vehicle was sold as is without any warranty, vehicle drove off the lot just fine and was shipped out by a transportation company acquired by the customer and aside all of that the price was already negotiated from our original asking price. if need be I will upload... paperwork. thank you Advance Auto Sales

I am writing with regards to the above entitled matter and specifically to address the allegations made against my client, *** *** dba Payless Auto SalesTo begin with, you will find enclosed herein a copy of the Federal Buyer's Guide
which indicates the vehicle was being sold "AS IS" with no warranties, which is signed by Mr***
You will also find enclosed the NMVTIS check, which indicates that there were no historical problems with this automobile
California law only requires auto dealers to advise buyers of used vehicles for defects in the vehicle that they are aware of, or should be aware of
It is clear from the information from the NMVTIS check that there was no reported damage to this vehicle prior to the buyer purchasing itMy client is not required to look into a crystal ball to determine the history of a vehicle, but certainly can rely upon the documentation that we have presented
Although my client is not liable to Mr***, my client is willing to offer $as full and final settlement of this dispute simply as a gesture of good willThis is not an admission of any type of liability and is simply offered as a means to show the buyer once again that Payless Auto Sales appreciates its customers and does the right thingIf the buyer refuses this settlement offer, then there will no further offers made

I thank you for showing me the NMVTIS check listI checked my paperwork and I do not have that paperI am going to just assume that Payless auto sales did not know their was frame damage and they were taken for a loop as wellI was really frustrated and felt like I was lied to and misleadI will accept their offer even though it is not what I requested since according to the paperwork it seems they were not at fault but rather the person who sold the car to them initiallyThank you for your time

Not having received response to date, called business -- spoke to owner Charles [redacted].Mr [redacted] says that Ms [redacted] purchased the 2000 Taurus "as is," in accordance with Minnesota Used Car Warranty Law. When she first contacted him about  a week after purchase about vehicle issues (won't...

start / 'ticking' sound from engine), she opted to purchase a new battery for the vehicle and drove to a casino, where the vehicle died again -- turned out it was actually an alternator issue.He says the car was left at / near the Casino, and he eventually had his tow truck guy go out and retrieve it -- says it is now sitting on one of his lot locations, but Payless does not have a key for it.Mr [redacted] says that he has had conversations with Ms [redacted] (and / or her boyfriend) about potentially assisting with repairs, but that they have not returned calls recently.He says he is sympathetic to Ms [redacted]'s situation, but emphasizes that the vehicle was purchased "as is," that Ms [redacted] would've signed off on 'Buyer's Guide' disclosures at the time of purchase, and that any offer the dealer makes to assist is strictly on a goodwill basis.He says that if Ms [redacted] is willing to bring the key back plus $100, Payless is still willing to assist with the alternator repair. From there, Ms [redacted] can continue to make payments. As far as returning the vehicle outright, Mr [redacted] says he might be willing to give $500 back, but not the $1300 Ms [redacted] requests.Mr [redacted] asks that Ms [redacted] call him at ###-###-#### to discuss, and to make necessary arrangements for moving forward.

Review: Since the day of purchase I have had major issues the sales person was aware and promised things would be handled. The car was scheduled to go in for repairs the first time the shop had the car sitting for week untouched going in for jerk problems, steering wheel issues and lose front grills. I continued to contact then they notified me informing me the car needed a transmission when that was replace and picked the car problems emedily started to happen ABS lights, chk engine, fluid issue message, bulb issues car drove worse reported issue dropped car back off they tell me I need a different transmission day of pickup next day all same issues all over again made third appointment dropped off again I am told same that I need a different transmission and all issue taken care of picked up car the car drove worst then ever same light going in text message screen along with new on maintenances ser. light random times the car will putter like its running out of gas at stop light it has a flutter when driving and sometime car will turn off all engine light came on the car has been in the shop every month for week since purchase car will turn off all engine light came on the car has been in the shop every month for week since purchase on 9-22-14 when I brought on the issues a few weeks later they transferred my loan to [redacted] and to this day my car remain in the same for the same issues and the car is not drivable car just turns off while drivingDesired Settlement: I would just like my car fixed everytime I leave the shop it's worst. I just want the reliable car I was promised at the date of sale.

