PATHWAYS DUI PROGRAM EXEC REFUSES TO WORK WITH FLOOD VICTIM AFTER COMPLETING 3 MONTH PROGRAM FOR A 21 YR OLD CONVICTION
I was convicted of a DUI first offender in 1995. My driver's license was suspended. I never felt the need to get my driver's license because I became pregnant plus my two grown kids could take me where I needed to go..,they were 18 and 19 at the time. Now my youngest is 20 yrs. old and moved to Southern California and my son lives in Roswell, N.M. and my daughter and grandson moved out. So I feel have to get my license back and it's been over 20 years. I paid the $125 admin fee at the DMV and enrolled in the First Offender DUI program at PATHWAYS. I completed the course with my final class ending on December 22, a couple of weeks ago and I only needed to see the counselor at Pathways for her to sign me off. I had made the appointment for the 9th of January...Monday of this week. My house in Marysville (it's actually Linda by the old Peach Tree Mall) was flooded and I called PATHWAYS and Sara the person in charge said she would have to pay $15 for missing the class before we could reschedule the appointment. Wednesday the 11th I went in there and paid the $15 and tried to reschedule and they told me that it was too late that day (3pm) that I would have to try back. I called yesterday to reschedule and Sara wasn't in the office. Today I called and Sara told me that I have not had any activity on my account for 21 days and that I would have to go back to court and get another referral from the court to start the program ALL OVER AGAIN. I paid so much money to this program ON TIME, WAS NEVER LATE TO ANY OF MY CLASSES, NEVER MISSED A CLASS, and because she doesn't like the way I panicked when my house was flooding she is going to throw the book at me?! I am speechless as to how much authoritative power these bhes have. AND THEY'RE NOT EVEN THE DEPARTMENT OF MOTOR VEHICLES....THEY ARE JUST A Partnership program THAT I COMPLETED BUT NOW SARA REFUSES TO WORK WITH ME....I CANNOT BELIEVE THIS!!!!
I talked to the DMV and they can't do anything at all..the California Department of Health Care Services is this programs "overseer" but they barely got the program assigned to them...

I am not going to go back to the court now, not after 21 years.
I am not going to allow for $1100 paid to this program to go down the drain over a woman that is discriminating against me.
There is no other recourse for me to get my driver's license back other than to do what this woman says? SHE CANNOT STAND ME and I don't even know why.

Review: I applied for DUI classes (to get my drivers license back) at Pathways in Yuba City,CA on 2-13-14. I got a DUI back in 2007. Pathways asked me to bring in my DMV printout, current I.D. and $125, which I did. They enrolled me in an 18 month course. I just went to DMV today (5-21-14)to see about getting a restricted license and DMV informed me I only needed a 3 month DUI course to get my regular drivers license back! And DMV gave me paperwork today stating that. I went to try to resolve the matter with Pathways today and see if they would transfer the 3 months of the 18 month program I've already done since THEY were the ones who put me in the wrong classes/program. The Program Director ([redacted]) was very rude and told me I should have made sure I was in the right program. She then said,"If you don't like it you can do your program somewhere else." I said," why did you guys have me bring in my DMV printout if you didn't even look at it to properly place me," and she replied, "we did look at it!" I then asked," why did you put me in the wrong classes then?" She got more rude. They are terminating me from the 18 month program in which I have paid 2 months in advance. She said they have 90 days to refund my money. So now I can't even afford the $125 to enroll in the 3 month program until they send me the refund! I asked if they could use the money I've already given them to start the 3 month program. [redacted] was very unprofessional and down-right mean. She kept on saying,"we provide a service here."I don't even know why she would say that. They're not a non-profit organization! I asked if there was anyway she could work with me. She replied,"if your'e going to blame this on us then there's nothing I can do for you." Then she repeated,"we have up to 90 days to refund your money." I was very upset but said "thank you" and walked out. Ms. [redacted]l also said they usually have people sign a waiver for mistakes like this. I told her I wasn't made to sign one and she said "exactly."Desired Settlement: Since it was their mistake, they should transfer my 3 months of classes attended there to my required 3 month DUI program. And they should refund the extra money to me. If they can't transfer my class credits, they should AT LEAST have to transfer the money I've paid them already toward a 3 month program and refund the balance to me. I feel like Ms. [redacted]l thinks she can just do anything she wants to people because of her position. It's not right for her to treat paying customers like this.

Due to confidentiality state law CFR 42 we will be responding to this complaint using the Revdex.com ID # only. Pathway’s a non-profit organization serving the Yuba and Sutter Counties since 1974 providing the least expensive DUI programs in the North State. All clients who come to enroll are asked what program they are required to enroll in as we receive referrals from multiple courts’ and from the DMV. Pathway’s does not choose the program the client is required to attend. However the client in the above named complaint was previously enrolled in an 18 month SB-38 program in 2011 per the DMV for a prior DUI. The client came in on February 13, 2014 with a DMV H-6 printout stating he/she needed an 18month program. The DMV printout reflects multiple offenses within a 10 year period and the client request to be enrolled in an 18 month multiple offender programs.

The client attended a total of 18 activities between 2/13/14 and 5/16/14. The client paid $575.00 to enroll and attended program activities. These activities totaling $495 worth of and will be refunded $80 within 90 days after termination (term date 5/21/14) per CA Title 9 subchapter 4 section 9878 (k). After speaking to [redacted], Supervisor of the Department of Alcohol and Drug Programs, Driving under the influence Branch, Pathways confirmed is not required to transfer credits or finances from one program to another.

When a Client has a disagreement with policy financial terms or other concerns, Pathway’s company policy requires that two staff members are present for witness. In this situation the company witness to the information provided by the compantant has stated the client was upset, agitated, and used a rude tone of voice after being told he/she would not receive credit for services rendered. It is unfortunate that things of this nature occur and we are aware people are not happy to attend DUI educational courses but these are Court/DMV mandated courses that the client must attend. We are a non-profit agency providing these services at a lower rate to allow clients to complete probation or obtain a drivers license.
