      I have not been reimbursed for the towing and my time that I missed at wk those plates should have never been taken off my car it was done because I didn't wanna pay a personal property fee which I was told by [redacted] its a fee IF  there is if  any personal property that has to be taken out of the car which I had nothing in the car so there only option was to take off the plates which they threatened me with because I knew I didn't have to pay the fee. I made all appropriate decision and acted very professional with these people..... they hung up on me several times they picked up the phone and tried to speak in chinese.... I was specifically told they were gonna make my life difficult with these plates and thats when I got the police involved.. nothing in my case was done professionally and from what I herd from dmv they have this problem with this repo company all the time... I delt with [redacted] regarding this matter and talked to a couple of repo companies and they agreed  that this was done outta of spite because they didn't get there 100 dollars that there desperate for. the car was paid in about 11 hrs of the reposseion why take my plates off and how do u tell a person to drive home with no plates wich I lived 20 min away.. we clearly should be able to c what kinda of business these people are running... very unprofessional. when I picked up the car the man who repossessed it even said there was NO personal property in my...

TO WHOM IT MAY CONCERN:ON 09.06.2016 PAYBACK REPO REPOSSESSED [redacted] A[redacted]'S 2010 NISSAN ROGUE AS INSTRUCTED BY OUR CLIENT AMERICAN LENDING SOLUTIONS WHO WAS HIRED, BY [redacted]'S LIENHOLDER EXETER FINANCE. THE VEHICLE HAD BEEN INSTRUCTED TO BE REPOSSESSED BY EXETER FINANCE WHO STATED [redacted]...

[redacted] LACKED THE PROPER INSURANCE ON HIS VEHICLE. AT APPROX. 5PM ON 09[redacted].2016 WE RECEIVED A CALL FROM AMERICAN LENDING STATING THAT EXETER FINANCE WOULD LIKE A QUOTE TO KNOW HOW MUCH WE WOULD CHARGE TO RETURN [redacted]'S VEHICLE TO HIS HOME ADDRESS, BC IT SEEMED THAT HIS INSURANCE HAD BEEN REINSTATED, BUT HE HAD FAILED TO NOTIFY HIS LIENHOLDER. WE PROVIDED OUR CLIENT WITH A QUOTE AND INFORMED THEM THAT WE DID NOT HAVE ANYONE TO RETURN THE UNIT AT THE MOMENT BUT WE COULD HAVE IT DELIVERED TO HIM THE FOLLOWING DAY. AMERICAN LENDING STATED THAT WOULD BE FINE AND PROVIDED US WITH [redacted] CONTACT # SO THAT WE COULD MAKE ARRANGEMENT TO DROP OF THE UNIT.PLEASE NOTE THAT THE NY STATE LICENSCE PLATES ON [redacted]'S VEHICLE HAD EXPIRED IN MARCH OF 2016. THEREFORE THE PLATES ON HIS VEHICLE THAT HE WAS DRIVING AROUND WITH WERE NOT LEGALLY PERMITTED IN NY STATE FOR OVER A PERIOD OF 6 MONTHS. PART OF THE RETURN INSTRUCTION PROVIDED BY BOTH EXETER ANY PAYBACK REPO WAS THAT WE WOULD NOT RETURN TO THE PLATES TO [redacted] INSTEAD WE WOULD SURRENDER THEM TO THE NY STATE DMV. REASON FOR THIS IS THAT NY STATE LAW DOES NOT PERMIT US TO RETURN EXPIRED PLATES TO A CUSTOMER ONCE OBTAINED. WHEN WE CONTACTED [redacted] TO MAKE ARRANGEMENTS TO DROP OFF HIS VEHICLE NOT ONLY DID WE EXPLAIN THAT HE WOULD NOT BE RECEIVING HIS PLATES BACK, SOMETHING THAT WE WENT OVER THOROUGHLY TO INSURE HE UNDERSTOOD, BUT WE ALSO EXPLAINED WE HAD NO AGENTS AVAILABLE TO DROP HIS VEHICLE OF TILL THE FOLLOWING DAY. [redacted] SAID HE UNDERSTOOD WHY HE WOULD NOT BE RECEIVING HIS PLATES, BUT HE WANTED THE VEHICLE BACK THAT DAY. AN AGREEMENT WAS MADE WITH [redacted] THAT WE WOULD DELIVER THE UNIT TO HIM THAT DAY, PENDING HIS GAVE US UNTIL MIDNIGHT TO GET IT THERE. AS MENTIONED BY [redacted] THE UNIT WAS DELIVERED TO HIM AT 11:45PM. THE REASON HE HAD LESS GAS THEN HE HAD WHEN HE PROVIDED US WITH THE VEHICLE AND THE KEYS, IS BECAUSE NOT ONLY WAS THE UNIT DRIVER TO OUR YARD FOR STORAGE AS OUR DRIVE AWAY INSURANCE PERMITS, BUT IT WAS ALSO DRIVEN BACK TO HIM HOME THE FOLLOWING DAY TO BE RETURNED TO HIM. THAT BEING SAID, I HAVE NO IDEA WHY [redacted] WOULD FILE A FALSIFIED POLICE REPORT STATING HIS PLATES WERE STOLEN WHEN HE WAS NOT