I have reviewed the complaint that was submitted to you against my business by [redacted] , your case no [redacted] Duffer Construction entered into two different remodeling contracts with Ms [redacted] , the first being on April15, 2015, for a total of $2,to remove two plaster walls and sheet rock and refinish the area for a total of $2,I am attaching a copy of that proposal as exhibit AThat contract was performed and paid without complaintThe second contract with Ms [redacted] was on April 23, 2015, which was accepted by Ms [redacted] on that same date and involved the replacement of eleven windows and other miscellaneous window work for a total of $5,of which $3,was paid in advance leaving a balance of $2,to be paid upon completion of the workA copy of that contract is attached as Exhibit BI ordered the windows and proceeded to install them when they arrivedMs [redacted] asked me to save the two bedroom windows to do last because her daughter had tonsilitis and there was too much stuff in the room to move out for me to get in to do the work, which I agreed toAt that point she decided that she wanted one more window replaced which I orderedI agreed to provide and install that window for an additional $on a written amendment to the contractThe window was supposed to be delivered Wednesday, May 27th and I scheduled the installation for Thursday, May 28th When I called the window supplier on Wednesday afternoon they advised me that because of Memorial Day weekend it would not be delivered until Thursday, May 28th, too late in the day for me to install it that dayMy son and employee Jason D [redacted] went to the [redacted] residence at about 9:a.mon Thursday, May 28th and advised the male resident that the window would not be there until later that day and we would install it the next dayAbout 10:AM Ms [redacted] called me and was VERY angry and advised me that she was going out of town for two weeks and she would call me to put it and the last two other windows in when she got backShe called two weeks later and I arranged to install the window the next day, June 18, I and two employees went to the residence on June 181h to install the last three windowsWhile my assistants were setting up the saw and unloading materials, Ms [redacted] asked me when I was going to install the carpetWhen I told her that I did not bid carpet installation or any flooring installation and read the contract to her that says nothing about flooring she then told me to leaveI packed up my tools and equipment and we left the premisesLater that day the police came to my shop and advised me that she had filed a civil no trespass order against me and I was not allowed to go onto her property or speak to herI subsequently filed a claim of lien against the residence for the $2,owed to meI still have the three special ordered windows that are not usable in any other location and am ready willing and able to install them for the completion of the contract or to deliver them to her upon the payment of the balance owingNeither of the contracts involved installing any flooring in the residenceHowever, in the bathroom remodel, the toilet was removed by the plumber and there was no toilet available in the residence for the occupantsI discussed that with Ms [redacted] Because she was going to be without a toilet for a long period of time during the installation of the fixtures by the plumber, I discussed the flooring with her and agreed to install enough of the flooring to install the toilet soley as a courtesy to her so that she would not have to pay to have the plumber install the toilet and then remove it and reinstall it after the flooring was installed by whoever she hired to do the flooring workThere was never a verbal or written agreement with Duffer Construction to do the carpet or any flooringShe showed me samples of what she wanted installed in the bathroom as flooring and then she bought the materials and I did agree to put enough of it down to install the toilet solely as a favor to her, without charge, which I didOther contractors have also had problems with herThe electrical work on the project was done by Hunt Electric of American FallsSierra Plumbing and Heating of American Falls started the plumbing work but did not finish it because of disagreements with Ms [redacted] The plumbing was finished by Platinum Plumbing from PocatelloLusk Plumbing of American Falls can verify that they refused to bid the job for her because of her attitudeAll of those contractors can verify that she was difficult to get along with and they had trouble collecting their money from herThis complaint is baseless and was filed in retaliation only after she refused to pay me and I filed a claim of lien against her propertyI intend to proceed to enforce that lien through the courtsSincerely, ***SUPPORTING DOCUMENTS REDACTED BY Revdex.com***

plaster walls and sheet rock and refinish the area for a total of $2,100.00. I am attaching a copy of that proposal as exhibit A. That contract was performed and paid without complaint. The second contract with Ms. [redacted] was on April 23, 2015, which was accepted by Ms. [redacted] on that same date and involved the replacement of eleven windows and other miscellaneous window work for a total of $5,600.00 of which $3,300.00 was paid in advance leaving a balance of $2,300.00 to be paid upon completion of the work. A copy of that contract is attached as Exhibit B. I ordered the windows and proceeded to install them when they arrived. Ms. [redacted] asked me to save the two bedroom windows to do last because her daughter had tonsilitis and there was too much stuff in the room to move out for me to get in to do the work, which I agreed to. At that point she decided that she wanted one more window replaced which I ordered. I agreed to provide and install that window for an additional $500.00 on a written amendment to the contract. The plumbing was finished by Platinum Plumbing from Pocatello. Lusk Plumbing of American Falls can verify that they refused to bid the job for her because of her attitude. All of those contractors can verify that she was difficult to get along with and they had trouble collecting their money from her. This complaint is baseless and was filed in retaliation only after she refused to pay me and I filed a claim of lien against her property. I intend to proceed to enforce that lien through the courts.
