To whom it may concern, [redacted] says she feels the maintenance/facility fee should be refunded to her because she feels the facility was not well maintained to begin with. I did speak to *** at the beginning of this year about my complaints about the lack of instructors showing up for classes. It was more than the three times she is mentioning. The class that did not have the sound system did go on without it--but I left, the class was useless with the soundThe instructor couldn't even remember the steps without the music--it was a waste of time. No one got back to me when I said the women's locker room needed attention. The pool is the same size as when I joined. However, when I joined--the person signing me up didn't tell me that there would be other "private" classes going on the same time as the one larger class that I was coming in for. I certainly would not have joined Innovative Fitness if I knew that was going to be happening. It seemed to be happening more and more--these "private" classes while the scheduled class was going on. The pool is too small to have both going on at the same time. It even seems to be dangerous. The last "private" PT session has little children in it. They could have been hurt! What sense does that make? My maintenance fee should be refunded as I don't think the place was maintained very well to begin with! Clearly, you can see this with my complaints

For your reference, details of the offer I reviewed appear below.I did issue a complaint about the sound system and the lack of cleanliness of the Women's Locker Room to the person on the other side of the Reception Desk. He just shrugged, and said he was sorry. I did tell *** in my earlier complaint about the number of times an instructor was not available, and she said she was sorry about that matter. I lost at least visits to the Aqua classes because to the reasons I have listed aboveThe least Innovative could do would be to give me the $maintenance fee for the inconvenience of getting dressed and undressed (and in the pool and ready for a class that did not commence.) The warmer therapy pool is very small--I also told *** in our last conversation that I felt it was in poor taste to let persons not in the Aqua classes use the pool at the same time as the classes were going. The Physical Therapist had several children doing exercises while the class was going on. This is definitely a safety issue for the kids as the adults in the class were making waves and practically running into the kids. These were special needs children---not very smart for the club--nor the PT instructor to be doing this. Because of all this hassle that I have had to put up with, I think the least Innovative could do would be to refund my $for the maintenance fees for a club I will not use at all in 2015. Why pay the fee when I will not be using the facilities? I told *** it is very poor customer service to not refund the fees. Especially since I had so many problems with the club to begin with.

We were very sorry to hear that she had a problem with her swim suit while at our facility.  This person is not a member, she came on a free pass from physical therapy.  She felt her suit was "eaten" by our chemicals in the pool.  However our pools are all computerized with a special...

unit that adds or takes our chemical depending on how many people are using the pool at any given point.  We also incorporate a second cleaning system that runs the water thru ozone tubes to kill bacteria along with the chlorine. This ensures that our pools are always very clean.  Ozone is not a chemical and does not effect eyes and swim suits.  We verified thru our computer records that chlorine levels on our pools during the times she was in them was well within norms.  We had no other complaints of damage to any one elses swim suit that day or since.  We are inspected each month by the city inspector to verify our computer records and to verify water quality.  Her suit had multiple tears not areas eaten away as described.  It feels like she may be trying to force us to give her free membership beyond the 30 days she has already received by making this complaint.  She has asked us to replace the swim suit and to give a free or discounted membership for her perceived problem.  But since we have over 2500 swimmers in our pool every week and no one else has this problem, and we do not know how old her suit is and we do not know what other things she may or may not have done to this swim suit before coming to us and the fact that she in not a member led us to decide not to pay for her suit or give her a free membership.

As we mentioned before we have computers to monitor chemical levels in the pool every 7 seconds.  Our records indicate that all chemicals were and are at safe and normal levels.  The city of Franklin has inspected our pools and they have also found the chemical levels safe and normal.  We have had no other complaints of suits or skin irritations and as we felt at the time the pictures indicates ripping of the material not a chemical burning or melting of the material.    A report of skin irritation was not recorded from the initial complaint and has not been confirmed by pictures or a doctors visit.  If a chemical can eat away a swim suit it would surely burn a persons skin very severely and this did not occur.  We stand by our belief that our pools were and are clean, properly disinfected, with proper chemical levels and within all state and local regulations as per our state and local inspections.  It is unfortunate that this person swim suit fell apart but we feel confident that it was not caused by her one time use of our pools.

My swimsuit was destroyed DAY 1 of a 3 day pass that I fully intended to join a year paid in full ahead. It is unfortunate that [redacted] had to lie and resort to defamation of my character to get out of his responsibility of keeping a SAFE hot tub. As you can see my swimsuit was NOT faded before or after the incident of being in the Hot tub the FIRST DAY I ever have been in the club. As you can see the original size of my swimsuit was the same size as the blue suit over it in one of the pictures- however, immediately coming out of the pool my 6 month old swim suit was stretched down to my knees- with acid holes and HUGE baseball size holes eaten by the over chemical present in the hot tub. I certainly did not enter the club with a swim suit around my knees - nor was it damaged in the club dryer. The stretching and holes were found IMMEDIATELY after I left the  hot tub that I was in for 20 minutes. My skin was red with slight burning and I had problems breathing. I did not have chemical burns on my skin - thankfully. I also never requested a "FREE Membership" never used a 30 day pass - as I this incident happened the FIRST DAY OF A 3 day pass (FRIDAY) - and like I said I had every intention of Joining- however, they refused to correct the problem or "own" that the pool was NOT properly maintained. If they would of waived the $49 yearly Maintenance fee (as the pool obviously was NOT maintained) - and maybe grant me one or two $24.95 a month - AND FIXED The problem - they would have had a happy client. plus hundreds of dollars for a membership paid a year in advance. However, that did not happen. The pool had a problem on a FRIDAY- where I turned in my suit for the club to inspect the first day- Monday when I returned the hot tub appeared to be fixed - however, Maria wasn't there to address my suit issue and when I came back Tuesday Maria wouldn't take responsibility for my Acid eaten suit - and the hot tub again had over chemicals so I found a different place to join.I'm so sorry that Innovative Health Fitness Center can't correct the chemical problem in the pool and expose other clients to burnt suits , skin and lungs.

Bottom line is that the Innovative Health & Fitness contract states "Innovative Health & Fitness reserves the right to deny or revoke any membership without refund". Please see the attached copy of Stefan's signed contract again which states that. Therefore, no refund will be provided.

To whom it may concern,[redacted] signed a contact and initialed an I Understand form stating that she agrees to pay the annual facility fee every year (see attached). This fee is charged on a specific date each year (per the contract) and is not pro-rated or returned once charged as it is used...

to help improve the facility and add/upgrade equipment on a monthly basis. In addition, [redacted] signed a contract stating she understood that she would need to provide a 14-day notice in writing to ensure time to process a medical freeze request (see attached). Therefore, we already made an exception for her when she came to us in December 2014 asking for four months of membership back because of medical issues from August 2014 to November 2014. Per our contract and policy, we do not back date medical freezes but made the exception for [redacted] to help her out and refunded two months of membership fees. Finally, [redacted] never brought up any of her concerns at the time to help resolve them or give the club a chance to explain. For these reasons, we do not feel a refund of [redacted]'s facility fee is justified.Sincerely,[redacted]General Manager, Innovative Health & Fitness
