Miner Realty is the property manager of the home we are currently renting. Since we have been in the house [redacted] who handles the rental for the company has belittled my husband and myself. We have asked for repairs to be made that to this day have not been made. When we moved in back at the end of May we let [redacted] know there was an issue with the hot water heater pilot light. It would not light she immediately insulted my husband by implying he was incompetent and said that we would be charged if it was something we could handle. It turned out the lighter wasn't close enough to the gas to light it. We also let them know that 2 burners on the gas stove would not light on their own, it is now almost November and they haven't been fixed. My husband and I decided to buy a house and I called to ask about getting out of our lease [redacted] promised to talk to the owners. nit even 2 minutes later [redacted] called back and said that if we used her as our realtor she could get us out of our lease. Implying that she would not look at letting us out of our lease unless we used her. I followed up to see if she had spoken with the owners a little over a week later and was told she had sent the information to an email I had asked her not to use. Once she forwarded the information to me I wrote her an email explaining why the owners demands were unreasonable. I then called and asked her to try and work something out she told me we had to accept or be sued for the remaining balance of the lease, the whole time insulting me and telling me to act like an adult and accept the consequences of my actions. We had told her we would prefer to do a month to month lease and were told that wasn't an option, then when I asked for an early termination clause in our lease I was told no. She knew we might leave early for family reasons and made it impossible for us to work with her. We had to stay in our area and this was the only house available.Product_Or_Service: Rental houseAccount_Number: LeaseDesired SettlementI want to be let out of our lease with out penalty. I called on September 18 2015 asking for a reasonable way out, with the expectation that we would be out by November 15th. that is almost 60 days notice. She did everything possible to stall the advertising by not telling us she didn't have pictures until last minute causing us to have to scramble and do her job for her to get the property listed. It wasn't listed until October 13th when we had agreed that it would be listed on the 1st. She said she needed to stay in the area due to schools. After discussing this with the owner, we were sympathetic and agreed to let her lease with her pet. The owner's required a minimum one year lease which they signed on 5/22/2015. Four months later tenants informed me they had purchased a home across the street and wanted to get out of their lease. I contacted the owner who agreed to let them out of their lease with standard conditions including tenant would have to pay rent until it was re-rented. In summation, the terms were that the Owner would not incur any costs as a result of them moving which is not unreasonable. Note: I did call her back and asked if she had a realtor, telling her if she did not, I would be happy to help her with her purchase if the owner's would let her out of the lease. I would not have told her I would get her out of her lease, as it is not up to me. There was no implication that I would not contact the Owner about getting them out of their Lease. I represent the Owner and all decisions are theirs. When she objected to some of the terms, I contacted the owner who instructed me that those were their terms and if the tenants did not accept them they would not let them out of their lease. I explained this to tenant. She asked what would happen if they did not comply, and I explained to her the owners rights under the Contract, which would be a lawsuit for the balance of the Contract. These tenants went into contract for buying a home without checking with their landlord about the repercussions of defaulting on the Lease Contract, then were argumentative about the terms.As to the repairs, I have two maintenance people who have informed me the stove has been repaired except one burner has to be lit manually as the igniter does not work. They have 3 burners that ignite and one that has to be lit. The oven was also inoperative and that has been repaired. When they called about the water heater, I merely asked if her husband knew how to light a pilot light. She said he did but couldn't get it to light, so our maintenance guys went right out and lit it for them. They were not charged. At this time there are no outstanding work orders on the home, all their demands have been met and my maintenance people will give a statement to that effect if need be. The owner paid $728.98 in repairs as follows: Computer board on range Sprinkler valve and repair New workings in hall toilet Changed 3 entry locks Lit pilots on water heater and fireplace New fuse link for A/C condenser Re-stretched carpet in several areas Gave tenant $50 cleaning credit We have diligently addressed all property repair issues.I think this is merely a tenant trying to get out of an obligation. I have been cooperative and supportive of all their requests and have gone to bat on their behalf with the Owners from the beginning. I am still trying to help her in getting the property rented again as soon as possible and will continue to do so.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I'm not trying to shirk my responsibilities, we told her from the start that if we had the opportunity to buy the size of house we needed we would need to break the lease. At this point not only is it because we found what we need for our family, it is because we feel belittled and harrased by this property management company. Example this month we sent our rent through the bank like we always do, we have no way of knowing they recieved it until they cash it which is usually a week to ten days later. Instead of calling to say your check never showed we get an email from the system saying we are being charged a late fee because no cheek was recieved. When I called to ask why we weren't told our check check never showed up I get this song and dance about how she had trusted me since she was helping me get out of my lease, like we were trying to screw her over because we didn't get the answer we wanted. I had to prove I sent the check through my bank then drive completely out of my way to turn in a check the next day. When ever I try to talk to her she says things like we had several other offers to tent the house we didn't have to go with you. I find that hard to believe since we spoke with the owners before they even listed the house to rent and she hadn't even taken pictures of the house to advertise it. We had sold our house and every house we tried to rent was being rented out from under us so we agreed to pay the outrageously over market price they asked. Based on the market the rent on this house should be around $1300 a month we are paying $1500 for a 1700 sq foot house and have no landscaping in the backyard so our kids can play outside when ever they want. The houses out here that are renting for $1500 a month are about 2000 sq feet and most are landscaped front and back. We offered to landscape the backyard as long as we were reimbursed and were told we could but we would not be reimbursed. If we had known we would be treated the way we have been we never would have rented this house. Would I love to be out of my lease yes, but no body should ever be treated like the sm on the bottom of someones shoe by a professional. That is the main reason I filed the complaint. Today I was told it is my sole responsibility to get this house rented not theirs even though I was required to pay for them to advertise it. Why are we paying to advertise the house if we are the ones that have to find new renter? Why weren't we told it was all on us to find a new renter? Why weren't we told that they didn't have the pictures to list the house for rent until after the agreed upon advertising date and only after I called to find out why it wasn't listed? Her response shows how little she thinks of us. The owners said we could have our dogs and to talk to [redacted] about having our cats we agreed to extra inspections to show that our cats weren't damaging the property. All we asked was that if we were able to get the house we needed we could terminate the lease, which [redacted] assured us it would all be fine. The misleading way we were handled what I'm upset about. Final Business Response In speaking with the complainant a few minutes ago, she told me she was going to dismiss the claim as soon as she got time to figure out how to do it.
