As the balance of the materials had not been paid for they were not an issue".           Response:  Please explain what agreement with all parties? This must be in your mind because we have not signed any agreement and do not want to sign any agreement with Pacific Steel Building               and/or Pacific Outback Steel Buildings or [redacted] Inc to settle this or any part of the complaint.  We have an agreement with [redacted], [redacted] of Sandy, Oregon to pay an         additional $14,463.75 on June 23, 2016  for the steel and fasteners. We told Mr. [redacted] of [redacted] that we did not want to ever have any dealings with you again. The complaint filed             stated that as of June 1, 2016. The grand total of $54,495.68 and with the additional payment of 14,463.75 for a total $68,959.43 minus the cost of the slab cost of $25,000 (that we can not use) this               29,936.64 complete building cost has now increased to $44,400.39 without the doors, rolls-up door and insulation. Just steel and fasteners. The steel and fasteners have been delivered to Weaverville             ($14,463.75) and now we find out that the construction package layout and assembly instructions furnished dated 6/25/2016 is not for the same steel  delivered on 7/17/2016 by [redacted].  So another       unsolved problem.  A very costly problem.You stated in your response that Revdex.com cannot be involved in this and it isn't really a matter for the Revdex.com to be involved.  Your response to our complaint with         the Office of the District Attorney General on July 14, 2016 you furnished to them an unsigned sales agreement dated 8/8/2014 and copies of the 2 page terms and conditions states #8 breach "both               parties agree to arbitration by the Revdex.com" and #11 General "disputes will be resolved by submitting them to the Revdex.com".  We filed with the Revdex.com to confirm with the terms and conditions and you are trying       to circumvent our rights to the  Revdex.com both for arbitration and disputes". The unsigned sales agreement dated 8/8/2014 title [redacted], [redacted] and states in the first sentence "Pacific Steel               Buildings, Inc as (hereafter known as the seller).  So you do not own and have no ownership in Pacific Steel Buildings.  You own Pacific Outback Steel Buildings, Inc and no      signed contract with  ,         myself ([redacted]).      5)  You stated "a note has been signed by Pacific Steel Buildings and Mr. [redacted] to pay the cost of the      steel payment to [redacted]".       Response:  I did not sign or agree to any note with any company and if I did agree to any signed note it would not be with you or Pacific Steel Buildings and a company you do not own and have no             ownership of. Why would you state this? If not wanting to show involvement in the effort. Since 8/8/2014 we had been trying to purchase an Outback Building and had the help from your Master                 Distributor Outback [redacted] of Sandy, Oregon. You were fired and terminated on June 1, 2016 and your  Master Distributor was informed in an E-mail on June 21, 2016 with the same of no       contact. So how does Pacific Steel Buildings, [redacted] and [redacted] have and relationship without my written or verbal permission? Mr. [redacted] would like to add that his question is, how do           you extort monies by using force or threats from Pacific Steel Buildings ? When they do not exist as a business in the State of California and why would you (personally) even include this in this                   complaint which is against Pacific Outback  Steel Buildings, Inc? 6)  We would like to know where the $22,077.48 paid to Pacific Outback Steel Building went, [redacted]? It went missing, spent or disappeared   We have been asking this question and still                  asking the same question since 8/14/2015.

The customer already negotiated a settlement with the President of Outback Steel Buildings.  There is nothing further to settle.We did not deal directly with the customer.  It was negotiated between Mr. [redacted] and the President of Outback Buildings in Australia, [redacted].  The agreement was that by Mr. [redacted] paying Metal Sales $14,463.75 as per the attached invoice that he was making that arrangement for the steel right then.  He was unwilling to wait for us to pay this portion as we could not pay it right then.  We then agreed to repay the $14,463.75 to him as soon as we were able to do so.  The agreement was put into place with the purchase of the steel.   We also extended out discounts with various vendors for him to directly purchase the balance of his options that he had not already paid for.  As they had never been paid for we didn’t owe them any additional funds. That was the agreement which we still intend to honor.  It now appears that the [redacted] and his brother-in-law think they can extort all kinds of charges that they have dreamed up.  No we will not agree to that nor negotiate any further.  We as distributors of Outback Buildings made the agreement in good faith according to our distributor agreement with the customer and OutbackBuildings.  There is no further need to agree to anything else.  Pacific Outback Steel Buildings

Yes, we have a customer named [redacted].  He has made 2 of the 3 payments on his contract.  He has not paid for his building.  At this time we are working out a timeline with the President of [redacted] to decide the best way for them to complete their portion of the...

contract and arrange delivery.  You cannot be involved in this as it is with our parent Master Distributor.  We are following whatever they set in place. As to Mr. [redacted] as he is not a customer if he has a financial interest in Mr. [redacted]’s building that is between the two of them. It really does not involve us.

