Revdex.com: I have reviewed the response made by the business in reference to complaint ID 10753169, and find that this resolution is satisfactory to me I am acknowledging that the business has allowed me move out on August 31, I do not wish to continue the complaint any furtherI am also acknowledging that I will be held liable for any damage that may possibly be found in the apartment, even though I have cleaned it thoroughly and taken pictures of the day we completed the move out processMy only known damage in this case is a small spot in the carpet Sincerely, [redacted]

Complaint:
I am rejecting this response because:I do not find this
to be a minor issueI’d like to begin by saying, that yes I did speak on the
phone with Mrs*** in April about the situationShe made it sound like it
wasn’t that big of a deal and her response to me on the issue was “To get her
step dad’s cell phone number and try to talk to him about it.” I informed her I
am a pretty civil person and will usually handle any issues myself before I
complainThere had already been many instances in which I had tried to
confront the neighbors and inform them of my complaints before contacting Mrs
***The parents, however, told me to approach their daughter myselfThis is
when I decided it was time to contact managementUpon contacting her, I received
the response aboveI had also called the police multiple times, and the
problem continuedI do not doubt that she made the attempt to talk to the
neighbors about the situation, however, nothing has changedAlso, when talking
to Mrs*** in April, she said to me that many other residents have complained
about the girls driving around the apartment complex and had complained of her
driving on the sidewalksTherefore, I do not feel I am the only neighbor with
these issuesI also have proof that the problem continued after our
conversation in AprilI have lived here for over two and a half years and had
no problems until the downstairs neighbors moved inDuring this time I had
made complaints to the office about the noise as well as their parkingAfter
my final contact with Mrs*** in April, I decided my only option was to move
because the problems continued
In her reply back,
Mrs*** said that in the notice I left informing her that I was moving out was
because I have purchased a houseThis is a lieThe letter said I was moving
out because of ongoing circumstancesShe then told us that I would be required
to pay out the rest of the leaseWhen I asked her what my options her, she
said the paperwork is “black and white” and there is nothing she can doThis
is when I decided to contact free legal for advice on what to do in my
situation and what my options wereI contacted Mrs*** and asked for all the
paperwork she had on my apartmentThis is when I received the original lease from
along with the 2015-renewalI immediately noticed that the apartment
had not been transferred into my name and the lease renewal had not been signed
by the lease holderAfter bringing the paperwork to the free legal agent I had
been speaking with, she informed I did not have a valid leaseThe agent then
contacted Mrs*** to inform her that there was not a lease on my apartment because
she had failed to transfer it into my name and the renewal was not signed by the
lease holderMrs*** then said that she had made a verbal agreement with my
mom and thought that was sufficient and “did not feel she needed her to sign.”
The agent then pointed out that the contract says in bold letters that there
will be no verbal agreements but that everything must be in writingThis is
the point where the free legal agent was just acting as a mediator to confront
her of the documentationAfter the agent spoke with Mrs***, I was contacted
once more and she informed me that she was willing to make some changes to any
paperwork she had to find a solutionShe had already informed me at this point
that she could not make changes
Mrs*** said she
was frustrated with the situation and accepted that the paperwork had not been
done right, and told me she should not have done it that wayThe free legal
agent also informed me and Mrs*** that this situation also holds potential
security issues if not properly handledOn August 15th we began
moving our things out of the apartmentIn the process our neighbors were home
and outsideThey kept staring and intentionally standing in our way as we
moved our thingsThey then made some verbal remarks towards us that led me to
believe that Mrs*** had called and informed our neighbors of the situation
One of which was a remark from their daughter that said “I’m such a scary little
year old girl” directed bluntly at usAlso while in our way, they would
discuss things to each other intentionally out loud that had information about
our conversation from a few days beforeIt leads me to believe that Mrs***
had called them and told them everything as nothing other than gossipI found
this very unprofessional as she is releasing information to them that should
have been private between a resident and the landlord
We have removed
everything from the apartment and followed the appropriate move out procedure
by cleaning everything as instructed in the move out papers given to usI do
have photo and audio evidence of the problems that continued after the day we
spoke with Mrs*** initially In summary,
I would like Mrs*** to acknowledge that this started as a security issue when
she advised me to take the problem up with the other tenantI was forced to
seek other living arrangements after many months of these problems not ceasing
It wasn’t until I sought legal advice that we found out there is not a current
valid lease in my nameMrs*** even went as far as to say she could ask my
mother to move out of her apartment if I chose not to satisfy an invalid lease
that was never in my nameI have been a good tenant by paying on time and
never having complaints made on myselfI would just like Mrs*** to
acknowledge that this was a problem and there was no valid lease in my name.

I reject the many misstatements in Mr***'s statementHowever, since I have already agreed to let him break his lease at the end of this month, I do not understand why he is continuing to complainIn fact, if he continues to insult me by calling me a "liar" when he, in fact, is the one taking liberties with the truth, then I may reconsider holding him responsible for the remainder of his lease (which he most certainly signed at renewal).Finally, although I am willing to let him break his lease, I will not release him from any damages that are found in the apartment after he vacatesQuite frankly, I am especially worried about this possibility since I recently discovered that Mr*** has been keeping and concealing a large dog in his unity in violation of the lease.Sincerely,*** ***Saddle Brook Manor

In April 2015, I received a single phone call from Mr. [redacted] complaining about a teenage girl down stairs who was playing her music to loud while her parents were out of town. Since he had called the police and the immediate problem had been resolved, there was nothing more I could do at the...

time. When her parents returned home shortly thereafter, I immediately met with them and they promised to correct the problem and make sure that it never happened again, Since that time, there have been no more complaints from Mr. [redacted] or any other neighbors. As such, as far as I was concerned, the problem had been successfully resolved to everyone’s satisfaction. On August 1, 2015, Mr. [redacted] notified me that he had just purchased a house because it was a “good deal that he could not pass up”. He also advised me that he would be breaking his lease and moving out of his unit by the end of August. When I informed him that he would still be responsible for the lease through the end of the term (January 31, 2016), he became upset and stated that he could not afford to continue paying his rent now that he had a house. I promised to work with him on trying to relet the apartment as soon as possible to mitigate his liability. It should be noted that there was never any mention of any problems with the girl downstairs or any other problems during this conversation. On or about August 12, 2015, Mr. [redacted] contacted me again to advise me that the “real reason” he was leaving was because of the girl downstairs and that we should therefore let him out of his lease with no penalty. He also had a “paralegal” friend of his call me on numerous occasions to also argue this same position. There are plenty of witnesses available who can confirm that there have been no noise issues around Mr. [redacted]’s unit since April of this year. During my many years as an apartment manager, it is not unusual for circumstances to change with a resident such that they need to break their lease. In most cases, when residents are honest about their situation, we are able to work out an arrangement that is acceptable to both sides. In this particular case, it is unfortunate and disappointing that this resident is trying to bring up a relatively minor event that happened five months ago as an excuse to avoid responsibility for his lease. It is also especially distressing that he would file a frivolous and potentially fraudulent complaint with your office in an effort to pressure me into giving up our legal rights.
