Great Job, Never finish Completely
We were scheduled to have our property re-painted in July 2020, but since we were out of State in May, and in deference to the Covid Virus, the painter wanted to do the job during My in our absence. The over-all job was done very well. JWD did a very responsible job of repairing quite a bit of deteriorated wood, and the over-all paint job was very well done However I paid then in full when they said they were completed, big mistake. It is details that were not finished properly, such as:
1. Paint over spray on many windows, which JWD said were from a prior painting; several of those areas are on windows 100% renewed since the last job, 10 - 12 years ago.
2. Our white Chevy Suburban, which was in the garage, has a good amount of over spray on its rear end.
3. A sill on the bay window in the dining room, has started to deteriorate, JWD started a filler type repair, but left it entirely unfinished.
4. All of the shutters were re-hung, but never screwed back to the house to prevent them swinging in the wind.
JWD and I have had several texts, e-mails, and phone conversations, and he has promised to come complete the job, but it is going on 3 months now, and no one has showed up.

I had a contract for exterior painting of my house for $2500 plus optional wood repair, signed on 9/2/2011, with a promised work start date of 9/12/2011 and an initial payment of $800. He cashed the check the same day. On 9/12, around 7:00 AM, I called to inquire about what time they would arrive to begin work and left a voicemail message. At 9:30 AM, there was no returned call or arrival of work crew, so my wife called and left a voicemail. A while later, my wife received a call stating that we called 3 times already (only two times actually) and that he said the start date would be Monday, 9/12, or Wednesday (neither my wife, nor I remember hearing about the possibility of Wednesday). We told him he should have called to let us know he wasn't going to come on Monday. He apologized and said he'd be out on Wednesday. Wednesday, 9/14, came without a phone call or a work crew. We called him and left a voicemail. He called back later and said his current job was delayed and he'd be out next Monday, 9/19. I anticipated a phone call before Monday to let me know he had finished his job and would be out on Monday and I didn't receive one, so I called Sunday morning and left a message to call my home phone number, and I left him the number (he had previously contacted me several times at my work number, but it was Sunday). I didn't hear anything from him. At 10:45 PM, after reviewing weather forecasts and discussing his inability to inform us of his intentions, we decided to cancel the contract. There was no work started and we had no believable indication that it would be started. (After the fact, I learned that he had called my work number around 6:00 PM to say he wouldn't be out on Monday, pushing it back to Wednesday, again.) Monday morning, I went to work without a phone call after my message to cancel. Around 8:00 AM an email was sent to me from [redacted], on behalf of [redacted], stating that [redacted] was delayed because of rainy weather the week before, they can't control the weather, they don't refund "deposits" because they could have scheduled another job for that time and they were scheduled to be out now on Wednesday to start the job. [redacted] sent another email around 10:00 AM the same day, suggesting that they could reschedule our job for the spring while holding our deposit "of course." I received these emails after I returned home from work and replied at that time. I stated that if they are able to reschedule my job for the spring without detriment to their business, then they can cancel my job, return my deposit, and I'd consider them again in the spring when weather permits. I received a call from [redacted] minutes after that email was sent. That was the quickest reply we've ever received from him. I told him that I wanted my $800.00 back because the weather was getting colder and we couldn't rely on him actually starting the job. I also told him that I also wanted my money back because he failed to act professionally and call me when there was a scheduled start date, whether he was coming or not. He was told to call after the first offense and had multiple opportunities to call, but failed each and every time. [redacted] made excuses that the weather was delaying him, but he never tried making excuses about his inability to call us. That was apparently a "non-issue" for him, even though we are the ones who were paying for the job. Regardless of his excuses, I told him to just send my money back to me, and I repeated it several times. As far as the "contract" is concerned, there is nothing that states that my $800.00 was a "deposit" or that is is non-refundable. It was 1/3 of the price of the job, and since there was no work even started on the job, I feel that I am entitled to the entire amount returned. Again, since they offered to reschedule for the spring, they cannot claim a loss of business by my cancellation.

While the weather was a concern of ours, it wasn't the only concern. [redacted] had scheduled multiple start dates without actually showing up or calling without us having to call him first. He also never answered the phone directly. We had to leave a message and wait for a call back. Other comments: The quote I received by email quoted $2500 for the preparation and paint, with an optional $200 to $400 for replacement of wood on the exterior. It also stated that there was a 5 year warranty on his work. The contract, on the other hand, was lacking both of these points. That was blamed on [redacted]'s wife, [redacted], so I wrote it in by hand. Ultimately, the lack of information on the contract, followed by the lack of phone calls and the lack of performance, brought his credibility into question. That, combined with cooling temperatures, led to our decision to cancel the contract. I'll be happy to provide copies of the original quote, the contract and associated emails. There were two additional email requests I sent for information that went unanswered, at least until we finally got a phone call, or called to cancel the contract.
