May 4, 2015Gentlemen/Mesdames:I have been retained by Realty Brokerage Solutions LLC of Falls Church, Virginia to respond to the above-referenced complaint wherein a purchaser seeks compensation from our client for misrepresentation of the number of parking spaces assigned to the... townhouse he purchased in May, 2014.After having discussed this matter with my client and after having reviewed the pertinent documentation surrounding the transaction affecting the subject of the complaint, I have the following comments:1. The information regarding parking space availability was provided by the Seller of the property and was based on the most reliable information available to the broker at the time of the listing. 2. The number of parking spaces (2) assigned to the townhouse unit was further represented and restated by the Seller in the Sales Contract between the Seller and Purchaser dated March 28, 2014. 3. The Homeowner's documents were provided to the Purchaser well before closing and if there were any information regarding parking in the complex which varied from that represented by the Seller, or dissatisfied the Seller, the information would or should have been available in those Homeowner documents. Purchaser could have canceled the contract within the requisite period of time prior to closing if he desired, without any penalty or forfeiture. 4. My client informs that the Buyer's agent indicated that his client(s) knew of the possibility of only one (1) assigned parking space and that it was not going to create a problem. 5. An entire year has gone by before the Purchaser has lodged any complaint whatsoever or even mentioned it to my client.If the Purchaser feels he has a valid complaint at this time, his efforts might be better served in pursuing his complaint against the party with whom he legally contracted (the Seller of the property who represented the parking space availability), the title company who insured his title (if in fact the assigned parking is related to the title he received), or against his own agent for not doing his due diligence. His complaint against the Seller’s realtor, our client, is misguided without merit.Further, he has waited an inordinate amount of time to complain, if indeed he has a legitimate complaint, and that fact alone could legally bar him from any recourse whatsoever against anyone.Sincerely, Gary W
