Hi, Here is the contract. The clause is hidden on page #8. It was neither mentioned nor brought to our attention that there is a STATE SPECIFIC clause for the purchase of the Maintenance contract. We were simply told " [redacted] ... [redacted] " We were misinformed and mislead about the nature of the contract that we were given so little time to sign.Thank you [redacted]

At this time, I have been contacted directly by Pace BMW regarding complaint ID [redacted], however my complaint has NOT been resolved because:
They posted a response to a negative post I made on their [redacted].  We bought a second BMW from them in August 2015, they have all my contact information including email and phone number but they posted on [redacted] asking me to get in touch with them.  I have had allergy flare [redacted] and haven't had a chance to talk with them, will communicate to see if this can be resolved.

[redacted] purchase a warranty which provide coverage on tires and wheels coverage.
He brought his car in for repair of a flat tire which the warranty did cover the cost. Our service department ask if [redacted] would like to have his rim cosmetic's scratchs repaired which the Tire and Wheel warranty only cover when it's crack or bent. We didn't not misrepresent the coverage and he paid $1359 not the $3200 stated on his complaint.
We can cancel the coverage, however the cancellation only will be prorated to around $800. Also, any cancellation will only be refunded to the company which the vehicle is being finance/lease (to stop further interest accrued). These are the standard banking/insurance cancellation protocol.
We've given [redacted] the explanation of coverage, cancellation process and awaiting for him to let us know what he intend to do.

This is in regard to [redacted], ID# [redacted] - and BMW of Mamaroneck  (Pace BMW)  [redacted]; We are pleased to report this issue has been resolved to the satisfaction of both parties.   Mr. Joe C[redacted], General Manager of BMW of Mamaroneck, came to the resolution that was acceptable to [redacted].

Response:

[redacted] has had numerous concerns with regard to his tire light on his BMW X5. We have attempted to identify his concern on multiple visits to our service center. While [redacted] has had difficulty with the tire light illuminating , we have not been able to duplicate it on many occasions. We did replace a component on the visit when we could identify a problem.

[redacted] has most recently brought the vehicle in stating the engine was running rough and he was having a loss of power. At the time he brought it to us, his concern was not occurring. He also told us on this visit that he was going to keep our loaner car until BMW gave him a new one. This prompted us to retract our offer of a loaner car and we told him he need to utilize a rental company who would come to our service center to take care of the necessary paperwork.

[redacted] would very often bring his vehicle to us on a Thursday and not return, even though his vehicle was completed the same day, until after the weekend where our vehicle was used to take trips to his home in New England. he has also had many conversations with BMWNA regarding his X5 and they have advised him that he must bring the vehicle to a BMW dealer, utilize a rental car if he needs alternate transportation and must have his concerns diagnosed before any other discussion or decisions can be made.

[redacted] did have an appointment set up with us approx 30-45 days ago but did not show up.

Lastly, we will continue to do our best and provide [redacted] with the kind of service a BMW owner has become accustomed to. It makes it more difficult to do this however when [redacted], in his frustration, becomes antagonistic, cursing, yelling and frankly threatening my staff while in the service area. I would simply ask that we move beyond that and try to rectify and concerns he may have.

We would still be happy to make an appointment to look at [redacted] vehicle and make a rental vehicle available to him for the time it takes us to diagnose any issues.

