Hello [redacted] ***,I am in receipt of your letter dated 7/10/in regards to [redacted] *** I was not familiar with this client so I had to do a little investigating and now I am prepared to respond.As you are aware this loan originated back in February and the loan agent was [redacted] [redacted] quickly determined that this was a loan to refer to Murphy Bank in Fresno, CA [redacted] advised the client that he would continue to work with her but that the loan was being referred to Murphy Bank Murphy Bank had approved the loan file based on the credit file of [redacted] *** The next step would be the appraisal which was ordered by Murphy Bank and the client paid Murphy Bank for the appraisal Once they appraiser started to work on the order it was determined that the mobile homes on the property were not in [redacted] Name but rather a prior owner of the property The appraiser then completed the report and delivered it to Murphy Bank noting the mobile homes on the property were not a fixture to the land Murphy Bank researched title and determined that the property had just transferred into [redacted] name in December and the mobile homes on the property were not in [redacted] name and not permanently affixed to the land Murphy Bank said if you can provide proper documentation to get these units transferred into your name they would still make a loan on the property [redacted] was not able to provide the documentation needed and Murphy Bank canceled the loan.Even after Murphy Bank canceled the loan, [redacted] continued to worth with [redacted] trying to come up with a way to help her get a loan [redacted] contacted the title company and the realtor that were involved in the sale but they provided no information that would help this situation [redacted] tried to get Murphy Bank to make a loan solely on the land with no value to the mobiles but Murphy Bank couldn't proceed in that manor with the unresolved issue of the mobile titles Based on the emails I have attached you will see that [redacted] was communicating well with Murphy Bank and [redacted] was communicating and getting answers directly from [redacted] *** Once the loan was canceled by Murphy Bank and not other options were materializing the client wanted a refund of the appraisal I believe that had [redacted] or Murphy Bank had know of the issue with the mobile homes prior to ordering the appraisal, the appraisal would have never been ordered and since it was known and wasn't discovered until after the report was done I see no fault of [redacted] or Murphy Bank in this situation.I do feel bad for [redacted] in her situation but I also understand why Murphy Bank could not proceed When [redacted] acquired the property there should have been more careful regard to the property transfer of the property and everything that was included My understanding is that when the title issue can be resolved that Murphy Bank would re-consider making this loan I don't believe that [redacted] is entitled to a refund of her appraisal as that was the final piece of the loan process to determine if she could get a loan on the property and it was that piece of information that ultimately haulted the process In my conversations with [redacted] he stands by the fact that he never avoided [redacted] and always returned her calls even if the news from Murphy Bank was not good The only time he wasn't able to be available for her was when he was on Vacation in June from the 18th till the 26th I would be happy to meet with [redacted] and discuss this further.Sincerely, [redacted] ***Vice PresidentMid Valley Financial [redacted] Fresno, CA 93711Direct ###-###-####email [redacted] @mvloans.com
