Review: Here is a copy of the letter I sent to Paving the Way explaining the issue:

I signed a contract with you on August 22, 2013 for the installation of a patio, replacement of 3 deck posts, and the removal of a sliding glass door. During the contract process I also asked about the excavation of another small area, which you readily agreed to. You also suggested raised planting beds, which I stated that I did not want. You said that work should begin in about two weeks. I waited patiently for work to begin but did not see you for several weeks. Once work did begin, the patio portion of the project was still only partially done at the end of October.

At the completion of the patio portion, I again inquired about the extra excavation, which you now told me you would not be doing. I accepted this because we did not have it in writing. I also was also left with raised planting beds outside my patio walls, which I also accepted because it was not in writing. You also stated that the patio was slightly smaller than the 610 square feet stated in the project contract.

Weeks had gone by and I had not heard from you about the removal of the door. I sent you a message and you replied that it would be done soon. More time passed, and I again inquired about the rest of the work. You apologized and said that it would be completed in the next two weeks, this was in November. Over a month went by and you neglected to contact me at all. Then I received an invoice from your company on January 15th.

The invoice stated that I owed another $270.00 for pavers. You stated at signing that there would be no extra charges and also told me, after completion, that the patio was slightly smaller than quoted. The invoice also gave a $500 credit for the door. We did not discuss this and it is unacceptable. I currently have a door that is a major safety hazard because it has no steps beneath it. During the patio process, your company removed the steps that led to that slider with the promise that the door would be removed and closed in. I have two small children that could easily be hurt from a fall here.

Our contract stated that the final payment was due upon completion of the job, yet almost 5 months after the signing of the contract, the job has still not been completed and I am left with a door that is a violation and a safety hazard. I now have to figure out what to do with the door to ensure that no one gets injured by trying to use it.Desired Settlement: Either consider the contract done with no more monies owed or provide me three contractors that I can choose from that will complete the work in the next two weeks (I am having a floor put in that cannot be completed unless the door is done)

Response:

Paving the Way is a hardscaping concrete company that installs patio, walks, steps, walls, etc.

Alter meeting with said customer and presenting a contract for patio, steps and sitting wall, said customer asked if my company could provide some carpentry work. He was told that we would use another contractor to do that work since we are not in the business of performing carpentry work and said customer agreed. My company amended/revised the contract to include the carpentry work he asked for and added $500.00 to the final cost for that work.

the hardscaping work was completed, we tried several times to get the carpentry contractor to perform the work but he was in the middle of a large job and could not pull away to perform the work in a timely fashion. Therefore, Paving the Way credited said customer $500.00 for the carpentry work and also credited said customer for extra work that was performed by Paving the Way for customer’s inconvenience.

Customer contacted Paving the Way via e-mail and Paving the Way responded via e-mail leaving my personal cell phone number and should have have any questions to feel free to contact me so that we can

resolve the matter. In addition, as of this date, the customer still owes the balance final invoice (approx. $3,000.00) which I have yet to receive.
