Review: Floor is buckling and trim pieces are popping up. Carpets were stained and materials were dripped on stone patio causing stains. After multiple attempts through Palermo and Lumber Liquidators they have not honored the warranty or corrected the problems.

Background: I hired Palermo flooring through Lumber Liquidators. They installed flooring in my house and in Autumn of 2013. We had contract for service and price and the job was completed on time. I paid 50% down in cash (have signed receipt/contract) and the remaining 50% after completion of job (Palermo cashed final payment due stead in contract). Upon completion of the job Palermo informed us that we ow them twice the amount agreed upon due to "additional work". I informed them that we did not authorize any additional work nor were we notified of any additional work. [redacted] from Palermo has since visited to assess the issues and agreed that the buckling of floor boards was due to installation error (i.e. not levying enough room for expansion). However, he also stated that they consider the case still open and not under warranty as payment if not complete.Desired Settlement: Repair buckling floor. Adhere all trim pieces, clean carpets, replace, clean stones on patio where materials were dripped.

[redacted] states that additional work was done without his authorization but his wife [redacted], has signed off that she was aware of the additional work and charges associated with this additional work. We have signed paperwork by his wife which clearly states this. "I, [redacted] am 100% happy with the material and method of installation of my bamboo gluedown floor. I did not have the remaining balance on my person. Palermo will not have a problem collecting the balance (due)".

Furthermore some of the other additional work [redacted] states that were we not authorized to do was on his original estimate and invoice.

The additional work that was preformed was done to ensure his warranty would be valid. Palermo Flooring installed a concrete sealer, as the additional work, due to a high moisture reading on the subfloor concrete slab, which is done before all floors are installed.

[redacted] recently went out to inspect the buckling issue at the customers home. The floor is not buckling at all and only one board is 'bouncing' slightly. This is a very easy repair and Palermo will not have any issue repairing said board once the customer has paid his remaining balance fully or to reach a payment settlement. During this last inspection visit, moisture readings were performed again and came out in great standing.

Pictures of work performed where taken and can viewed upon request. This job was completed at an A+ level and the reason behind the complaint is because the customer has no warranty due to his outstanding balance.

Please note the following in response to Palermo's reply:

Response 1: NO additional work was communicated by Palermo during the job or at time of "completion". No additional work was authorized by my wife or me. The paperwork my wife signed is agreeing that the job was completed and we agreed to pay the remaining 50%, with the assumption that the obligations of the signed contract were met. I have repeatedly requested a copy of this paperwork and have not received it. In turn I promptly sent payment for the remaining balance of 50% and Palermo cashed the check. Upon calling Palermo, the day of job completion, they informed me that the bill doubled in price. I had verbally informed them of my disagreement but told them at that time I would be sending payment to honor the contract/agreement. At that time, [redacted] from Palermo, informed me not to send payment and that I would hear form their attorney. Informed him that I would be sending payment and that I would honor the existing contract and dispute their “additional work”. Further, after some time of dealing with Palermo and attempting to obtain performance through Lumber Liquidators, Palermo contended that they had emailed my about additional work prior to performing it. I had never received such an email and I requested that they send me a hard copy along with a screen shot of their Sent Email folder showing a date and time stamp. The deliver and/or failure can then be authenticated by the sender/receiver servers. To date nothing has been sent.

Response 2: Please see attached. NO such comments or wording is included.

Response 3: [redacted] told my wife and I that the buckling was sever and he did see how it would be a tripping hazard. Ho offered 2 options for repair and stated that he would be notifying Lumber Liquidators and someone should get back to me shortly (separate complaint filed against lumber liquidators, Complaint ID#: [redacted]). There are a number of boarded buckling (3 wide by 3 boards long). I do recommend that you view their pictures and compare them to the attached. The worsening of the situation can be seen. [redacted] had informed us at the time of the visit that the buckling was in fact due to the last board being cut to close to the trim and not enough expansion room being left by the installer. He indicated that this had to be the issue since the moisture reading was “great” according to his equipment.

4) Palermo wrote: This job was completed at an A+ level and the reason behind the complaint is because the customer has no warranty due to his outstanding balance.

Response 4: Having read this last statement I am offended and certainly now question Palermo’s business practices and honesty. The job was not completed to our satisfaction and a number of issues were by me when I had gotten home on the day of “completion”. The attached email makes note of them and later it was founds that installers dripped materials on the patio and stained bricks.

employees. As we have stated numerous times throughout this process,

Palermo Flooring has no issue making the repairs the customer is requesting.

All Palermo Flooring is asking for is the customer to pay for the work that

has been completed.

Anything within reason we will work with the customer to solve all these

issues.

Attached are pictures of the dirty carpet the customer is speaking of.

There is no boot mark to be seen. Also I am sending a second email with

attached pictures taken of the job completed (we have more if you would

like).

All Palermo Flooring is asking for is the customer to pay for the work that has been completed.

Response: I was not informed of any additional work nor any additional work required to satisfy a warranty. If additional work was required to meet the warranty a professional contractor should have noted it on the original contract as either a requirement or a possibility. I have no way of know what additional work was done, what materials were used, or if they were applied in appropriate manner, if at all. I have reservations based on the time actually spent to complete the job (i.e. not the actual duration but rather total labor hours).

Response: The cost of the “additional work” over double the cost of the project. I would have not used Palermo for the project had they included the “additional work” in their original quote. Based on conversations with them, I believe their tactics are deceptive and unprofessional. From the onset of the disagreement they told me not to send in the remaining payment and that I would hear from their lawyer. I did send in the remaining contract amount (which they accepted). However, after numerous threats I have yet to hear from their attorney.

Response: It had been some time since the job was completed. I cleaned the carpet yet the red staining from the wood cutting/dust still remains along with the other staining at the entry way. None of the staining was there prior to the job. As previously mentioned Palermo drip materials on me rear brick patio causing excess staining. I am having the mason that built the patio come back for an assessment.

I realize that the Revdex.com is only an intermediate and has little authority to rule of force action on either party. I appreciate your time and at this juncture will file a formal complaint with the Suffolk County Consumer Affairs and will have all repairs, cleaning and replacements done by licenses and qualified companies. I will retain all correspondence and itemized bills and will bring Palermo to Small Claims court for damages.