Yes, we responded with voice mails and emails to the email address we had.  The wet stamped engineering blueprints & calcs were in fact created and we still have them.  We would be happy to send them to Mrs. [redacted] if she wans them. One of her messages said she would not be proceeding...

any further with the building so we didn't sent them to her because we thought that was what she wanted.Yes, a deposit was paid for the payment of the wet stamped engineering and calcs specific to the [redacted]s address.  I do understand Mr. [redacted] was an engineer but he was not the structural engineer that created the blueprints & calcs for this custom designed building.  He advised by phone and email what he would like us to create but he had no engineering input on the project.  I don't even know what kind of an engineer he was. but I don't think it was a structural engineer because if he was I'm sure he would have created his own building project and wouldn't have asked for our help.  We worked with him over several years on this project.  We understood perfectly what he wanted.  I'm not sure Mrs. [redacted] is aware of all that had gone on as we had never spoken to her or met her.  Only the message that he had died.Again, we would be happy to mail the engineering blueprints & calcs to her if that is what she wants.

We have been in communication with Mr. [redacted] on a daily basis regarding this issue.  When Mr. [redacted] went until contract over 2 years ago he was unable to give us the necessary required information from his county to be able to have the blueprints & calcs created for his building....

 He didn't have an APN # or an address for the property so we were basically put on hold until sometime this year.  And then, of course, he wanted his building immediately.  A lot had happened during this time frame for us and the business has been struggling.  We are in fact, recovering and are trying to catch up which we have communicated with Mr. [redacted].  While we cannot comply within the next couple of weeks we have a plan and timeline in place with Mr. [redacted] to get his building delivered to him.I believe the goal of the Revdex.com is for the company to communicate with the customer and find a solution for the problem.  We have done that.  We will continue to stay in regular communication with Mr. [redacted] until all materials are delivered to him.

There are several untrue statements in the response in regards to the [redacted] contract. The contract is with Outback Steel Buildings, inc. which was the Federal corporation name.  It also was the California name but as it was too similar to the Master Distributors name in Australia it was amended on and filed June 11, 2014 in accordance with the required procedures for the state of California. In regards to the allegation that there is or ever was a business office located in Stockton that is not a true statement.  There was a construction office that the contractor’s, tech support and all the sales people could schedule and use for training customers and meeting prospective customers who wished to see what the materials looked like on the displays.Mr. [redacted] did in fact show up after a previous scheduled appointment with another person and so found someone at the office for that period of time.  Again, no one sat in that office every day or conducted business there.  Each person who scheduled meeting there went back to their home offices after any appointments or anyone who happened to “drop by”.  There were no scheduled business hours.In regards to the contract a non-refundable deposit was made by Mr. [redacted] in the amount of $7,109.16 that pays for all engineering and distributor fees and payments to any sub-contractors involved in pre-engineering design.A second payment was made which is used to order the steel for the building.  In accordance with the contract this is to request a delivery date for steel only not the hardware or any other options ordered for the building and in order for any materials to be delivered the final payment would have to be received.Yes, Pacific Outback Steel Buildings has been struggling to recover from the recession and the drought and has suffered cash flow issues.  Never did they refuse to order the steel or get a delivery date as soon as they were able.  The steel was ordered was ordered and was only waiting for payment in order to schedule and ship.Mr. [redacted] decided he could not wait and that he wanted the steel delivered immediately.  So he contacted the master distributor Outback Steel Buildings in Australia who negotiated Mr. [redacted] paying for the steel with Metal Sales and the agreement that Pacific Outback Steel Buildings would sign a promissory note for that amount in an effort to expedite the order. The balance of the materials had not been paid for so were not an issue and Mr. [redacted] said he was going to take care of that himself. Mail has only been delivered to the post office box 30368, Stockton, CA 95213 for the business as that is the legal address for the business.  Until the property sold to a trucking company in 2015 there was no mail delivery to the site.  There wasn’t a mail receptacle as they had been vandalized so many times they were taken do

