June 30, 2015In the first place my name is *** ** *** *** not ***That is the road I live onThe contract was signed on April 27th in the afternoon and plainly in legible letters spells my nameWe started the project May 4thThe day before the sellers signed a contract to be
done on the 5th of MayThat contract was with the buyerHowever, our contract did not have a completion dateI also did not agree to do the project and get paid at close of saleUnless the homeowner could pay part of the project and I could come up with the rest.Late in the second week of April I spoke with the homeowner and they could not come up with the down. I never said that I would finance the job as the seller saidI was trying to work with the customer to accomplish the same goal We started the project and found there was a second layer of roofing to be tore off which was a surprise at a cost of $to me and came out of my pocket. I did not say anything to anyone because I signed the contract and and considered it my work and my faultThen we found rotten plywood sheeting over most of the first half the roofThats when I turned in a change order for $for the extra work and materials to re-sheet the roof. At that time I did not in any way say to anyone, anywhere that the roof was doneThere was not any roofing material on the job site at that timeWe proceeded to work on the project and yes there was a few leaks with the heavy spring rains and the roof being opened up and temporarily covered with tarps.At this point we had half the roof on and I turned in the second and final change order for sheeting replacement for another $At this point I was putting all the money I made from other jobs in the projectI explained this to the new owner and he understood what was going on. It did take a while to come up with the money and complete the jobIt was completed in the first week of June. I communicated with the new buyer on a regular basisI did not go out of my way to address the project with the seller because he was never there; even when he made appointments to meet me thereI was working on other jobs to get the money to finish hisHe wasted my time and didn't even call me to let me know he would not be able to make itWe are a small company and we take the time to make things right at all costIf it wasn't for me talking to the new owner he would of sued the sellerEvery single customer is told by me personally that I'm available -for any reason whatsoeverI always stand behind my word and behind my work. It does bother me that I was not able to comunicate with the seller better than I did but he was very distant and confusing to me and I apologize for thatI'm proud of the job we didThe new owner got a $20,roof for only 10,000.00; I would say that's good equityThis roof is just short of squares; when I said the project could b done in 5-days that was with perfect conditions with just the shake roof to be torn off and install a new oneso much for wishful thinkingalso I walked off the roof without measuring it; which was a mistake on my partI was off by over twenty squaresI did that because I was only going to wash and treat it at firstThis evening (June 30, 2015) I spoke to the new buyer and he had an inspector come inspect the attic for any damage from the leaks today. I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
In response to Mr. [redacted]’ statement:First,
the contract was signed on April 27 2015 -at the same time the closing
sale
for the property was completed and signed.  A check with the full amount
of $6,516.34
was issued to Mr. [redacted]. This amount was the original estimate
for the
completed roof to be completed. Our real estate agent, [redacted],
was the
person who called Mr. [redacted] to confirm that the completion of roof
for [redacted] would be no later than
May 10 2015. This arrangement was made as a condition of the sale; In
order for us to close the buyers deal it was required to confirm
that the roof was to be completed on time. By phone, Mr. [redacted] agreed
to Mrs. [redacted] to finish the roof by May 10 2015. This conversation and
witness
is documented with the Berkshire Hathaway Home Services. Again, at that
time the full amount was given to Mr. [redacted] to start and finish the
roof. During the first
2-3 days his crew worked very hard on getting the roof done, I was
checking
progress every day. During the time I noted that Mr. [redacted] was never
there unless I
called him to get and update on the roof or make appointment to meet him
job
location.  As the job progressed, I was not able to meet with him
for a week due to my job hours but he assured my by phone that they would finish on time.  On May 4th my wife received a text
from Mr. [redacted] telling her that the roof was almost done but there were extra
charges for wood damage he needed to replace. Mr. [redacted] asked for $ 2012.52
extra. My wife and I agree to pay that extra charges to make sure that there
was no delay and because we were committed to the new home owners having a quality roof. When my wife gave Mr. [redacted]  the check, Mr. [redacted] assured my wife that
the roof was almost done, that they were close to finish and they just needed
to do some clean up but for sure they will be done by Saturday May 9th
or  Monday May 11th.
