Our house was built by Baker Residential of Pennsylvania (PA DCA number 32837) of Builder Identification Number 001713B and Builder’s Limited Warranty Number is The warranty company is: Professional Warranty Service Corporation, P.O.Box 800, Annandale, VA **SSN [redacted] PWC Claim No0222991-The house was built in a way that all the surface runoff and groundwater backflow to the front entrance and there is no place for the water to drain toSince the water pours into this area but has no place to flow away, there is a big pressure exerting on the surrounding basement concrete wallsIn the basement, the basement concrete wall has a corner chopped off underneath the front entrance and all the water simply pours into our basement from this damaged corner whenever there are rainsThe water soaks the living room carpet and there are molds growing along the wooden beams and underneath the carpet constantlyWe have filed claims about the house structural problems with the warranty company in June, 2015, PWC Claim No0222991-The builder refused to do any repairThe warranty company told us that the next step was to file arbitration, but rejected any arbitrator chosen by usThe warranty company appointed DeMars & Associates for the arbitrationHowever, we will only accept the arbitration result if the arbitrator did not receive any kickbacks from the builder, or any type of payment that is beyond our knowledgeThis house structural warranty is not a protection of customers who have drained their lifelong savings for purchasing the houseThis warranty is a protection of the builder and the warranty document takes away our right to file any lawsuit against the builderThe business model of this warranty company is complained by many homeowners in our neighborhood

*** ***, Thank you for your time on the telephone today Professional Warranty Service Corporation (PWSC) administers different types of Builder Warranties Some of the warranties are insured by an insurer and some of the builder warranties are basically self-insured
All of them offer the arbitration process to resolve issues related to the warranty The Home Builder’s Limited Warranty which is the warranty *** Homes elected to have PWSC send to **and *** *** is not an insured warranty While this homeowner sent you a copy of the Limited Warranty Validation Form, they apparently did not send you a copy of the Home Builder’s Limited Warranty, I have attached a copy Please take a look at the Validation Form that the homeowner sent to you, it identifies PWSC only as the ‘Administrator’ Please take a look at the attached warranty document, page where PWC is identified only as the administrator of the limited warranty provided by the builder I have also attached a copy of the ‘Registration Form’ executed by **and *** *** on 6/23/suggesting they have reviewed and understand the Home Builder’s Limited Warranty. **and *** *** submitted their request for warranty service (also attached) via the PWSC web site on November 9th Once reviewed and confirmed the type of warranty document issued, I verified the builder was out of business We took another step on behalf of **and *** *** and found that *** Insurance Company was the General Liability Insurer at the time they purchased their home PWSC never denied coverage, PWSC identified the builder’s insurer and filed a claim on behalf of this homeowner Please see my letter dated November 11, to **and *** *** letting them know what we had done for them A claim was opened (Claim Number ***-***) by the insurer PWSC nor I would make any determination of coverage but please note that I did move forward in an attempt to assist the above homeowner and I do suspect they have heard directly from the builder’s insurer The homeowner’s request was received on Monday, November 9th and our response was mailed on November 11th Our response included contact information for the builder’s insurer I hope you would agree that our turn-around time of less than hours was responsive to the request and that as the program administrator, we were as responsive as we could be based on this builder’s Home Builder’s Limited Warranty Please review this e-mail and the attachments and contact me with any questions. I am rejecting this response because:
When we bought the home, builder told me to go to PWSC if any issue arises.  I never read any fine prints on limited warranty. I didn't know what games builders play like this. I just want by the page which put PWSC name and told us to go to PWSC when any issue arises.

Did not help with issues which the builder refused to fix even though the problems occurred within the warranty period and had been properly identified to builder in writing, but builder ignored. Generated lots of paperwork to explain the issues to them but all they did was pass us along to an arbitration company which we found to be unprofessional and in cahoots with the builder, which this company likely is as well.
To us the whole loop is just one big fraud. Don't waste your time or money, there is no justice to be found here, and no help.

Please take another look at my detailed response to you dated December 7, 2015. I sent you a copy of the warranty document applicable to the [redacted] home, I included a copy of the Home Builder's Limited Warranty Registration Form executed by **. and [redacted] dated 6/23/2008 and in my narrative, I explained the role as Program Administrator for Professional Warranty Service Corporation as it relates to the [redacted] Homes Home Builder's Limited Warranty. The Limited Warranty Validation Form that **. [redacted] shared with you also states that Professional Warranty Service Corporation is the program Administrator. On this homeowner's behalf, I researched our files and identified the General Liability Insurance Carrier for [redacted] Homes at the time **. and [redacted] closed escrow on their home. I sent their claim for construction defects to [redacted] Insurance Company, an affiliate of [redacted] NA. And the Insurer has sent **. and [redacted] an explanation of their coverage determination. Professional Warranty Service Corporation does not make the coverage determination and is not an insurer. I have assisted **. and [redacted] as the administrator. If this builder was a viable entity, I would assist them with the available mediation and / or arbitration process. The builder is no longer in business and this is why I assisted them in locating the builder's insurer. I have attached a copy of the letter I received from the builder's insurer which states the insurer's coverage determination. Prior to your response to **. and [redacted], I request you take another look at my initial response to you including the warranty document and the registration form executed by **. and [redacted]. I do hope you will agree that I have assisted this homeowner in the exact manner stated in the warranty document. If not, please feel free to contact me again.
