Ref: [redacted] If [redacted] did not directly contact the carrier to confirm financial status then he bypassed verification necessary to completing the sale and shares blame with the seller in this situationIf [redacted] did contact the carrier to confirm device status as instructed by Swappa before completing the sale then the carrier provided information and is to blame (the seller could blame them as well).Still, action was taken against the seller; their account was reviewed and they received a penalty rating for all other potential buyers to see.Either way, if the carrier was providing incorrect information to both buyer and seller then how could Swappa possible be blamed? If the buyer did not receive what they expected then they deserve a refundHowever, claiming a problem one year later is not a reasonable time-frame for support under these circumstances

If the seller does not meet their requirements then the buyer is entitled to a full refundYou transacted directly with the seller and you confirmed, after receiving the device, that it met all the stated requirementsSwappa pre-screens listings verify all listings to the extent that we can, but never handles the deviceThe buyer must always verify after receiving the device that it is in the advertised conditionWe provide a checklist for all items to check, including contacting the carrier and confirming the ESN status

After all, Swappa's website claims that all of this is checked prior to the sale The representative claims that their system is "imperfect," but I maintain that not only does Swappa not ensure proper safeguards to prevent the sale of such illegal items, but rather they intentionally neglect and at times impede the actions of uncovering the true history of these high-end electronics The basis behind this is because of the attached documentation: I randomly found another seller on Swappa who was selling the same type of device in question, asked them to provide documentation indicating that they were the true owners and that I would pay them more for their trouble The sellers were unable to provide documentation indicating that they were the original owners as they stated in the listing, and Swappa removed my comment and allowed the sellers to relist the product This type of illegal activity that Swappa promotes online is neither isolated nor is it accidental Regards, [redacted]

Swappa (***) is a site that allows sellers to post listings to sell mobile devices (e.giPhones, iPads)Other users can act as buyers and purchase a listing, paying the seller directlySwappa is not a middle-man to the transaction, just a facilitator, and we receive a small amount ($10) of each successful transaction for our services. While Swappa does review listings and undertake extensive anti-fraud measures as part of our service, the seller is responsible for ensuring the accuracy and fulfillment of their listing and saleAll buyers of the site know and understand this before buying or selling per clear documentation and our terms of use.Her complaint, in part: "I bought a Samsung Galaxy sfrom Swappa, which was defective without my knowledge." Followed by: "I used it for a good months without any issues, and then all of a sudden my phone service was disconnected, and I found that the phone I had purchased from Swappa had been reported as stolen."We are sorry to see Ms. ***'s experience with a phone she purchased from another user on SwappaShe has legitimate reason to be upsetHowever, this situation was not in anyway caused by Swappa. Ms*** purchased a pre-owned phone directly from another userThe device was not defective when purchased in June of as declared by the buyerThe device did become defective many months later after it was apparently reported lost/stolen by the original owner. The complaint is legitimate, however it should not be targeted at SwappaThis situation was caused by fraud perpetrated by the original owner of the device and allowed by the blocking carrier (Verizon).The buyer states in the Desired Setttlement: "It is completely unjust for me to have to foot the bill for Swappa's negligenceI should never have been sold a phone that had a bad ESN."This situation was not caused by negligence, nor any action or inaction of SwappaNobody sold a phone that was reported stolenRather, seven months after the phone was sold the original owner committed fraud to report it stolenTo suggest Swappa had any part in this happening is untruthful.Further the buyer states: "I desire a full refund or replacement for the phone I purchased."This is a reasonable request, but one that can only be met by the party that sold her the device (which again was not Swappa)Alternatively, hopefully this can be resolved by the carrier that allowed her to use the phone for the better part of a year then allowed a previous user to report the device blacklisted without merit. hour.Quotes from him included: "THERE ALL liars and MEAN people who work here! I NEED my money bACK! *** should be fired and get kicked OUT IMMEDIATELY! I sent several emails and I WAS ignored, *** is totally BS and a filthy person."His claims of being ignored are absolutely untruthfulHis emails were belligerent and personally insulting to members of our staffWe do not wish to do any business with this personHe has been fully refunded and banned from our serviceWe consider this matter concluded
