I am rejecting this response because:  Mr. [redacted] failed to honor his word.  I waited all weekend for him to contact me and he has not called or texted me.

I did do the job for Ms. [redacted] last year. On completion of the job Ms. [redacted] was pleased, and paid us promptly. It was not until some 10 and 1/2 months later that I was made aware of any alleged damage to her drive. I received this notification by certified letter. She never called me, wrote...

me, emailed me, or attempted to make any contact with me prior to sending this letter that I am aware of. My question to Ms. [redacted] is, why wait over 10 months to notify me? Why wasn't a complaint made before paying me? Why all of the sudden, after this much time, would she decide that my company had damaged her drive? If Ms. [redacted] can provide solid evidence, that we indeed caused the damage, I have no problem solving this issue with her. However, over 10 months after the fact, anything could have damaged her drive. IE, garbage trucks, or other utility trucks that frequent the area probably weekly.

I am rejecting this response because:  By accepting his response, I would be indicating the issue is resolved and it is not resolved.  However, I do appreciate Mr. [redacted]'s willingness to inspect the damage and view the proof that I have.  Since he stated that I could suggest a third party, I thought of my neighbor [redacted] since she is close by. She does not know anything about the issue as I have not talked with her about it.  Therefore, she is a neutral third party. Due to her work schedule, she is only available on Saturdays.  I asked her if she could be present and she said she could on most any Saturday.  If possible, I would like for this to be set up quickly since my Doctor has advised me of health concerns I will be facing in the near future.

Thank you for the reply. Question number one. I asked for solid evidence that our company caused the alleged damage. Please provide it for me to review. If I certainly caused the damage, I will correct the damage. I would also like to request any and all written documentation that she has for review. I do not recall the exact conversation I had with Mrs. [redacted], and think that after this much time, would be irresponsible of me to confirm or deny any verbal communication. I do recall speaking with Mrs. [redacted] about a the fence in question, and remember telling her that removal of the fence was an option, but I do not specifically recall telling her that we would remove it. I do specifically recall her telling me that she wanted to do the job with the least amount of impact to her yard. The question has never been whether or not we used Mrs. [redacted]'s drive for access. The question is, did we indeed cause structural damage to it? A video of my skidsteer tractor on her drive does not conclusively prove that we damaged anything. Also, if she was videoing this alleged damage while it was occurring, and told my operator that he was damaging her drive, why did she not stop the work immediately, and notify me or my office then? I assure you, if that would have happened, I would have promptly inspected the area, and stopped using the drive for access. However, that call was never made. Furthermore, if Mrs. [redacted] was aware at the time the job was being performed that damage was being done. Why did it take her until November 3 to investigate as to it's severity? I will remind you again, that it was approximately 10 and 1/2 months later that I was notified, for the first time, by certified letter. Surely had the damage been that extensive Mrs. [redacted] would have notified me sooner. I understand that she encountered health problems, and for that I am truly sorry, but the fact remains that she obviously was not ill on November 3 when she claims to have photographed the alleged damage. Why did she wait? To add, I do not own a skidder. I own a Bobcat S300 skidsteer loader. From the research I have done, a skidsteer of this size has between 3.5 and 5.0 lbs per square inch ground pressure. Even loaded, it should not increase more than 30 percent of that. However, this being said, this is only the best information I can find with google, and should not be considered concrete fact, but I will get the exact number for you.  I would also like permission to inspect this alleged damage myself with a witness of the Revdex.com's choosing. I will not inspect it without someone with me who is a neutral party, but would be happy to provide a list of local people who would escort me. To be completely fair, Mrs. [redacted] is also welcome to make suggestions for a neutral party to escort me to investigate the alleged damage also. Again, I have no problem solving this civily if I indeed damaged her drive, but before I fix anything, I will be sure that our company is at fault.

As per phone communication with Revdex.com 12/10/15, Mr. [redacted] will contact consumer, [redacted] to arrange a time convenient for both of them for him to come by her home.
