I am the SVP-Legal for Monster WordlwideThe client, to be blunt, is wrong about the facts and the law. The client contracted for job postings with a price of $Apparently, she thereafter changed her mind, not because of any concerns about our services, but because she filled the role
internallyWe have a voicemail where she told a Monster manager she wanted her money back because she had an internal candidateThe attached email also reflects her same reasoningMoreover, the contract does not allow someone to simply change his or her mind because they no longer want the serviceIn the attached email, the client points to a day cancellation clause but that is only the case of a material breach by either partyWe can give the customer a credit for future services but not a refundthank you for your cooperation

This individual signed a valid and fully enforceable contract for a stated period of time and priceHe cannot simply decide one day that he does not want the service any longer or cannot afford it and expect Monster to simply cancel the contractThe customer is turning years of contract law on
its head. He is arguing that the contract should have specified that he cannot cancelAs a contract law attorney for years, I can state with great confidence that it is the opposite--the customer must rely on specific out clauses in a contract to cancel a contractOtherwise, anyone could just wake up and decide he or she wants to cancel a car lease, cable service or a thousand other types of contracts that provide a service over timeIf a client files for bankruptcy protection, then contracts may be nullified under the bankruptcy codeBut saying I am short on cash so just tear up my contract does not work under the law.*** ***

Once again, the customer cannot simply say his business has folded without proof of dissolution or bankruptcyStrictly as a courtesy to the Revdex.com, we would be willing to accept $to resolve the matter--a discount of over percentthank you*** *** ***

I have reviewed the response made by the business in reference to complaint ID ***, and and I still think that Monster is wrong, and that we were indeed entitled to the months free BEFORE the months of our contract were up, and not after as expressed by *** *** *** in the previousmessage. I base myself on the email (see attached) where the sales rep *** *** clearly wrote:" Should you stay with Monster I will give you, at no cost an additional months of resume access and Premium Job postings (which could be used at any time before 12months).” This promise was the only reason we decided to stay with Monster because we were actually going to cancel the very next day after signing on and finding that we could not access the site, nor get anyone on the phone that could at the very least tell us what was going on, nor find *** *** the person who signed us on in the first place. The ***,*** ***, was even going to assist us in the cancellationHowever, we were persuaded not to cancel that day with the promise that *** would give us months free (which could be used at any time before months), and redeem himself bygiving us great customer care The problem we have with Monster is a lot more complex, than *** *** understands it to be, and for this reason I feel it will be difficult for both parties to come to an ideal agreement. Therefore, despite the evidence that I have presented, we are willing to meet Monster half-way, and agree to this proposed resolution of paying only one month worth of service, regardless of time left in thecontract between *** & Monster and we wish to be discontinue from Monster services, and to be released from their collections, and resolve the matter once and for all.Sincerely,

We did have a settlement for the value of one-half of the contractThat obligation became satisfied with the payment on Oct**, Additionally, our sales deptactually credited $more than what was agreed upon so we refunded $from the Oct**, final paymentThere are no further payments scheduled to process on the accountThe customer received several emails from the finance group including one on Oct**, and again today explaining the situationIf the customer has further questions, he can contact Adam G*** at ###-###-#### or ***

This complaint was not address, the company went out of business and is still being required to pay for a service it doesn't useWhen the monster account was created a name was picked which was not the correct name of the company so no supporting documents of dissolution can be providedI am not looking to deal with robots or isI am willing to come to a resolution, but not pay for a year of service when the company folded.PHOENIX RECRUITMENT NEVER EXISTED!

I am the SVP-Lega;l for Monster Worldwide. While we believe our sales person acted properly, as an accomodation to the customer and the Revdex.com, we will issue a full refund of the $425. Thank you for your cooperation.

We are sorry the customer was not satisfied with our services. However, Monster fulfilled its contractual requirements to the customer. The 5 job postings were placed on our website and 154 job seekers responded to those job postings. The customer received the resume license and accessed 277 of 1500...

resume searches. We of course do not guarantee that the customer will ultimately hire a candidate through Monster to fill the role. Now the customer simply doesn't want to pay anything for the services they fully used. We believe the $995.22 is due in full and will proceed to collections. However, strictly out of respect for the Revdex.com, we will offer the customer a 50% discount to settle the account but nothing less.

 They have said they are going to refund us a little of the money and stop charging our account. We have...

canceled the credit card they were charging and hopefully we will not be charged any more but there has not been enough time to verify that. We have not seen the refund yet or I have not been informed of it unless we received it in the past few days. Hopefully it will be resolved soon.
