I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.However all the books, navigation cd's and second key that belong to this car has not been send to me as promised, all those items are quite expensive to replace and even thou is a use car is Bentley certified and all those items still due, also my temporary registration is about to expired and I have not received the plate and registration either.

Client requested a modification of a contract after several days. Client visited our facility and requested and agreed to change the terms of their contract from a 2 year limited warranty to a 1 year limited warranty. Client also requested and agreed to change the existing tire and wheel warranty...

from a 6 year warranty to a 2 year warranty. Client submitted complaint prior to this resolution. Client is agreeable to new terms and conditions. Manhattan Motorcars worked with client in good faith towards this resolution in order to satisfy the client.

Review: I am writing this letter in an attempt to resolve an issue I have with my 2014 Porsche Cayenne GTS. The vehicle was purchased in February 2014 at Manhattan Motorcars, [redacted].

Allow me to begin by saying I am deeply dissatisfied with my purchase and my experience with my salesperson, [redacted].

While [redacted] was a consummate salesman and I believe he could sell anything to anyone, the problem lies in delivering what he promises and following up with the product.

There are issues with the technology (i.e. Bluetooth, audio and navigation system) that I can live with, but the car I test-drove had a specific type of driver’s seat that I required with the vehicle I purchased.

When I received the vehicle, it had a completely different seat, which I pointed out at the time and was told, “Don’t worry, we’ll fix everything.”

The sales presentation led me to believe without any ambiguity that the seat in the vehicle that I test drove would be the seat that I would receive should I purchase the car.

After a few weeks, I began to have difficulties with my back even though nothing else had changed with my personal health.

I made an appointment with my salesperson, [redacted], and he advised me to, “Buy a pillow from Bed, Bath & Beyond, lots of people have this same problem with this chair.”

I did has he suggested, which did not solve the problem. I do feel however, that it is ridiculous to drive a $100,000 Dollar Porsche with a pillow!

Further correspondence kept returning to the solution of a pillow. I would understand if this was a special pillow designed and manufactured for the Porsche, but it appears that no such specialized pillows exist. I am led to believe that the staff of Manhattan Motorcars did not have any real desire to address my problem.

I called Porsche customer service, which informed me that they have nothing to do with this issue and directed me back to my salesperson, [redacted]. When I spoke with my salesperson again he offered to sell me a used seat for $4000 Dollars. I reminded him that I have a NEW 2014 Porsche Cayenne GTS and that I do not want to install used parts into my new car. [redacted] then told me that if I wanted the seat that was in the car I test drove I needed to buy a new car at an additional $20,000 expense.

I have tried to resolve the issue with Manhattan Motorcars several times to no avail. On the whole they were very dismissive of my concerns.

I have also written to [redacted] and [redacted] of Porsche Cars North America with this issue and received no response.Desired Settlement: I would like to have the seat I test drove installed in my car.

Failing that, I would like to return the car for a full refund.

I only want to receive what was promised to me for the price I agreed to pay.

Response:

[redacted] purchased a 2014 Porsche Cayenne GTS in February 2014 from Manhattan Motorcars. The purchase was for an incoming vehicle which he identified and thus accepted delivery of in person without issue.

Approximately 10 days after delivery he sustained a flat tire which we repaired and at that time with no mention made about any discomfort in his seat.

After a considerable amount of time and after driving the car for over 6,000 miles he then mentioned to his salesperson that he had some discomfort his seat and demanded an unreasonable and immediate resolution consisting of a free replacement car in May 2014 at no cost to him.

In an attempt to resovle this client concern we have made a very fair proposal to trade [redacted] into a new 2014 Cayenne GTS with the seats he now has identified as his preference with some cash out of pocket and credit terms similar to what we obtained for he and his co-buyer on approved credit on the first transaction.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I expressed dissatisfaction with the seat to [redacted] upon receipt of the car and was given assurances that it would be handled.

Furthermore, my phone records show dozens of calls to various representatives of Manhattan Motor Cars since receiving the car. Their allegation that this complaint came after 6000 miles is patently false and in line with the deceptive practices that involved passing off an inferior product than I test-drove. I can furnish the phone records if necessary, as they further prove that this company continually postponed dealing with my complaint.

The issue with my back notwithstanding, I have a long haired dog and would never select a two-toned seat.

It is the salesman’s duty to properly represent the product. This is a case of bait and switch and the business continues to misrepresent the situation, just as they misrepresented the transaction with the seat.

I have had further issues with this business since that time beyond the parameters of this complaint regarding their service practices (long response time with potentially dangerous engine situations, failure to secure loaner car when service was finally scheduled, etc), but this issue with the seat has been an ongoing problem.

The businesses’ answer to my complaint continues their attitude of dismissive behavior now that they have my money, much like their answer to my issue with the seat has been “go get a pillow from [redacted].” If Manhattan Motor Cars can produce a pillow designed and manufactured by Porsche that replicates the seat I test-drove, I will withdraw my complaint.

All I am asking is to have the seat that I was promised when I test-drove the vehicle.

Perhaps it would be more productive if [redacted] would keep this a professional and polite interaction.

Continuing to barrage Manhattan Motorcars employees with personally charged harrasing and insulting email is unbecoming and unacceptable.

Our policy is and always has been to attempt to create and amicable solution for clients and we have offered him a few options which he refuses to accept. At this point nothing further can be done other than what we have on offer.