I am rejecting thSubject: Pacific [redacted] (Revdex.com) responseIn reviewing the Pacific [redacted] response to our Revdex.com complaint filed on 5/26/2016 received 6/27/2016. I/We would like to respond to make sure that our position is very clear. 1. Our Final Demand Letter was dated and sent on 5/16/2016 with a response due date of 5/27/2016 and Payment Due date of 6/1/2016 with no response to either. As of 5/17/2016 you were informed you, POSB was terminated and its contract and the reasons stated in the complaint. [redacted], and [redacted] were not your customers as of that date. 2. POSB you are correct about [redacted] has not paid in full for the building. The President of [redacted], Mr [redacted] stated in a email dated 4/13/2016 " do not pay the last payment until we know that POSB is in a position to provide the building. Your email of 1/20/2016 stated " Please do not send any money until we have a delivery date for the steel. So wait until April, and again on 5/17/2016 your email to [redacted] " Still working on giving [redacted] a delivery date for the steel for his building. No other materials have been ordered at this point so there is no other dates else due." We understand now, steel did not mean a building. The final payment for the building was in hand 9/4/2015 to be paid prior to any shipment of a completed order. 3. Your statement of "we are working with President of [redacted] to decide the best way to complete their portion of the contract and arrange delivery." As of 6/1/2016 we have signed no contract with POSB. We ([redacted]) do not have a signed contract with [redacted]. However, since 4/13/2016 [redacted] and [redacted] had been in contact with each other with well over 40 emails flowing back and forth trying to just get a building from you. If Mr. [redacted] was not a party to the building purchase, why did you and Mr [redacted] have continued direct communications to ordering and delivery dates? You have referred to "the best way for them to complete their portion of the contract and arrange delivery." I think you are confused don't you mean the other 7 orders that you have taken monies from and not delivered the buildings and you can't because you are C.O.D with your vendors for a long time and [redacted] of [redacted] has since 2015 tried to help solve this mess and your problems.4. Your statement of "the Revdex.com cannot be involved in this as it is with our parent Master Distributor. We are following what they say." seems odd in this case since you bought a protected territory since the early 2000's and this leads me to believe that you are belonging to the OutBack Corporations. Your Terms and Conditions of Sales referred to in the Building Component Sales Quote #[redacted] and the Sales Agreement #[redacted] states in the Breach Section, In the event of the breach of the contract both parties agree to Arbitration by the Revdex.com. In your email dated 5/19/2016 you stated " Per the contracts t's & c's this is not a time specific contract. It has held up in court many times and we will work on the delivery date."We do not have a agreement with you or the Master Distributor with whatever he ([redacted]) setsinto place. We filed the complaint with the Revdex.com and is the same as the Final Notice. We paid you, POSB$22,077.48 and had the final payment $ 7,859.14 in hand and you never up to 6/1/2016 placed a order with [redacted] suppliers. In the complaint and Final Notice is the Breakdown of the Total of $54,495.68 due.  is response because:

I am rejecting this response because: I am sending additional documents to the email address given to me the last time you requested additional information.I find the response by Pacific Outback Steel Buildings, Inc. totally false and amazed that they responded so quickly to Revdex.com.  First, they claim they responded with voicemails and emails.  When I contacted them on November 25, 2015, the day that [redacted] died, I left a message advising the company of his death and that I did not wish to continue with the project. I also told the company that I could not get into [redacted]'s computer and did not have email service.  I requested a return call via the phone.  I left my home number. There were no messages.  I also checked [redacted]'s business phone number; no messages.  I continued to call and leave messages twice a day for a week.  On approximately December 6, 2015, I called their business number.  A woman answered but never identified herself.  I asked if I could speak with [redacted].  I was told that she was not in.  I told her I had left many messages for [redacted], and to date had not received a call back.  The unidentified person said she would personally give her the message and would ask her to call me.  I continued to call but never received a live person, only the answer machine.  On December 6, 2015, I received the printed email in the US mail.The building that [redacted] was ordering is a standard building.  It was 30 feet by 40 feet.  There was nothing "unique" about it.  I cannot believe that the engineering blueprints and calcs are "special".  It is my belief that these blueprints are on hand and not made up "custom".  Also, [redacted]'s check was dated 11-12-15.  Assuming it was mailed the same day, the check was not cashed until 11-20-15 (the day before he died).  Are they saying that the engineering blueprints and calcs were put together in five days?  I would like proof that these documents were specifically made for the building [redacted] was planning on constructing and not something they pull from a file.  The size of this building is a very popular size.[redacted] has made NO attempt to contact me by phone despite my numerous requests for her to call me.  I believe that the company is taking advantage of [redacted]'s death by retaining his deposit.  I am also requesting a copy of the contract signed by both [redacted] and Pacific Outback.  I cannot find any document sign by any party.

I am rejecting this response because: Pacific Outback stated they had a contract witn both signatures; however, the document they provided has no signatures for the buyer and seller.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.
I have received the previously referenced Promissory Note, signed and notarized. Terms set fourth therein are satisfactory. Only time will tell if the terms are faithfully executed.