THAT HE WOULD NOT BE RECEIVING THEM BACK BY BOTH US (PAYBACK REPO) AND HIS LIENHOLDER EXTER FINANCE. AS FAR AS THE GAS SITUATION GOES, NEVER HAS A PERSON QUESTIONED THE USUAGE OF THEIR GAS WHEN PROVIDING A KEY FOR A UNIT AND THEN HAVING IT DRIVEN BACK TO THEM. THAT BEING SAID CUSTOMER SERVICE IS SOMETHING THAT IS VERY IMPORTANT TO US, AND IF IT WOULD REALLY PLEASE [redacted] WE WOULD BE HAPPY TO GIVE HIM $20 TO REFILL THE 1/4 OF A TANK THE WAS USED. ON THAT NOTE, I HAVE ATTACHED TWO DOCUMENTS ONE BEING A PICTURE OF [redacted]'S GAS METER TAKEN AT THE TIME OF THE REPOSSESSION AS REQUIRED BY OUR CLIENTS AMERICAN LENDING & EXETER FINANCE SHOWING [redacted] HAD ONLY A 1/2 A TANK OF GAS AT THE TIME OF THE REPOSSESSION, TO WHICH WE USED A 1/4 OF IN THE REPOSSESSION AND DELIVERY PROCESS. THE OTHER DOCUMENT ATTACHED IS A COPY OF [redacted]'S DMV PLATE SURRENDER LETTER SHOWING THAT WE HAD RETURNED THE PLATES THE NYS DMV ON 09.06.2016. AS YOU WILL NOTICE NOT ONLY DOES THIS ATTACHMENT SHOW THAT THE PLATES HAD BEEN SURRENDERED ON THE [redacted] OF SEPTEMBER. BUT IT ALSO CLEARLY STATES THE FOLLOWING: REGISTRATION SUSPENSION, INSURANCE LAPSE -REGISTRATION EXPIRED. INSURANCE CANCELLED 05.**.2015. PLATE WAS TO BE SURRENDERED ON 03.**.2016 WHICH IT WAS NOT LENGTH OF SUSPENSION 304 DAYS (MEANING HE WAS 304 LATE IN RETURNING HIS PLATES, WHICH HE WAS ILLEGALLY DRIVING AROUND WITH) AND FINALLY A SUSPENSION DATE ENDING 01.12.2017 MEANING HE IS NOT PERMITTED TO RECEIVE PLATES IN NY STATE AGAIN UNTIL THE BEGINNING OF 2017. HENCE EXPLAINING [redacted]'S AGGREVATION WITH THE SITUATION. BECAUSE WITH OUT US PROVIDING THE EXPIRED PLATES BACK TO HIM, HE WOULD NOT BE ABLE TO LEGALLY PUT PLATES ON THE VEHICLE IN NY STATE AGAIN UNTIL 2017 DUE TO HIS NEGLIGENCE IN RETURNING THE PLATES TO THE NYS DMV AS INSTRUCTED. I SEE [redacted] IS REQUESTING A REFUND FOR HIS GAS, WHICH ALTHOUGH USAGE OF THE GAS IS A GENERAL AN ACCEPTABLE OCCURANCE IN THE REPOSSESSION BUSINESS, I WOULD BE WILLING TO STILL PROVIDE HIM WITH $20 FOR THE GAS USED. HOWEVER, HE IS ALSO SEEKING AN APOLOGY FOR TAKING THE VEHICLE. UNFORTUNATELY ALTHOUGH I AM SORRY FOR THE PREDICAMENT HE IS CURRENTLY IN. WE WERE SIMPLY HIRED BY A CLIENT TO REPOSSESS A VEHICLE, IN WHICH CASE IF AN ERROR DOES OCCUR WITH THE REPOSSESSION PROCESS OUR CLIENTS CONTRACT STATES THEY ARE TO TAKE FULL RESPONSIBILTY. WHEN WE RECEIVE A CASE FROM A CLIENT BY LAW THEY DO NOT EVEN HAVE TO TELL US THE REASON FOR THE REPOSSESSION, THEREFORE I DONT KNOW FOR SURE IF THIS CASE WAS EVEN A LEGIT WRONGFUL REPO, AND IF HE WOULD LIKE TO SEEK AN APOLOGY FOR THE REPOSSESSION HE SHOULD CONTACT EXETER, BC UNFORTUNATELY HE IS SEEKING AN APOLOGY FROM THE WRONG COMPANY. LAST BUT NOT LEAST. HE FEELS IT WAS ILLEGAL FOR US NOT TO RETURN THE CAR THE WAIT IT WAS TAKEN (WITH THE PLATES ON) HOWEVER AS MENTIONED NY STATE LAW PROHIBITS US FROM DOING SO. ONCE WE ARE IN POSSESSSION AS AN ITEM SUCH AS EXPIRED PLATES THAT SHOULD HAVE BEEN RETURNED TO THE DMV, WE ARE LEGALLY OBLIGATED TO DO SO. To whom it may concern:On 02.**.2015 [redacted] contacted our office to make arrangements to pick up her 2003 Honda Accord that had been repossessed on 02.**.2015 as per the direction of our client/[redacted]'s lien holder '[redacted]' do to lack of payment.  [redacted] sent...

us a release authorizing [redacted] to redeem her vehicle upon payment of the property fee.  [redacted] was offered the option of paying the above-mentioned property fee (totaling: $103.00) by credit card over the phone or, by cash in person at the time of the redemption.  [redacted] immediately stated that she was refused to pay the property fee.  It was then explained to [redacted] that the property fee is a contracted fee between Payback Repo & her lien holder [redacted], and that if she is refusing to pay this fee we recommend that she contacts [redacted] to see if they would be able to waive the fee.  