[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: As I explained the day of the incident, it was impossible to stop The time of day this occurred was morning rush hour and I was being flagged to more on during the congestion of the situation This was occurred in front of a part on a narrow street The milling equipment was being run and I was flagged onI heard a hit to my car but in now way was I able to stopI would have caused an accident if I had attempted to stopIt was a hot day made hotter by the street paving being doneThere was no one to speak with at the time my car was hit as they were running the paving equipment Since this business is aware of what takes place during street paving, if they had bother to read my complaint, they would have understood the situation Their insurance adjuster also did not come out to view the damage If the insurance adjuster had viewed the damage, they would have seen that my explanation of the situation corresponds to the damage done to my car I am sorry that this business receives fraudulent claims but that in no way should effect how my claim is handled Again, I called immediately, took pictures that were sent in immediately and was put off by the business consistently It was not until January 2015, that they notified me that this was reject when I originally contacted them in July If an agent had looked into this the day it happened, again the damage would have corresponded and the scene congestion of where this took place would have been realizedThe damage was done and they should pay for it I am sure the insurance company could easily look into my background and determine that fraudulent claims are not in my history Sincerely, [redacted] ***

The drivers for this company have no regard for pedestrians or the people (and their personal vehicles) who live on the streets on which they are doing business Today, as I was pulling out of my driveway to go to work, there was a fleet of trucks from this company on my street They were obviously lost/in the wrong location because all of them started to make u-turns and tried to get off my street As truck #was backing up to leave, he almost rammed my car even as I was honking my horn to warn him he was about to hit my car He completely ignored my honking, and if I didn't put my car into reverse at the last second, he would have plowed into the front of my car with the back of his big truck I asked him what he was doing and did he realize that he almost just crumpled my small car with his big truck He ignored meI tried to get his attention and kept talking to him and asked why he did that He then verbally abused me and spew profanities at me, when in fact, I did nothing wrong The other trucks must of thought this was funny because they were all laughing as I drove past them to go to work finally after nearly avoiding my car almost being crushed by a giant street paving truck This company is a menace as far as I am concerned I am going to do everything I can to deter business away from this company They don't deserve to be in business, They are unprofessional, dangerous and rude I am going to file a complaint wit the Revdex.com to ensure that they are held accountable for their actions and that everybody knows what kind of business this really is

Please accept this response to the complaint submitted by [redacted]. We are a Street & Road Contractor and have been in business since 1960.
We take pre-cautions when working on a road during all phases of our project. The roads are...

municipal roads in townships we have been awarded the Street and Road Project. Our safety record is very good and we recognize the importance of working with township residents when a problem occurs. If the incident happens while we are on-site, we are able to speak with owner of the damaged property immediately to address the issue. If the person does not stop or the incident happens after hours, we endeavor to investigate the claim. However, at this point, we are advised by our Insurance Broker and Attorney to submit a claim to our Liability Insurance Co. to protect our Co. I am sure you understand this practice, as we have experienced false claims filed against us for damages that were not a result of our work or operations.The Insurance Contract includes an “Assignment Clause” that requires us to assign the claim to the Insurance Adjuster. We cannot negotiate with the claimant, and we are bound by the decision of the Insurance Adjuster. After their investigation, it was determined that there was not sufficient proof to hold our Co. responsible for damages. We were not negligent in our actions and the Insurance Co. denied the claim. We rely on them for the investigation, and we are bound by their decision. We have found insurance Co.'s have been very fair with handling the claims.
We met our obligations, and [redacted] would have to submit a claim against the Insurance Co. We have enjoyed a good reputation, and we hope you understand our approach to claims presented against us.
