Potential homebuyer for my home used a Home Inspector from Smart Home Inspects on the 16th of September 2018 and they were scheduled to do the home inspection at 4:00pm. I left the home before 4 pm and returned back at 8:30pm that very same evening. Once I entered the home I felt the home quite hot and humid. Went to my home thermostat and found it up to 85 degrees and on HEAT. I turned off the HEAT and turned it back onto COOLING and set my thermostat back air conditioning to 73 degrees which is where I had it on when I left my home in the afternoon. I went upstairs and checked the thermostat there and found it on OFF completely. The heat upstairs was unbearable and once again I had to turn on the air conditioner on upstairs to start cooling my upper level. I go downstairs already hot and frustrated and I am always drinking ice water so I go and get a cup to get some ice from my ice maker as always and find that it is not working. All I can hear and see is a loud sound of grinding and no ice coming out. I try it again and nothing comes out from the front door ice dispenser. I tell my husband something is wrong since he was with me in the kitchen and I go ahead and open the freezer of my refrigerator and all I can first see is my freezer is full of ice cubes all over my frozen food thrown all over in inside of my freezer. I tried to take out the ice maker along with the ice bucket and it was all crooked to once side and it was stuck and it would not come out. I tried to lift it somewhat and nothing. It was stuck and could would tell it was not placed back in correctly. I tied over and over and finally I had to ask my husband to try to pull it out and he was finally was able to lift and pull it out. There was ice everywhere along the area it usually sits. I found ice in the hole where the ice dispenses and pushed it out of the dispensing unit. By now I was extremely upset and sent an e-mail to my real estate agent asking who were the inspectors because I feel that they ruined.

Dear ***,
Our company is in receipt of your letter dated September 24th ,2018 concerning a complaint by the homeowner of a residence that was recently inspected by us. Below it is our statement and response to such complaint.
BACKGROUND:
On the 16th of September I, inspector and owner of the Company Smart Home Inspects, performed a home inspection at the complainant’s residence. This is requested and paid by the prospective buyer, who was also present with his agent. The inspection was uneventful and was performed according to national industry standards and a report was submitted to the buyer who may have shared it with the seller (complainant).
On September 18th at about 10 am, my company received a call of a person who wanted to know the name of the owner of the company, our email address, and other identifying information. The person who answer the call at my company, provided her own name, her email address and repeatedly asked the caller for the purpose of the call and what her interest was in our business, after my partner’s insistence on learning more about the nature of the call, the person hung up the phone abruptly without every providing this information.
About 30 minutes later, the complainant (identified on your letter) called, and we learned about the complaint concerning the ice-maker and internet cables that were cut and that internet was not functioning properly. My partner Daisy stated that I, the inspector would call back and discuss the matter with her. Which I did twice at 10:55am and then again at 11:56am and left a message and provided my direct number so she could reach me. I never received a call. My partner Daisy sent her an email to both email addresses she provided advising her I, the home inspector, would give her a call. My partner called hear again at 1:51pm informing that I, the inspector had called and was expecting her call back when convenient for her. She said she would call back. She never called us again.
At 12: 07 we received an email from a person simply identified as *** (Not the complainant for what we understood from the email herein included) see attachment 1. This person was not a known person to us or related to this transaction. She was not the agent of either party. We were baffled by the questions and comments on the letter and since we could not share much information with an unknown party, we replied (see attachment 2 email sent to this person). Stating our reasons not to share certain information with her and that we would gladly do so, if she qualified herself to be a representative agent for the complainants. (she responded with another puzzling email attachment 3).

