The company in question normally would process their payroll information a few days before their check dates, the 15th of a month and the last day of the month After the company processed their last check date of 2013, December 31, 2013, they did not give Pay-Net any indication of their
intention of leaving Pay-Net's payroll services
Pay-Net's first indication of the departure of this company occurred about January 13, 2014, when the company did not process their payroll for their first check date in 2014, January 15, Since the Pay-Net staff was busy preparing Year End Payroll Tax Returns, including WForms, for our clients, we were not able to contact this company during that week The following week, the company contacted our office inquiring where their WForms were At that time, we were informed that the company had left our payroll service for another service My staff explained to the company that our system prevented us from processing Year End for any company that had left our service without first receiving payment The company agreed, and after payment was received we processed and released the WForms to the company
The critical part of this complaint is the client's perceived lack of access to, what they describe as, their payroll data If we examine the time table, the client was aware that they were going tor change payroll services sometime between December 1, and January 15, During this time period, the company downloaded payroll information and provided this information to their new payroll service in order to become setup and ready to run their first payroll dated January 15, Also, during this period, the company accessed the secure Report Repository to download their Quarterly and Year End Payroll Tax Returns And, when we examined the records, access to the online payroll system was available to the client up until February 5, 2014, when the client's data was erased from our online system
So, in actuality, the client had complete access to their data for a period of days AFTER they had run their last payroll with Pay-Net and before their access was removed The complaint states that the client would only need hours access With our web-based system, available 24/7, they actually had some hours that they should have retrieved the data
On February 11, 2014, the client's representative talked to me about the data retrieval I stated to her that we would not restore her data, but if she gave me a list of her requirements, I would run the reports and mail them to her for no additional charge That evening, at 5:03pm, I received an email from the client stating that she wanted access to Pay-Net's system On February 12th, at 10:52am I received an email from the client informing me that she was filing a complaint with the Revdex.com, I was out of the office at that time Some minutes later, at 11:47am, I received an email from the client stating that they had filed a complaint with the Revdex.com at 11:41am So, in less than hours, the client's representative went from a discussion of a problem to a complaint filed with the Revdex.com It is obvious to me that the company does not really want, or need, their information or they would have tried to arrive at some agreeable solution
Finally, the concept that the data belongs to the company is incorrect Payroll processing services, like Pay-Net, are third party service providers, according to IRS definitions And, as such, payroll processors do not have any fudiciary obligations or requirements and function as Attorney In Fact's for the clients when it comes to tax deposits and payroll tax reporting, totally different than CPA's or Attorneys
In summary Pay-Net was not aware of the client's departure from our service until late in January The client had over hours, and 30+ days, available to them to access the web-based system and download all the data they needed before being erased from the online system The client did not make a sincere effort at problem resolution My offer of generating the reports and sending them to the company still remains

Mr [redacted] and staff went out of their way to help us this winter, came out fast and checked our furnace, found our issues, his worker [redacted] who has been with him 25years was amazing. They installed our furnace right away and got our family heat, they have been working with our family for over 30 years. Very trustworthy and honest. His staff are just like family.

Review: We hired Pay-Net services to process our payroll. Due to a change in banks, a decision was made to transfer the payroll services to our existing bank. Pay-Net was rude and unprofessional when I asked for my W-2s. That aside, I was not given any notification Pay-Net was going to disable my access to my payroll records. I need to print out many reports from the Pay-Net website, as we used Pay-Net for over 11 years. The company offered to print the reports, but I need to access the information so that I can determine which reports on need printed. Furthermore, the payroll data does not belong to Pay-Net, it belongs to Kriger Law Firm. The payroll company is now telling me the data was available to me and it was my fault if it was not printed. They are also claiming there is a problem with security issues. The security issue does not make sense to me, because I have always just had access to our company's payroll. If Pay-Net is worried about security, then it would stand to reason I should never have been granted on-line access in the first place.Desired Settlement: I want access to my payroll data so I can print the reports I will need to have documented. They can, of course, limit the amount of time I will have access to the payroll data. I am requesting that I have access for at least 48 hours to print the reports necessary.
