Maglieri Construction & Paving, Inc. paved the driveway in 2011.  The following spring/winter,...

someone broke the edge on the driveway and we fixed it at his request, at no charge.
 
His driveway is off the common roadway that we paved.  He installed a drain which settled around it and in the spring, we repaired at no charge, at his request as well.
 
We’ve made several trips to repair the common roadway, which is used by several neighbors, including snow plows, delivery, construction and fuel trucks.  The driveway is very narrow and we did not install, design, or put down the base material on the original driveway.  We graded and installed additional stone to existing base and then paved.
 
We recommended a 2 course paving due to the amount of traffic; customer did not accept due to the additional cost for 2 course paving.
 
It was recommended, per his contract, to backfill the common roadway shoulders to give required support to edges.
 
We offer a 1 year warranty on the contract.  We have not refused to service him at any time.  We have serviced him every time he has requested service annually since 2011.
 
We are willing to do the crack filling, at no charge, but as always, we asked that the customer please wait until we are in their area with our crew.
 
We are very sorry for his frustration, but will get him serviced within the next 2 weeks, weather permitting.

I am not in full agreement with the response from [redacted]  They have only been to my house two times to make repairs.  Once to fix some spots where weeds grew through the pavement and one time to heat the cracked areas which was supposed to fix them.  That was a temporary fix and the cracks have worsened. I have called [redacted] 8 times since December 2013 to get these and many other cracks fixed.  I was told numerous times that they would be out here first thing in the Spring, it is now August.  [redacted] also mentioned about cutting and patching the bad areas when I first talked to him about the cracks, but that has not been offered since then.
Maglieri did not install the base material, but they did come out and inspect it with a backhoe before any works was started and they said it was acceptable.  At no time during the negotiations did Maglieri or any other contractor mention a two course paving and I never received a price to do it.  This was mentioned for the first time last month when I complained again about the cracking.  The common driveway is 11.5 feet wide and is only shared with two other houses.  The first house is only a couple hundred feet up the driveway.  I have been told by a driveway repair company that my driveway is wide enough.
The drain was installed before the base material was installed around it by Maglieri.  I did backfill along the common roadway and my own driveway.   To say that snow plows, delivery and fuel trucks use the driveway is true, but this is true for all driveways and they should be able to support them.  My neighbor and I use the same fuel company and they deliver to both houses at the same time.  We also both work from home which helps cut down on the use of the driveway.
[redacted] has been very nice when I have been able to talk to him, but I still question why my driveway is cracking as bad as it is for a new driveway which cost $22,000.  It seems like it is only 1.5" in some places and it should be able to support the weight of normal traffic.

We hired Maglieri Paving to replace our home driveway. They were impressive from the initial contact to the end of the job. They responded to an email request for a quote within the day ( actually, it was within the hour). The office staff was a pleasure to deal with. They were responsive to our scheduling concerns. We received an estimate promptly ( and on the day he said he'd be here!) The driveway is beautiful, neatly done, and we expect it to last. Thank you for an impressive company and contractor that clearly takes pride in their work.

Review: Maglieri Construction paved my new driveway in the fall of 2011. In less than a year after it was paved, it started to crack. I talked to them multiple times and they finally came out and heated the cracks to fix them. The repaired cracks got worse and more cracks have developed. I have been trying to get them to fix the cracks since the beginning of this year. They keep telling me that they will be out here to fix them and no one has shown up. I last talked to [redacted] the owner on 7-11-14 and he said that [redacted] would be out here the following week to make repairs. That has not happened and I am tired of calling them and getting the same answer. I paid over $23,000 for the driveway and I would expect it to last more then a year before it showed cracks.Desired Settlement: I would like Maglieri to fill all of the cracks with rubber and seal the entire driveway. If the cracks are not repaired by the winter. Water will get in them and make it worse.