Review: Hi, I purchased a new 335I convertible last year and was consequently sold a car paint and interior insurance for $500, which was supposed to cover bird droppings, tree saps and acid rain damages. I had a goose dropping on top of the roof, which caused some minor scratches, been contacting the dealer for more than a year now, they refused to repair the damages, even though goose is a type of bird and the insurance is specifically designed to protect against bird droppings. As ridiculous as this sounds now, the dealer is now claiming that the service sold is not their service, though as time of sale, the bird dropping insurance was sold as a [redacted] service. In the first 4 months (3,000 miles), the car engine had multiple issues and had to be repaired more than 7 times! Keep in mind I paid almost $66,000 (including taxes and fees) for the car new! Service had kept customers waiting hours on end, with no answers in sight as to whether they actually knew who is responsible for repairing what parts! To make matters worse, when I was volunteering at [redacted] (where I been tutoring 3 years for free) and the car was hit by one of my student's mother, these people refused to allow a loaner! For $66,000, I thought maybe you get a loaner, especially if you are doing charitable work when the non-at-fault accident happened! Wow, talk about cheap! Then, just to slap you on the face further, folk here turned the enterprise rent a car around, so as to make me spend 6 hours in the shop, while they try to contact [redacted] and repair shops, simply because everyone was not communicating with each other! All this after their repair service representative told me, "Yes sir, just come in, we will take care of it"! Overall, new car under 3,000 miles should not need over 10 trips to the dealer in the first 6 months for engine repairs. Treating someone who paid you over 60 grand like a prisoner and completely not respecting the customer's time, bad dealer!!!!!Desired Settlement: Return $500 or repair the scratches left by the goose droppings.

Thank you for the opportunity to address our client's concerns.

While, we acknowledge that the insurance comapny for the goose dropping repair denied coverage - we do not know why they denied it. Be that as it may, I will be having the [redacted] Service Advisor contact them to make arrangements to have the vehicle brought back to us. We will wet sand the roof stains in an attempt to remove the staining at no charge to the client.

With regard to the other items the client mentioned, while we apologize for any delays in servicing or repairs they may have encountered, we always attempt to provide prompt , courteous service to all of our clients. We unfortunately are not able to provide a loaner vehicle for any Body shop repairs as they are often difficult repairs to gauge the timing of. We do however work closely with [redacted] and offer a discounted rate for rentals to our clients.

While we understand the clients concern about the repair history to hs vehicle, (6 visits including 2 maintenence visits) the vehicle is fully warranted for the first 4 yrs or 50000 miles against defects in workmanship or materials and we will always be here to accomodate our clients when they need assistance.

Review: I purchased a car in [redacted] 2012 from Pace BMW. At the time, I offered to bring in my own financing/check for the vehicle from Bank of America, since I was preapproved for a low rate already . I was told to forgo the check because they would run my credit with Bank of America specifically. I re-iterated that I only wanted to work with Bank of America and did not want any additional credit inquiries on my report, since it wasn't needed because I had stellar credit. After agreeing my credit would only be run for BOA and not sent to multiple lenders since I didn't want additional inquiries or new relationships with other banks, I signed a credit application. I was approved for the BOA loan at the same rate, and took my new car home. Nothing else was said about any other banks or inquiries. Two weeks later, I start receiving credit alerts about my credit being pulled on the same day as the car loan - and even a few days after it was still being pulled. Pace had inquiried me NINE times across all three credit bureaus, reaching out to four additional creditors that I did not authorize. I immediately contacted the finance manager who explained to me that it's process - even though it's not what we agreed upon. I also sent another note as recent as */*/13 to the new finance manager showing him the inquiries and explaining to him the situation. He denies it was fraudulent, even though I signed the application under the pretense only one creditor would be inquiried. I've also left multiple messages for the general sales manager in charge of the dealership, and he will not return my calls. Ultimately, I believe that because Pace was greedy and feared I would not purchase the car if I left the dealership to come back with a bank check, they would lose the sale. So they misled, lied and deceived me into thinking our agreement was valid. Then, only to throw a legal document in my face and say that I signed it, regardless of what the finance and car dealer told me and what we agreed on. I feel taken advantage of.Desired Settlement: I would like for Pace BMW to alert the three credit bureaus and each of the lenders they reached out to (not Bank of America of course) that they used a deceptive/fraudulent practice to inquiry me with the other banks, in order to have the inquiry removed. Since the creditors are saying it was done 'with cause' Pace must explain that I signed the credit application under the pretense that it would only be sent to one institution, not multiple. And that it was an error done on their part. They deceived me and my credit has dropped because of it. Thus far, they've made multiple excuses to not notify the credit bureaus, when a simple letter on their letterhead (as well as a copy sent to me for my records) will solve the issue.
