Review: I hired Quantum Dynamics to design my web site and send my monthly newsletters for my business via email. My customers sign up for my monthly newsletters. I provide Quantum Dymanics with the material for my newsletters and they format the information for me. My customers signed up for my newsletters either in my store or on my web site. Quantum Dynamics matained my customers email list which is well over 2600 which i've collected for 20 years of being in business. When the newsletter was complete they send out the newsletter via email.I ran into some tough times and filed for bankruptcy. I could not pay them so they will not give me my customer email list.I own the list not Quantum Dynamics. [redacted] with my permission sent out short "email blasts" via Quantum Dynamics using my customers email list with my permission.They wanted to meet with me and the owner of the new company [redacted] who will be my employer. They want to work something out with the owner of [redacted] and have him pay for my unpaid balance to Quantum Dynamics.Desired Settlement: Turn over my customers email list in a cd or format it so it can be sent via email in a way it can be transfered into [redacted] or a simple data base.

Quantum Dynamix original began work with [redacted] and **. [redacted]'s [redacted] and [redacted] in October of 2009 to develop a website, logo, and email marketing campaign, Quantum Dynamix has maintained a positive relationship. with this client for several, years, always/working to meet his marketing and financial needs.

On November 1, 2013, Quantum Dynamix was notified by **. [redacted]'s [redacted] and [redacted] that **: [redacted]'s was going out of business at the end of 2013. It was at this meeting that the transfer of assets was discussed in detail. The original agreement was that **. [redacted]'s was going to transfer several assets to [redacted] and [redacted]'s [redacted] and [redacted]. These assets included the email, mailing list as well as various other digital marketing assets, it was also proposed by [redacted] at this meeting that the. past-due amount would he settled in small installments by [redacted].

After this meeting, Quantum Dynamix began to send email marketing out on behalf of both **. [redacted]'s [redacted] and [redacted] and [redacted]'s [redacted] and [redacted] using the existing **. [redacted]', email mailing list. These emails.were designed to transfer customers over to the new business and have customers opt-out of receiving [redacted]'s [redacted] and [redacted] emails, if they so choose.

On December 13, 2013, **. [redacted]'s requested the transfer of this email mailing list to [redacted]. The original position that Quantum Dynamix held was that with **. [redacted]’s -several month behind on his existing payments. Quantum Dynamix did. not want to engage in more billable work to collect and transfer these, assets without an agreement on how **. [redacted]'s was going to settle the existing outstanding balance and pay for the collection and transfer these assets.

Throughout this, process, Quantum Dynamix has never claimed that they have owned the **. [redacted]'s assets, specifically the email mailing list. Quantum. Dynamix simply did not want to-engage in more billable work without a guarantee that the prior balance would be settled and any future invoices would he paid in full.

On January 13, 2014, seeing: no reason to continue to be harassed by [redacted] or **: [redacted]'s, Quantum Dynamix supplied [redacted], via his attorney, all assets related to **. [redacted]'s [redacted] and [redacted]. These assets were provided on a disk, sent via USPS Certified Mail, and contained all website related assets, the **. [redacted]'s [redacted], and the email mailing list (as a component of the existing website files). This satisfies the desired outcome sought by [redacted] in this Revdex.com request and should resolve this complaint in full.