When [redacted] contacted [redacted] they confirmed with her that she is in fact responsible for the property fee. After around the [redacted] inappropriate & threatening call we received from [redacted] demanding the address to which her vehicle was located, I gave in and finally agreed to waive [redacted]'s property fee. Although, this was against my better judgment since by this point [redacted] had threatened to sue both Payback Repo & [redacted] as well as file a complaint with the Revdex.com, I agreed in hopes to put an end to the on going dispute. Once [redacted] had redeemed her vehicle (at no charge) I received yet another phone call, now demanding we give her back her license plates.  It was explained to [redacted] that her plates had been returned to the Dept. of Motor Vehicle.  As of 02.**.2015 [redacted]'s vehicle had now been in our possession for a total of 5 days. NY state law requires that we surrender the license plates to the NY state DMV within 24 hours of the repossession.  Please note, that as explained to [redacted] " Failure to do so is a violation of vehicle and traffic law section 425, which is punishable by a fine of up to $150.00." [redacted] then shouted, "You won't get away with this!" and slammed down the phone. Approximately 2 hours later [redacted] arrived at our main office in Lynbrook NY, accompanied by two officers from the Village of Lynbrook Police Dept. The officers informed me that [redacted] had called them because we refused to give her back her license plates.  At this point, it was then explained to the officers, that it was not that we refused to give them back, but that we could not because they had been returned to the DMV, as state law requires.  I then provided the officer with a copy of the MV327, which is a document that is required to be given to the DMV along with the plates when surrendering. The officer than explained to [redacted] that her plates had been returned to the DMV, they then provided her with the copy of the MV327 they had been given and told her at this point she would need the DMV to obtain new plates. The officers thanescorted [redacted] off the premises and went about their day.  Half hour after the officers had left [redacted] then contacted our office yet again, stating that the MV327 provided to her was not legit because it was not even stamped or signed by the DMV.  [redacted] was then told that she is correct the form is not stamped nor signed, as mentioned when she was provided the form, its just a copy showing the state law.  Being we are a repossession agency we return plates in bulk & they are not processed while we wait.  Not only does it take a few days for the plates to be processed, but also I would not be able to provide her with the DMV plate surrender receipt for at least a week or two when they are mailed back to our office.  However, if she wished to obtain the receipt sooner she could simply do so by contacting or going to the Garden City, NY DMV where the plates had been surrendered.  [redacted] was not heard from again until the next day 02.**.2015 when we received notice of her complaint to the Revdex.com.            Please Note: I have included a copy of the release request sent to us by [redacted] Financial stating [redacted] is responsible for the personal property fee. A copy of [redacted]'s MV327 stating NY state law requires plates to be returned to the DMV with 24 hours.  As you can see we have no other complaints on the Revdex.com website and place ourselves on being one of the only repossession companies accredited with the Revdex.com. They took our car illegally. I have a letter stating that we had more time to pay past due balance not for lack of insurance. They came at a late hour to take the car. The tank was full because my wife filled the morning of 09.**.16. Since the plates were on the car when the car was taken and I called to ask who took the plates off, The repo company should have not lied to my wife and tell her the local police station took them off. This is the reason why my wife filed a report with our local precinct.