We did call and attempt to speak with the complainant directly again and try and resolve this matter, but she never responded and communication ceased.
The complaint stated on your letter:
While we strive and try our best to return a home to its original condition at the end of the inspection, I understand we do not always succeed at leaving things completely undisturbed. The complainant referred to the A/C and heating of her home. The last act before leaving her residence at about 8pm was to reset her lower thermostat (main level to 73F), which I state to the agent just before I left. Indeed the upper level thermostat was left off (because it was a heat pump which had just been briefly tested in heating cycle and if turned back on cooling, it could damage a compressor, especially since the unit was very old. I assumed it was best to leave it off, the homeowner would turn it back on at the desired temperature later on when already safe to do so); As stated by the homeowner, she came back immediately after the inspection was done and it is understandable that the home was warmer than when she had left, we had just concluded testing the heating system.
The ice maker was not functional from the very first moment I touched the control buttons. As a home inspector, we do not dismantle, open, remove parts of an appliance. All that is done is turn the controls on. I picked up my own rubber cup placed it under the ice maker and water dispenser and tried the controls. The agent and buyer were both present and looking at me during this testing. I was able to get water but ice was not dispensed. As the next step in the inspection and after washing my hands I opened the freezer to see if Ice was present in the ice box, I touched the ice to see it was loose or solid, it was mostly solid. At this point, I turned to the agent and buyer and state that the ice maker appeared to be working but the dispenser was not. I told them that this could possibly be ice that froze together and would not dislodge preventing the ice maker from working. I stated I would note this on the report as a defect.
The report listed the issue as follows:
MAINTENANCE ITEM: There is a water valve noted in the area of the refrigerator. Water dispenser is functioning, however, the ice maker did not dispense ice as expected, repair/clear ice as needed.
It is unfortunate that the ice maker may have been functional before and not later, but it is not possible that my action of activating the control could have caused it to stop working. As stated, a home inspector simply turns the control on or off. While I am sympathetic to the complainant’s need of an ice maker I cannot take responsibility for defects in a home when there is no negligence of my part. As other things in the complainant’s home (home is from 2004), equipment and appliances are aging and nearing the end of their useful life. Past performance is not a guarantee for future performance. It is regrettable that the complainant’s speculation has pushed her to make a judgment of my character and to defame me without even know what transpired in the home while we were there. She fails to point to any indication of failure or negligence on my part, and her only argument is the timing of the event.

The buyer’s agent and buyer can be reached to provide their own account on how I performed the inspection. Their contact information can be obtained from the complainant or myself, simply call, email or send a written letter to my office.

Proposed settlement:
While we are sympathetic to the complainant’s issue. I am certain my action was not a contributor to the issue experienced by the complainants. Therefore, we reject the request for repairs. We understand the process of selling a home can be stressful and some small things can trigger a reaction on sellers. We wish the complainant luck.

Complaint: ***

I am rejecting this response because: My ice maker has never had any issues and I have used it daily since I bought it new from ***. I, once again, have health issues and I use the ice maker and the filtered water from my refrigerator constantly along with my husband. One the day of the inspection it was not working and found the actually ice maker had been moved inside the refrigerator and it was not properly installed back into its location correctly only after we could not obtain from the front dispenser ice cubes, but only crushed ice. We tried to determine what was the problem, but after take out the ice compartment and still could not get the ice to come out as cubes, but as crushed only. The water dispenses correctly and crushed ice, but no ice cubes. This is the problem. We do drink water from the water dispenser and ice cubes daily so there is no reason for this not to work right after the inspection. Furthermore, as I stated on my original complaint, the reason why I went to get water and ice immediately was because the heat had been left on during a hot day on the 1st floor and the air conditioning was turned off at the second floor completely. I had to get some ice water because it was hot in my home. I do not recall mentioning anything about any cables on my complaint that I submitted, but I did mention about the heat being left on and about the ice maker for my refrigerator.

When I initially called I was greeted by a woman with a very upset voice. I asked if she could allow me to speak to the owner of the company and she insisted that she was the owner and asked me what was my call about and I explained to her what the problem. She stated to me the inspector would call me directly in reference to the matter. I did not receive a call nor any e-mail from anyone from the company. The person I spoke to was a "Daisey", I am not sure of the correct spelling of her name. She would not give me her last name unfortunately. I am the owner of the home at this present time and I have never had any issues with any contractor ever, and so the treatment surprised me from supposedly an reputable company.
