Complaint: [redacted] I am rejecting this response because:what this agent is trying to point out is that, not only did I give her this listing to look at since I found it not her, but that nothing she sent relates to the issue of not having the title ready for transfer at the close of sale. it was her responsibility to make sure that the sellers agent had EVERYTHING finished and ready for the close. Yes I did give her a great rating on Yelp, but that was before we ran into the problem of their unprofessionalism, ineptness and poor attitude when you ask them to do what they are supposed to do! They either do not reply to emails, phone messages,text messages or respond irrationally. for these reasons, they have pending reviews by the MT Department of Labor/Realty Regulations, the Attorney Generals office and the Mt Motor Vehicle Division of the DOJ. what we need is the title that legally should have been giving to us in November, not stories how great they think they are! Please accept this letter as my response to the complaint filed by the disgruntled clientThere are so many issues I had with this client, but for the sake of representing him to the best of my ability, Iput aside any differences Imay have had with him and did just that, represented him to the best
of my abilityWith my help, the client acquired a tremendous property for a below market price and upon my recollection of our last meeting,he was very happy with his purchaseSo, with that in mind, Ioffer the following narrative
I spent days with the client and his wife, showing them numerous properties throughout Southwest MontanaAfter deliberating,they decided on a property at Georgetown Lake and due to the amount of time this house had been on the market, they decided to put in a lowba llofferThe house was listed for
$375,000, but due to my representat ion and negotiating,an offer of $335,was f inally agreed uponThis price not only included the house but over percent of the personal property within the house and the ATV
The client was very demanding during this saleDue to the fact he resides in Southern California, he demanded numerous times that Idrive to the house and take videos of certain issues he felt might be a problemThese issues really only existed in the client's mind but the distance involved prevented him from checking on the property himselfIpersonally made five different trips to Georgetown to document "issues" for the clientWe regularly monitor properties for clients that cannot be here to do it themselves, so Iwas happy to accommodate these requestsOn no occasion did Ifind any issues with the property and each time notified him as such
The closing of the sale itself hit a few snags but all delays were due to the client's financial institution, never was a delay caused by the seller, *** ***, the seller's agent,or myselfDuring this time the client constantly degraded the seller, whom he had never met and mentioned how inept Mr*** was, putting me in a very uncomfortab le situationIdo believe Mr***, the listing agent, was, and continues to be an excellent realtor and an even better human being
After closing, the client called me in a panic because he didn't know how to work anything at the houseMy husband, who is not a realtor,made three different trips to Georgetown, over minutes each way, to assist and try to teach the client how things workedAlso, I paid over $to have electrical issues repaired to the client's satisfaction.
Mr*** had used a very nice exterior picture of the house in the listing hot sheet as it was framed and hanging in his officeThis client demanded that the picture of the house be given to himRather than continually fight the uphill battle with him,the listing agent gave it to him....freeAfter receiving the picture the buyer continued to have negative things to say about Mr***, all which had no merit
Now there is the issue of the ATV titleThe seller of the house is an elderly woman from ColoradoMr*** tried to get it from her but when she finally did send it, it was done incorrectly The process of having her get a new application began but was delayed because she does not use a computer The entire time this client kept threatening me and Mr***Bear in mind the ATV was in the possession of the client, at his Montana home and he was using it!
Attached are over pages of emails and pages of text message conversations I had with the clientIbelieve this record of correspondence shows I not only performed my job well, I went above and beyondAs a matter of fact,this client originally gave me a star review on Yelp and after Iwould not side with him during his derogatory assault of Mr*** character, the client has since changed it to a 1star, which is more a reflection of his character than of my professionalism
Attached also is an email from Mr***, who has taken the new application for title of the ATV to the courthouse and requested a new titleUnfortunately,this will take another to weeks according to himSome transactions such as this, take time that is out of our control as consumersThis client has accused me of breach of contract; however,I represented his best interest at all timesIt is not a legal requirement for realtors to make sure personal property items are transferredBoth Mr*** and Iwere just trying to help

To whom it may concern:       I'm not sure what other information I can provide as the complainant "rejects" my two packets of information showing I provided extraordinary customer service. Iunderstand his frustration with not receiving the title to the ATV but my hands are tied because Ihave no access to the seller as Iwas not the seller's agent nor do Ihave any authority to make the State of Montana issue it any quicker. I have assured him that he will receive it as soon as the state reissues it, but there is nothing I can do. He has the ATV in his possession. Ihave repeatedly said that personal property has no business in a real estate transaction because of these problems. The lawyer representing the Montana Association of Realtors takes the position that it is not a realtor's responsibility to make sure personal property titles are transferred. Therefore, as soon as the seller receives the title from the state, the buyer will receive it directly from her. Please let me know if you have any questions. Thank you.
