44115-2408 RE: ID [redacted]
Dear Ms. [redacted]:
Inasmuch as this is the first complaint I have received in almost thirty (30) years of practicing law I am addressing this matter very seriously.
I was hired to represent this individual on or about December 1, 2014. The representation included three (3) criminal/traffic matters pending in the Garfield Heights Municipal Court. My representation came forth after this individual discharged his prior "hired counsel" due to an "irreconcilable difference of opinion in the way business in general, especially this case should be handled". (See attached Defendants Motion)
I appeared in the Garfield Heights Court on the defendant's behalf on December 30, 2014 wherein preliminary evidentiary and plea discussions were had with [redacted], the prosecutor. Also, because I was made aware that. the defendant had failed to appear for a scheduled appearance on a fourth case and a warrant was pending, I successfully petitioned the Court to remove the warrant on December 30, 2014. (See attached Journal Entry). All four (4) cases were reset for pretrial on January 20, 2015.
On January 20, 2015 I again appeared with the defendant. Further plea discussions were had with Prosecutor [redacted]. The cases were set for change of plea on February 10, 2015. The defendant made me aware a few days prior to February 10, 2015 that he was unavailable on that date. A motion was filed and the matters were continued until March 3, 2015 at 9:00 a.m. (See attached-one of the pretrial notices). Between February 10, 2015 and March 3, 2015 the defendant demanded his entire file from my office. I complied. The defendant "was having the plea offer evaluated by another attorney". I entertained a meeting with the defendant wherein I was shown briefly what appeared to be a signed "Attorney's Agreement" with another firm. Therefore, I was under the impression that I was being relieved of my representation and on February 26, 2015 I filed a "Motion to Withdraw as Defendant's Counsel". The court overruled my Motion in that no other counsel had filed an appearance notice on defendant's behalf. In that uncertain period of time I scheduled a matter in a municipal jurisdiction within close proximity to Garfield for 8:30 a.m. on March 3, 2015. Unfortunately the magistrate in that jurisdiction was late and the exchange in the attached document took place with the defendant. I have also included other relevant facts.
As you can see from the Court's entry dated March 3, 2015, the defendant had no authority to leave the Courthouse.
Sincerely ours,
Anthony J. Bondra AJB/sv