First of all I have never met this person and from her statements it is clear she has absolutely no idea what we do or how the buildings are configured, engineered or created.  We do not now nor ever have had "standard sizes".  They don't exist.  We done things like buildings specific down to 1/2" because that is what was required for a specific purpose.  We do not have whatever standard drawings she is talking about and I don't even know what they are.  We have wet stamped blueprints & calcs that are specific to a building and a specific address as required by each county for that particular piece of property.  [redacted] County does not accept just drawings that someone has that are done "in house."  I do realize there are places that sell so called pre-fab buildings in [redacted] in particular; however, [redacted] county will not approve them.  [redacted] first contacted us at least 3-4 years ago and changed sizes multiple times.  And changed doors, windows, skylights and other additions through the years.  He also had negotiated with a G.C. to erect the building.  He finally decided on adding (2) 10x10 rollup doors and had 8 polycarbonate light sheets panels in the roof.  In addition he placed (2) pa/access doors and 2 windows.  Sorry these were all customer placed and involved structural calculations to determine how the shear strength of the wall sheets were affected in these areas as well as the cross bracing that is used for wind loading and zeismic.  I have attached a copy of the signed contract that Mr. [redacted] agreed to and while we are sympathetic to his passing we had previously accepted his non-refundable deposit and paid the fees necessary to the structural engineer and to the owner of Outback Buildings of which we are a distributor where we pay all fees necessary for use of the software. The contract clearly states that a portion of the deposit can be refunded only if the county does not approve the engineering for this particular building.This did not occur and again, we are sympathetic to Mr. [redacted]s passing we were sorry he is unable to complete the project as we know he did want to there really is nothing we can do at this point except not enforce the continuation of the contract.  We have stopped it at this point.

I am rejecting this response because:It has been almost a year and nothey do not communicate with me daily I will send then an email and it takes days most time to get a response if I ever get one yes I was putting a house on the property as well so the shop was put on hold but they had everything they needed early Jan 2016 to finish it was told the process takes 4 to 6 weeks once everything is submitted it's been 11 months

Doors will be shipped and delivered. the refund he is asking for is a lot more than the cost of the doors. We will either ship the doors or the actual costs of the doors not his stated amount.

Mr. [redacted] did enter into a contract in 2013.  He did receive the wet stamped blueprints & Calcs for his building.  He informed us that he was not ready for the building and would tell us when he was.  That wasn't until a few months ago in 2015 so there were no delays caused by...

us up until then.  When he decided that now he wanted his building he was asked if he had worked out his access issues which were a concern.  The company delivering the steel has to have a driveway access for a 70ft. semi truck to park and the customer needs to have a forklift to unload the steel.  Mr. [redacted] replied he hadn't worked out the access yet is was just all bumpy dirt and no road but the semi could park on the main highway Coffee Road.  Coffee road is heavily traveled and cannot be obstructed by a semi at all for a long period of time.  The company that would be delivering the steel has been very clear that until clear access to the property is provided by Mr. [redacted] they cannot deliver the steel.As of today we have heard nothing from him.  There are display buildings located in Stockton.  There is no office nor has there ever been an office.  Mr. [redacted] did meet at the display site at one point but only because he had an appointment at the buildings.  The only office at that location belongs to a trucking company.  There is no one else there so, of course no one would be just standing around in a parking lot. There is a toll free phone # and a local number that are always monitored.  If someone is unable to answer the phone because they are perhaps on another call voice mail is always available.  In addition Mr. [redacted] has email and every email has been answered.  We have yes had issues surviving the recession and thankfully we all seem to be coming out of it.  So we are a lot closer to being able to take care of our end of this.  However, even if we could have his steel delivered tomorrow there still is no where to deliver it.

At this point there is a valid contract in place that we have not broken.  We cannot offer a refund when there isn't a need from our side of the contract. Mr. [redacted] has stated that he wishes to do something other than follow the terms and conditions of the contract.  Does he wish to cancel the contract?  If so, he must do so in writing.  then he would be charged for all goods and services that have already been paid for on his behalf.  The balance would be owed to him.  There are several sub-contractors who have contributed services and been paid for on this contract. So at this point we have nothing we can or should be doing.  Mr. [redacted] certainly can do whatever he wishes as we aren't controlling his behavior; however, he cannot dictate to us what we can do either,

We are not accepting any more bogus excuses at this point $41,130 and two years of wasting our time and money is on the online, Coffee Rd has plenty of room on the side of the street for a semi truck to park right by the gate to unload materials without blocking any traffic what so ever, we have [redacted] and other commercial trucks do the same and we unload construction materials all the time. There are two fork lifts on site already purchased for this project alone. At this point the file has been transferred to the Law offices of [redacted] located at [redacted] office [redacted] the owners of Pacific Steel Buildings will need to contact and forward all requested information to the law office, we are looking forward to take the case to court soon as it is clearly a breach of contract and all involved parties will be held responsible for their actions.
