Thank you for bringing this to our attentionThe vehicle stated in the complaint was brought back originally for an oil leak two months after the vehicle was purchasedThe vehicle in question had 105,miles on it when purchased, which according to NYS Law there is no warranty on the vehicle
The vehicle now has 109,miles on it, the customer drove the vehicle over 4,miles in the time since purchaseThe customer stated there was a second oil leak, which we said we would take care of, and did, even though we arent obligated to

In regards to the complaint filed against us involving the Mini CooperVehicle was sold in good faith with a signed contract, and with a voluntary deposit left by the customer.When the customer purchased the vehicle I told them I would try for Friday or Monday, but that I could not promise a exact
delivery date as under New York state law all emissions monitors have to be setin order to get the vehicle inspected When she called on Friday , I told her this and she stated she want't her deposit back I explained that is not how it works we sold you the care in good faith Theyled me to believe that they had had some major family problem, told one of the other workers that she wrecked her other car, and could not purchase the vehicle,several excused to try and get out of a legitimate purchasePrepping the vehicle for inspection, we repaired the exhaust system and replaced wheel cylindersWe then needed to drive the vehicle to try and set the monitors for inspection and as of today that process is still going on. Vehicles can not be delivered to customers until we meet the state requirement of setting the monitors so the vehicle can properly pass inspectionAll of this was explained before deposit was even received

I guess at this point she should continue with her complete fabrication of this transaction.We did not and never do give a guaranteed delivery date as we have to meet the state requirements. I never told her that it would positively be ready by Monday.  Everyone involved in this matteris forgetting that we have to follow state guideline. Thats is the way it is. Since she continues to slander our reputation,this will be our last response to any more slander.  She has even accused us of being sexes.  she was told quote we would do our best to get it readybut due to the STATE REQUIRED MONITOR GUIDELINES, we cannot and did not guarantee a specif date. We try to do the bestwe can to deliver the car as fast as possible and all of this was explained. We are in the business of selling cars, we are not in thebusiness of jerking people around, as again for the last time WE MUST FOLLOW THE STATE GUIDELINES.

I spoke with Dave (salesman) on Thursday he stated the vehicle is having trouble passing inspection.  I called Dave on Friday a date we agreed on to inform him I had transferred my insurance to new vehicle. During our conversation he stated the vehicle would most possibly not be ready Monday. I then responded I wanted a refund and didn't see this working out. As for my car it was not wrecked and has nothing to do with this transaction.  I called this morning Monday 04/17/2017 at 10:52 A.M and the car is still not ready and has NOT passed inspection.  I asked for a full refund and the manager stated “I would get any money back because they used the money to get the car repaired”. At this time they claim to have spent over $1100 and the car is still not passing Inspection. The Cargurus classified ad where I originally viewed vehicle did NOT MENTION that the car needed repairs. The Manager justified his non-refund stating “we took the car off the market which entitles us to keep your deposit”. I stated that was a lie because the car was NEVER REMOVED from Cargurus and as of today April 17th the post is still online and listed for sale. The business is being dishonest in order to keep the deposit and did not spend $1179 on repairs for the vehicle; nor did they ever inform me thats what my money was being used for.  I would have never left a deposit if I knew the business was strapped for cash. The business is misleading and dishonest about the cars they advertise.Thank you,[redacted]

Vehicle was ready for customer when customer arrived. Wife didnt like the vehicle, so he backed out. We had put over $1000 into the vehicle to make it ready for NYS inspection. Customer signed a contract and backed out.