On Sunday May 10th I
received a call from the new owners ([redacted]) of the property where the roof supposed
to be installed. I was told by [redacted] that it was raining hard and that water was
getting in inside the house. I drove to the job location to assess the
situation, to my disbelief I find out that no work was done for a week and to
add to bad situation the part of the roof was taken out and left unprotected
from rain. The new owners ([redacted]) are willing to give and statement with
pictures if needed.
After I spoke with Mr. [redacted] on
Monday 11th 2015, he told me that they had not worked on the
roof
because of the holiday (Mother’s Day) and he said also that he needed
more money to finish the Job. I had been advised by the new owner that
they may
have to sue me if the roof was not done soon.  Again we felt like we had
no choice, and paid [redacted] an additional $2000 with the assurance that
he would finish promptly, with the hope that the rain damage had not
been too extensive.  After I made the last payment of $2000 on May
13 2015, Mr. [redacted] assured me that the roof was going to be done that weekend
and that he personally was going to be there to make sure it happened. On May 18th
I spoke with [redacted] (new owners) and I was told that nobody had worked on the roof
that week; when I confronted Mr. [redacted] he told me that he was sick and that he
was going to do the best to finish as soon as possible. I kept good communication
with [redacted] (new Owners) who said that occasionally some kids had come over to work on
the roof for 2 or 3 hours and leave. I tried to meet with Mr. [redacted] several
times in the afternoons after I got off work (4:00 pm) but he always canceled or did not show- with the excuse of already
being done for the day, sick or too hot to  work, etc. 
 [redacted] and his wife (new home owners) are witnesses of these meeting
times when I arrived to meet and Mr. [redacted] would fail to show.
After the heavy rains on the incomplete roof, I had agree with the new owners to help
cover labor and cost to repair damage. We discussed including cleaning,
painting and of course buying paint. Mr. [redacted] offered to do some repairs, but
the new owners simple didn’t want him or his employees on the premises for any reason other than completing the roof.

statements from witnesses.

Review: I contracted [redacted] to replace the roof on a home I was selling in April. He had agreed to do the job, removal, and installation of new roof for 6300.00 Originally he agreed to replace roof and receive payment through title company pay-out at the closing of the sale (scheduled for near end of April.) When that did not happen, the seller agreed to close the sale, and we finalized the sale before replacing the roof with permission of the buyer.Twice he came back and asked for 2000.00 more. We were so anxious to get the roof complete that we paid both amounts. The third payment (second additional payment of 2000.00) he indicated that the job was complete. I had met him in town and paid him, and we discussed contacting him in the future to possibly do small jobs around our house. It was clearly communicated that we were done, job was complete; my error was not meeting him out at the job site.More than ten days later we heard back from the new homeowner because he was wondering why he had not seen anyone working on the roof. During this time there were a number of very hard rains that leaked through tarps that [redacted]'s employees had left over portions of the roof that were unfinished. We have committed to the new homeowner to repair any damage and are waiting until the roof is complete to order an inspection.Since then, [redacted] has stretched the job out week after week. Each week he promises that it is almost done and another week passes. For the last two weeks he has promised that he is almost done. This is a job that originally he estimated would take 5-7 work days start to finish. We are very unhappy with him. I feel like he would have kept asking for money if I had not theatened to sue him. And still, we have not placed the roof that was promised in the sale of the home.The house is at [redacted].Desired Settlement: We would like him held accountable so that other potential customers do not find themselves in our shoes. He was dishonest in his estimate and billing. He has not completed job. At this point, at the very least I want him to pay for the inspection of damage and pay for repairs to home caused by the leaking rain over 6 days that it was left wet.[redacted] is his name.