Review: My vehicle was repossessed on June *, 2015 by Payback Repo Inc. On June **, 2015 I called the business to inquire about the status of my vehicle and to confirm if the plates (which were attached to the vehicle at the time of repossession) were delivered to the [redacted]. The woman I spoke to (no name was given) told me that the plates were not submitted and would not be submitted until the vehicle is removed from their lot. I asked why and she claimed that the plates were not submitted for the customer's convenience. I informed her that I would not be getting my vehicle back and therefore needed my plates returned to the [redacted] as soon as possible so that I could cancel my insurance. She told me that was not possible and I could pick up my plates in person, and I would be required to pay a fee to do so. After hanging up I contacted the [redacted] whom informed me that ** Vehicle and Traffic Law Section 425 requires the repossessor of a motor vehicle to, within 24 hours, deliver personally or by special delivery first class mail to any Motor Vehicle Issuing Office the licence plates from the vehicle repossessed. After being informed of this I called back Payback Repo Inc on June **, 2015 at around 1:10pm and spoke with the same women from earlier and asked that my licence plates be submitted to the [redacted]. Again she told me that the company will not deliver the plates until after the vehicle has been removed from their lot. I provided her with my vehicle information, which she successfully identified, and I informed her that failure to deliver my licence plates would be in violation the ** State Vehicle and Traffic Law. She stated that she is aware that Payback Repo Inc was an violation of the law but would not abide by the law and will not submit my vehicle plates for several weeks. I informed her that the business will be reported for their illegal practices.Desired Settlement: I want Payback Repo Inc to comply with [redacted] Vehicle and Traffic Law and deliver my vehicle plates to the [redacted] immediately.

THAT BEING SAID I WOULD EXPECT TO HAVE [redacted]'S RECEIPT IN OUR HANDS NO LATER THAN THE END OF THIS MONTH. AT WHICH POINT I WILL THEN GO BACK INTO THE COMPLAINT RESPONSE (PENDING IT IS POSSIBLE TO DO SO) AND UPLOAD THE RECEIPT. When one hears the word "repo", it's natural instinct to have a negative impression. I'm here to tell you that it is not always the case. I live out of state ([redacted]) but my vehicle resides with my son in [redacted]. My family experienced financial struggles and loss in October and I ended up having my vehicle repossessed. How in the world would I redeem my vehicle 2,000 miles away? I called Payback Repo and spoke to [redacted]. I had so many questions and concerns. She immediately put my fears to rest and patiently assisted me in redeeming my vehicle. She was so friendly and demonstrated such compassion and understanding. My son was able to redeem the vehicle without any issues. Friendliness, care, and compassion are rare qualities that are found in "repo" companies, but Payback Repo went above and beyond to assist me and my family. Top quality service is what you will receivewirh them. [redacted], you were and are out Angel here on earth! Payback Repo is very fortunate tohave you rrepresent their company. Review: on febuary [redacted] 2015 I called payback repo to get the address of where my car was located, due to a repossession. when I got someone on the phone I was told by someone named [redacted] that they needed a credit card over the phone to give me the address of where my car was located. I refused to give a credit card over the phone because I had no idea who these people were I was then told if I didn't give a credit card they were taking my plates off the car. I was given the address after being hung up on twice by this [redacted]. she was very unprofessional when I explained to her the reason for me not giving my credit card. I was told by this [redacted] if I was gonna make her life complicated she was gonna make mine twice as complicated just because I kept on calling trying to get the address of where my car was. I get to the yard where my car is located and I'm told to drive home with no plates. so needless to say I had to drive up the block and have my car towed from centereah to lindenhurst. I went to the main office with police officers to get my plates and a paper was given to the police officer stating that the plates were turned in on the [redacted] of febuary but when I went to dmv there was no plates that were surrendered and the dmv form they handed to the police officer was just a form that they printed out of there computer which I do have in my possession.. I went to dmv they said in there system it shows that these people are known for holding on to plates. its been nothing but aggravation dealing with these people there very unprofessional and try to rip people off..dmv is investigating this matter because of the document they gave to the police officer stating my plates were surrendered. my car was paid within ten hrs of the repo the release was made the following day so there was no need to take plates off my car if the release was made.now I'm stuck with no car because I can't get plates until my plates are turned in. I have two children and I wk full time and have lost 2 days of wk due to this and have to borrow my family cars to get around all because I wouldn't give my credit card over the phone.Desired Settlement: the best outcome would be that these people loose there liscence or fined for what they have done thats the best out come for me what they did was so wrong and unprofessional. if not I would like them to pay for the tow truck I had to pay for my days lost at wk due to this and all the time and aggravation

