Parade Publications Reviews (1)

Review: Parade Magazine's Weekly Freebie , as of this new year (2014) now requires everyone to enter through a Facebook account even though they say under their terms & conditions that "This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.". It is impossible to enter the sweepstakes without a Facebook account (which I do not have or want to obtain). How can they say it is not administered by, or associated with, Facebook? The entry method is contradictory to their own official rules. I have sent them an E-mail about my concern. In their response they wrote "At this time, we're hosting our contests on our Facebook page just as many other large brands do. ". I am going to try to paste the entire E-mail below for your review.

Thanks for reaching out to us. We appreciate you taking the time to let us know your concerns and we'll keep them in mind in the future.

At this time, we're hosting our contests on our Facebook page just as many other large brands do.

We're sorry that you do not feel comfortable entering in this way.

Subject: Your Sunday Freebie.

Dear Sir/Madam,

I am trying to sign up for the weekly freebie as I do every week. Now, apparently, I must sign up for Facebook AND "like this page" (whatever that means). What has happened to the common "no purchase necessary" that is found in virtually every sweepstakes that I have ever seen? On your entry page it says "This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Parade Magazine and not to Facebook.". If it is not by or for Facebook, why do I HAVE to have a facebook account to enter the sweepstakes? How is "providing your information to Parade Magazine and not to Facebook", or, not "administered by" (Facebook) possible if I MUST do it through a Facebook? Is this not a form of discrimination? I never install a program or give my personal information to any entity that I believe will leave me open to identity fraud, spam, spying on my web searches and other Internet activity history. I know Facebook can & does share all those things. It appears the purchase necessary is to sell myself to the world! I would like to continue entering your weekly sweepstakes but only through a trusted entity like your Home website. Thanks for your time & consideration on this matter, I await your response.

Sincerely, [redacted]Desired Settlement: They should change their rules of entry or change their legal wording of entry to reflect the truth of how to enter their weekly sweepstakes.

Response:

Dear [redacted],

We write in response to the above-referenced complaint submitted by [redacted].

We understand that [redacted] is upset because PARADE’s popular Sunday Freebie Sweepstakes now requires participants to enter through the magazine’s Facebook page. We also understand that [redacted] believes that the Official Rules governing the sweepstakes are misleading. Both issues are addressed below.

Among the reasons for transitioning sweepstakes to the PARADE Facebook page was PARADE’s desire to increase readership engagement through social media platforms. While we appreciate that a portion of our readers, like [redacted], are not Facebook users, we note that Facebook membership is free and easy to obtain. Furthermore, the information required to become a member of Facebook is the same type of information PARADE required from participants when the point of entry for its sweepstakes was on the PARADE website [redacted]). Accordingly, we do not believe that the transition to Facebook has made entry into our sweepstakes more complicated or onerous.

Furthermore, we respectfully reject [redacted]’s claim that the Official Rules are misleading and untruthful. The Official Rules clearly explain, among other things, the process for entry. [redacted] asks “[w]hat happened to the common ‘no purchase necessary’ that is found in virtually every sweepstakes that I have ever seen?” However, we note that the following language is included at the top of the Official Rules:

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A purchase will not improve chances of winning.

Additionally, [redacted] takes issue with the inclusion of the following statement in the Official Rules: “This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.” While we understand how this language may seem confusing to [redacted] since the entry mechanism for our sweepstakes is on a Facebook page, the fact remains that Facebook is not responsible for sponsoring or administering our sweepstakes, nor is Facebook endorsing or associated with our sweepstakes. On the contrary, as indicated in the Official Rules, PARADE is the sole sponsor of (and is solely responsible for the administration of) these sweepstakes. It is also worth noting that Facebook’s own terms require the inclusion of the language at issue (see Section III(E)(2)(b) of the terms available at [redacted]

We appreciate your attention to this matter. Please feel free to contact me with any questions.

Sincerely,

Consumer
