I am in receipt of the Complaint Activity Report Case # XXXXXXXX filed against BELFOR by Mr*** *** through the Revdex.com of Northern Indiana dated 1/12/and I appreciate the opportunity to provide further
information on this matterBy way of background, BELFOR entered into a contract to complete repairs at Mr***'s home in August of following an electrical fire at the premises of Mr***BELFOR timely completed the work in November of 2016, and Mr*** signed a Certificate of Completion indicating that he was satisfied with the work, with the exception of minor punch list items
BELFOR invoiced Mr*** for the work per the agreed upon scope generated by Mr***'s insurance company and paid to Mr*** upon completion of the projectA Liberty Mutual reconciliation of the payment amount is attached for your referenceTo date, Mr*** has only paid BELFOR *** leaving a balance due of *** Of this balance due, Mr*** has received Insurance proceeds of *** which he refuses to turn over to BELFOROn January 6, a lien was placed on the home of Mr*** for non-payment of workBELFOR believes receipt of the lien documents prompted the filing of this complaint, in an attempt to persuade BELFOR into letting Mr*** keep the balance of the insurance proceedsHowever, these proceeds were assigned to BELFOR in the contract signed by Mr***
In addressing the specific concerns outlined by Mr*** in his complaint, BELFOR is committed to working with Mr*** to resolve any valid workmanship issues as soon as possibleIn his complaint, Mr*** raised the following issues, each of which is followed by BELFOR's response:
No heat in basement: Installation/repair of heat in basement was not included in BELFOR's scope of work for this project
Counter tops separating from walls: Approximately a 3' length of countertop has pulled away from the wall less than 1/2"BELFOR will repair and re-install caulk on the length of cabinet that has pulled away from the wall
Trim coming loose: Two pieces of scribe molding along the top of the kitchen cabinets are loose on the endsBELFOR will repair the loose molding
Leaks in plumbing, other plumbing issues: Rough plumbing was the responsibility of Mr*** on this project, as Mr*** pulled the plumbing permitsIt was not included in BELFOR's scope of work, and Mr*** has not been billed by BELFOR for any rough plumbingAccordingly, subsequent repairs to plumbing are not BELFOR's responsibility
Concrete in basement done incorrectly: All concrete work completed in the basement was done in accordance with building codes and industry standards, and has passed municipal inspection
Porches not done: BELFOR's scope of work did not include any repair or replacement of porches
Ice in basement: Mr***'s home is in a flood plainHis basement had much evidence of flooding prior to Belfor ever entering his homeDuring the construction there was a time where there was a lot of rain and snow melt and his basement flooded with about 6" of water and then froze before it could be drained outTo our knowledge the home sustained no damage as a result and if it had Mr*** would need to file an additional insurance claim for said Flood damageIn any event the flooding was not a result of any actions of Belfor
Owner claims he was charged for stolen materials: If materials were stolen from the job site, the materials were replaced at BELFOR's expenseMr*** was only charged for materials and labor actually included in this project, a majority of which he has failed to pay for
Work took longer than expected: The contract between the parties did not include a completion dateAdditionally, Alternate Living Expenses were paid for by Mr***'s insurer for the duration of this project
On February 6, 2017, BELFOR conducted a walk-through inspection of the premises with a local municipal building inspector and has already begun repair of the punch list issues above