Although, this was against my better judgment since by this point [redacted] had threatened to sue both Payback Repo & [redacted] as well as file a complaint with the Revdex.com, I agreed in hopes to put an end to the on going dispute. Once [redacted] had redeemed her vehicle (at no charge) I received yet another phone call, now demanding we give her back her license plates. It was explained to [redacted] that her plates had been returned to the Dept. of Motor Vehicle. As of 02.**.2015 [redacted]'s vehicle had now been in our possession for a total of 5 days. NY state law requires that we surrender the license plates to the NY state DMV within 24 hours of the repossession. Please note, that as explained to [redacted] " Failure to do so is a violation of vehicle and traffic law section 425, which is punishable by a fine of up to $150.00." [redacted] then shouted, "You won't get away with this!" and slammed down the phone. Approximately 2 hours later [redacted] arrived at our main office in Lynbrook NY, accompanied by two officers from the Village of Lynbrook Police Dept. The officers informed me that [redacted] had called them because we refused to give her back her license plates. At this point, it was then explained to the officers, that it was not that we refused to give them back, but that we could not because they had been returned to the DMV, as state law requires. I then provided the officer with a copy of the MV327, which is a document that is required to be given to the DMV along with the plates when surrendering. The officer than explained to [redacted] that her plates had been returned to the DMV, they then provided her with the copy of the MV327 they had been given and told her at this point she would need the DMV to obtain new plates. The officers thanescorted [redacted] off the premises and went about their day. Half hour after the officers had left [redacted] then contacted our office yet again, stating that the MV327 provided to her was not legit because it was not even stamped or signed by the DMV. [redacted] was then told that she is correct the form is not stamped nor signed, as mentioned when she was provided the form, its just a copy showing the state law. Being we are a repossession agency we return plates in bulk & they are not processed while we wait. Not only does it take a few days for the plates to be processed, but also I would not be able to provide her with the DMV plate surrender receipt for at least a week or two when they are mailed back to our office. However, if she wished to obtain the receipt sooner she could simply do so by contacting or going to the Garden City, NY DMV where the plates had been surrendered. [redacted] was not heard from again until the next day 02.**.2015 when we received notice of her complaint to the Revdex.com. Please Note: I have included a copy of the release request sent to us by [redacted] Financial stating [redacted] is responsible for the personal property fee. A copy of [redacted]'s MV327 stating NY state law requires plates to be returned to the DMV with 24 hours. As you can see we have no other complaints on the Revdex.com website and place ourselves on being one of the only repossession companies accredited with the Revdex.com. I have not been reimbursed for the towing and my time that I missed at wk those plates should have never been taken off my car it was done because I didn't wanna pay a personal property fee which I was told by [redacted] its a fee IF there is if any personal property that has to be taken out of the car which I had nothing in the car so there only option was to take off the plates which they threatened me with because I knew I didn't have to pay the fee. I made all appropriate decision and acted very professional with these people..... they hung up on me several times they picked up the phone and tried to speak in chinese.... I was specifically told they were gonna make my life difficult with these plates and thats when I got the police involved.. nothing in my case was done professionally and from what I herd from dmv they have this problem with this repo company all the time... I delt with [redacted] regarding this matter and talked to a couple of repo companies and they agreed that this was done outta of spite because they didn't get there 100 dollars that there desperate for. the car was paid in about 11 hrs of the reposseion why take my plates off and how do u tell a person to drive home with no plates wich I lived 20 min away.. we clearly should be able to c what kinda of business these people are running... very unprofessional. when I picked up the car the man who repossessed it even said there was NO personal property in my...
