Plantation Shutters and Window Fashions

I am writing this letter in regards to the contract we signed on February 2, 2013. The original contract (copy is attached to letter) was to make and install 19 Real Wood Plantation Shutters for $6,259.00. We had a verbal agreement that you would have the shutters installed no later than March 15, 2013. We also paid you a check (check #[redacted]; copy of check attached) deposit of $3,000.00.

During the week of March 3, 2013, I left you a message regarding my trim paint color, you called and left a message stating that the shutters will be ready to install on our verbally agreed date of March 13, 2013. I placed numerous phone calls, including leaving several voicemails, during the week of March 10, 2013 for an exact time and date for the installation. Upon not receiving any call back from you, I contacted the police department. Only after that did you finally return my call on March 14, 2013 stating that you were sick and hospitalized. I requested that you call me on the next day to resolve the situation; however, you failed to call me back. On March 19, 2013 at 3:17pm, I requested that you give me a full refund. You stated that you need a few days to finish a few jobs and will call me back on Friday around 3pm to tell me that check has been mailed. On March 22, 2013 at 3:05pm, you called and stated that you are not obligated to refund me my deposit per our contract. Since then, I have made several attempts to reach out to you to resolve this situation, but again, you have failed to return my calls. To date, you have not made any attempt to resolve and/or satisfy our contract. It has been 13 days since our verbally agreed date for installation.Desired Settlement: Give me a full refund of my deposit in a form of money order, cerified check, or cashier check. No personal or buisness checks.
