This particular building that this resident lived in was in desperate need of updating and renovations on both interior and exterior of the buildingOn 5/8/15, we began the process of walking the property with contractors in order to obtain the necessary proposalsOn 5/7/15, we sent a letter (attached) notifying the resident that we would be entering the apartment in order to start this bidding processWe then gave the resident notice of our return entry on 5/11/(attached)We then sent notice to all occupants of the building on 5/22/(attached) stating that we would be doing numerous updates and improvements to the building and that these improvements were expected the continue through the end of JuneWe than began work on the exterior of the building such as; paint, brick work, concrete, etc, but had not yet needed to gain access to the interior of the apartment units at this timeOn 5/27/15, a notice was sent to the resident (attached) stating that we would be entering the apartments to begin installation of new windowsWindow installation began on several different areas of the building, but not yet this particular apartmentOn 6/12/another notice was sent (attached) to this particular resident stating we would be entering this specific apartment to replace the old aluminum windows with new vinyl double hung windowsOn 6/18/15, the resident emailed (email attached)stating she had returned home to find that her apartment was dirty, and that there were holes in the wallThe complainant also stated that the apartment door was unlocked, however, contractors were in the hallway still workingI spoke with the resident on this same day (the same day of the initial complaint) and advised that the contractors were still working and that they would clean any debris upon their departure for the day and that they were still there working, thus the reason the door was unlocked and the contractor was insideI verified with the contractor that they did in fact vacuum and wipe down the apartment prior to their departure on 6/18/The complainant stated she was refusing to pay any future rent because her apartment was dirtyUniversity Apartments feels it gave plenty of proper written notice to the resident and resident failed to follow or read the letter6/18/is the ONLY date that [redacted] and resident communicated with each other, at no point did were there any unanswered phone calls or emailsOn 6/18/15,the same day of initial complaint, University Apartments offered to release this particular resident on 6/29/from the agreed upon lease agreement at the resident's request, which originally expired on 7/15/University Apartments feels it went above and beyond with notifying ALL residents of said building of dates of entry and notification of building improvements, as a matter of fact, other residents have personally thanked us for doing much needed improvements! On 6/22/a final notice was sent (attached) stating that we would be entering the apartment the week of 6/22/- 6/26/to complete repairs, this process was expected to take 4-business days, which is clearly stated in the letterThis particular resident vacated the apartment on 6/29/15, days prior to lease expiration date and University Apartment waived all rental and utility charges for the month of July University Apartments has suffered an income loss for this particular apartment, but we felt that we were doing what was necessary to keep the customer happy

the response is falseI have photos I can attach of the debris left behind by the contractorI emailed and called several times to which the office phone just kept ringingIt was very difficult getting in contact with someoneIf the attached photos are considered ok by University Apartments standards then that is very telling of the type of people I chose to do business withThere were ants and flies all over my apartment due to the windows being poorly sealed and the gaping holes leading to outsideI was notified of the construction but just because you are adding updates to an apartment, it doesn't mean you lose responsibility for the care of tenantsIn fact, I think a judge would understand my argument that the level of care is enhancedIf you chose to do updates to a residence while tenants are still in the dwelling, you have a higher duty of care to make sure they are not affected by what is going onThe contractors they chose are very sloppyThey left my belongings scattered about and did not replace my furniture they way that they found it. Because of this confusion, I terminated my lease earlyI am no longer a tenant and I couldn't be happierI'm sure if you surveyed the other tenants, they would have nothing nice to sayI actually spoke with them about the work being done and we are all on the same pageI'm just the only one who would take things to the next level if need beI care about where I spend my money and this past month has been hell to live in such a gross placeSimply notifying me of construction isn't enough to satiate the ORC's Landlord ObligationsUniversity Apartments is trying to rush a job that should take longer to prepare for the next tenant I am happy that my new landlord was able to allow me the chance to move in early because I couldn't stay there any longerThe construction company representing University Apartments had no regard for my thingsIt is very unprofessional and it wasn't safeI would be hard pressed to find a judge who would consider the photos I attached in code for housingI have more photos of the debris and damage left behind by the construction crew

I am rejecting this response because: I never received any notices stating that I had balanceI didn't not leave at that address anymore instead they kept sending them to the wrong address I'm sure they got the returned mailed that they had sentThey
didn't turn it over to collections until May of When the collection agency called meThey stated hey had just got this collections bill in May of and had only had in their hands for daysThey also stated hey sent me notifications to the address given by the gym at which I do not live atThey also stated they had sent me serveral and I never responded so days before they sent it to my credit they called me on the phone number given fromThe gym which had been the same since and demanded the money in days or hey would send it to my creditIt took them years to send it into collections when it should've been the year of I did call and speak to someone at the gym about cancelling my membership because whom ever took the call didn't make proper notes is not my fault.

We have reviewed the photos with management and the contractor and we are unsure of what exactly was damaged to the point that it had to be disposed of? From the photos, what we can see is that windows were being installed, which caused some dust, dirt and debris to be present in the apartmentHowever, we do not see how it affected something to the point that it was not salvageableAs for the furniture not being returned to it's original placement, the contractors were still installing the windows and the project was still in progress, moving your furniture and television back to it's location could have potentially caused severe damage to the electronicsWe feel that we gave the resident significant amount of time to take proper precautions in moving personal belongings out of the way of construction, including clothingthe contractors moved what needed to be moved to gain access to the window areaOnce the project was completed, the apartment would have been returned to it's original condition (if the tenant would've stayed)
