it had been junked is incorrect. The lein was started all over again and a 30 day lein was done not a 15 day junk. We had the vehicle from June 30th til August 20th 2013. She came in a week ago because we had towed in her father's pickup that she was driving and got it impounded because she had narcotics in the vehicle and was driving on a suspended license. At that time she demanded her money back for the Monte Carlo. If Ms [redacted] had registered the Monte Carlo, had a valid California driver's license we would not have been called by Sutter Creek Police Department to tow the vehicle in. We do not feel that she is owed any money back because it is not our fault that she didn't take steps to recover the vehicle after it was towed, nor prior to it being towed. She had over a month's time to register the vehicle and failed to do so. Even if she had registered the vehicle she still would have gotten it towed for driving on a suspended license. If it had been in another tow company's area the same results would have transpired. They would have leined the vehicle and she would still not have a vehicle. We feel that Ms [redacted] is being vindictive towards our company due to the fact that this is the third vehicle of her's that the local police department has had us tow due to narcotics, driving on a suspended license and no registration. Hopefully this helps clear up this matter. If you have any further questions please feel free to contact me at (XXX) XXX-XXXX.

Sincerely

Review: My trailer was not working properly, and I took it to Jack's Service to get inspected and repaired, once a diagnosis was provided. Upon inspection, the service technician stated that the "Wheel Bearing Race" and wiring for the electrical brakes needed to be fixed/or replaced. I was asked to provide the parts (Wheel Bearing Race). I went to [redacted] in Tracy, CA., where I purchased my trailer originally, to get the part specified. Upon supplying the part, the service technicians had stated that they had completed the work, and that all was in working order to use the trailer. I had to transport some equipment in the trailer one afternoon, and noticed that the trailer was not working properly. In addition, other vehicles on the roadway were pointing at my trailer, as if something was wrong. I immediately pulled over, and had noticed the axle/bearing part that was replaced was not held in place. Rather, it was loose, not secured by the parts provided. The tire, rim, and electrical wiring sustained damage, due to the loose axle. Both the CHP and Freeway Service Patrol attended to my needs. This issue could have been life threatening, as a loss of control could have resulted from the work that was completed by Jack's Service Station. I took the trailer to [redacted] in Tracy, California. Per the inspection by that shop the following was provided in writing:"The following parts and labor were used to repair the damage of not welding the leaf spring purches to the axle when it was installed". [redacted] from [redacted] told Jack it needed to be welded on (parts were with axle). Instead of following the proper service steps to repair the trailer, replacement bolts were used instead of what was included with parts.I am thankful that both my wife were not seriously injured due to this incident. I tried to communicate this entire issue to Jack; however, no resolution was offerred. Specifically, I paid Jack's Service $271.31 for the supposed service.Desired Settlement: First, I want to be refunded the $271.31 that Jack's Service charged me to supposedly repair my trailer. In addition, I want to be compensated for the damages sustained after the repair. [redacted] charged $491.26 for the new tires and repair work to remedy the negligence on behalf of Jack's Service. It was clear that the axle needed to be properly installed-per the evidence provided by [redacted].