Review: day 1 bought the car. day 2 check engine light p0420 on. repair attempt 1.. 3 days and cleaned an o2 sensor. 48 hrs ltr p0420 on.warranty up in 2 days

Around august 20th 13 I purchased a car fron payless autosales here in stockton ca. the very same night check engine light p0420 came on. catalyst system. cruise cntrl doesnt work and car smokes badly up hill. repair attempt 1= dropped the vehical off at the car lot. waited for 3 days to recieve the car back with absolutly no gas. repair order states they cleaned an o2 sensor and fixxed a vaccum leak, nither have anything to do with the emissions related code. nor will make a difference. attempt to repair 2 they re-scheduled for a much later day 09-18-13.. today 09-18-13 attempt 3. still giving me the run around. man working the lot states he has ways to purchase catalytic converters from other sources. in cal its illegal to sell or install a used catalytic converter. so I chose not to leave the vehicle with him yet again. I called [redacted] ford here in stockton. They stated there is no aftermarket part for the vehicle. the stock replacement will take 7-10 days to order and costs $2206.00 car still has warranty 2 more days but doccumented under warranty upon first attempt to repair. Desired Settlement: I am either looking for all of my money back in full. or a paid in full ASE/ASC certified repair from the FORD dealership direct oem replacement part. not their backyard mechanic who probably isn't even certified for emissions related repairs.. thank you and have a wonderful day, [redacted] , stockton ca.

Review: upon purchase of the vehicle I was given a 30 day warranty (it was further extended) to have the vehicle repaired The catalytic converter was bad and I mentioned the symptoms about a week of purchase to the dealership but the car catalytic converter was not repaired instead was thrown out of the lot called names and was left stranded on several occasions yet the car did not get repaired I rented a car for a whole week yet my own car returned without any repairs made Desired Settlement: I want a refund of all I have spent repairing the car which was supposed to have lean repaired by the dealership under the 20 day warranty

[redacted] came in to Payless Auto Sales after her 30 day warranty had expired.The dealership still went ahead and decided to fix her vehicle. The problem began when the shop communicated to [redacted] that it would take them about 5 business days to make the proper repairs at which point she went to dmv to file a complaint. Needless to say dmv has cleared us of any wrong doing.The shop also issued her a warranty for the catalytic converter.

Review: August 1st, 2013, the conditions of car made it impossible to drive, various issues with vehicle. Returned car for repair or various to be corrected car was never returned. September 16, 2013. Default contractDesired Settlement: Return Vehicle- refund

Payless Auto Sales refuses to refund deposit on a car. A deposit was required for a test drive of vehicle due to faulty steering.A week later at the time of test drive the vehicle's steering unit still not repaired and found numerous other issues with vehicle during test drive. Dealer requested full asking price of car to make all repairs and when declined to purchase vehicle told by mechanic I would never get the deposit back because the deposit was used to make repairs.Product_Or_Service: Motor VehicleOrder_Number: XXXXXXAccount_Number: Deposit RecieptDesired SettlementRequesting full refund and have contacted State Attorney Generals office about issue, they are having difficulty contacting dealer.

Dealership agreed to purchase vehicle 24 hrs after title was received. They then said they need another 30 days to get they money. The agreement to buy car back was made 5 days after the sale and car was paid for in cash. That money should never of been spent by the dealer. Now they say business has been bad and they need more time. We had agreed to settle this matter but we just needed some more time to come up with some funds for him. The month of December is always a slow month. Anyhow, this matter was resolved on the 10th of December. [redacted] was refunded the funds and the vehicle was returned.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I never threated the dealership. I did demand to have my money. I was threated by their employee [redacted] The owner of Payless Auto [redacted] stood their and watched his employee and did nothing to correct the situation. Mr. [redacted] has had his license revoked in two towns, Bellingham and Douglas and pulled out of Attleboro after having many upset customers. Mr. [redacted] obviously could care less about the people he tries to [redacted] over. Do not buy a car there!!!
