The customer ordered 4.0 yards of concrete to be delivered on /23/15. When the Mini Mix driver arrived, he explained to the customer that he was pretty certain there was a septic tank on the property. sewers. The driver pointed out that he had...

previously worked for a septic company installed in this neighborhood. The customer said the septic tank was under the patio concrete in.
The driver explained the release that is clearly stated on the delivery ticket, regarding damages past the curb, circled it and had the customer sign it.
After the 4.0 yards were poured into the area, the job was short on concrete. The driver contacted the Mini Mix dispatcher at the plant and the dispatcher thought the job was close enough that a makeup run could be delivered. Mini Mix is not required to do makeup runs, if the customer has calculated their own concrete shortage and they come up short.  However, we try to accommodate the customer if the schedule allows.
An additional 1.5 yards of concrete was sent back to the jobsite. The customer was standing in the side yard when the driver arrived. The customer walked towards the pour site and the driver pulled into the area again. There was no attempt made by the customer to notify the driver not to pull in to the same area.
At that point, the drivers left rear side of the truck broke through the top of the septic tank and fell in.
Anytime we have multiple deliveries to the same location, only one ticket is signed with the total amount of yardage and price. Since the customer came up short on concrete, a new ticket had to be written with the total amount of concrete delivered, however, another signature for the disclaimer was not necessary, because we had it on the original ticket.
When the customer indicated that he did not want to pay for the second delivery of concrete, the driver informed the customer that he would contact the police (which is standard company policy), since the makeup concrete had been delivered in good faith.
The police will not make the customer pay, however, they will obtain the vital information in order for Mini Mix to prosecute the customer for payment in court.
The owner of Mini Mix was not available to contact the customer. The driver and customer were in contact with the  Mini Mix dispatcher (who has full authority to make decisions on behalf of the company), via radio and telephone. The dispatcher explained the company policy to the customer, several times.
This was an unfortunate accident for both parties involved. The pour was started at 8:00 am and the truck was not lifted out of the septic tank until 1:00 pm. The dispatcher waived the $60/hour truck time fee while the truck was stuck, and also waived damages caused to the truck.
Due to the fact that the truck was out of service until it was repaired, all scheduled deliveries for that truck had to be canceled.
We feel the damages to the truck and loss of service, far outweigh the damages incurred by the customer.
Attached are copies of the delivery tickets.
