Initial Business Response / [redacted] (1000, 5, 2015/09/24) */ I am in the business of selling OLDER used cars and trucksApril will have been years since I started this business at the same locationOver the years, I have done my best to offer decent vehicles to the public which are mechanically sound and are reasonably pricedI have my vehicles go through thorough mechanical, safety and smog inspections before offering them for saleFor this reason, most of my customers are repeat customers since they have been happy with the vehicles they have purchased from meMy business is mostly word of mouth and I do very little advertisingHowever, over the years, I have not been able to make these older used vehicles BRAND NEW like this 16-year-old Jeep Wrangler with over XXXXXX miles on it! I had had this Jeep completely checked out by my mechanic and a complete safety and smog inspection had been done before offering it for saleOne job in particular was done by an outside Rear End shop called DND Enterprises in Vacaville who did an overhaul to the rear differential which cost me $327.00(invoice shown to the customer) The Blue Book Value on the vehicle with the mileage of XXXXXX at the time of sale was close to $11,while I sold this Jeep to the customer at the price of $On a few occasions prior to the sale that the customer came in to check out my vehicles to make a decision as to which vehicle to buy, she had her eyes mostly on this Jeep since it is a wheel driveShe mentioned that she goes out of town wheeling whenever she gets a chanceAs she has mentioned in the complaint, I did take care of her on a couple of occasions that she came in especially when she had a leak on the FRONT differentialYet, I'm totally puzzled as why she had to have the seals done on both differentials unless the wheeling had been real [redacted] the vehicleIt is noteworthy to mention that my warranty was only for miles OR daysHowever, the customer had put close to miles on the vehicle before having it checked out by MeinekeIt is natural for a vehicle especially an older used vehicle to develop some problems especially with heavy usage in a short period of time( almost miles in less than months time)Having said all that, it should be mentioned that her complaint is not about anything major like a blown engine or a messed up transmission! This means that I have sold her a good vehicleThe minor stuff developed after the expiration of warranty is the responsibility of the ownerNobody can guarantee every used vehicle they sell indefinitelyThat's why in my warranty it is clearly mentioned days or miles whichever comes first As far as taking the vehicle back and refunding her money I should mention that, at the time of sale and after she was done test driving the vehicle and checking it out, she was offered to have the vehicle inspected either on the premises(on the lot) by her mechanic or take it to her mechanic shop as it is clearly POSTED in our office, which she declinedAdditionally, at the time of sale, she was offered a hour Contract Cancellation Option Agreement to purchase which she DECLINDED as wellTherefore, Since the fees like tax and license have been paid to the government and since new and used vehicles lose value over time especially as a result of wear and tear and mileage put on the vehicle I will not be able to take the vehicle back and give her full refundHowever, I will be willing to buy the vehicle back for the amount of $This offer is good for the duration of days from today as long as the vehicle is in original condition as it was at the time of sale on 7/9/wear and tear and ONLY needed repairs mentioned in the customer's complaint are expectedMy offer clearly shows that I still believe in this Jeep and I think it is worth the moneyAfter all, who would pay $6,for a year old Jeep Wrangler with over XXXXXX miles which the customer thinks is a LEMON?! I am not accepting this offer due to the fact this man sold me a lemon and he knows itI have paid him I have put almost into the vehicleI have had to replace the rear differential seals put spacers on the vehicle so the front tires would not grind into the axles.I had to replace the radiator because it was leakingThese are not general maintenance.This man had insured me the vehicle was soundI had to take the vehicle back to him due to electrical issues and the check engine lightHe had to replace the fuel injector and he said the lights worked fine.I also had major leaks from the engineI took the vehicle to him about the leaks he had his mecanic look at it and said nothing was wrongI took the vehicle to my own mecanic due to I no longer trusted this man.At this time I was informed of the issues with this vehicle and did the repairs.I have to replace the exhaust manifoldI asked him to just return my down paymenthe told me know and became upsetI informed him that he knew he sold me a lemon and if I had to I would take him to courtHe said he did not care and that he would see me in courtI have found thru word of mouth (yelp)this is not the first time this man has done wrong with his customerI really thought this man was truthful to his words and since he is a local dealership he would do good by being honest with his local customersI will proceed with legal actions unless he agrees to just give me my down paymentHe can keep the payments I already paid himIf this vehicle is so good he would have no problem selling this vehicle for way more than he sold it to me.He said this vehicle is worth XXXXXin his last responseso if that is true he could sell it for that Thank you [redacted]

For this reason, most of my customers are repeat customers since they have been happy with the vehicles they have purchased from me. My business is mostly word of mouth and I do very little advertising. However, over the years, I have not been able to make these older used vehicles BRAND NEW like this 16-year-old Jeep Wrangler with over XXXXXX miles on it! One job in particular was done by an outside Rear End shop called DND Enterprises in Vacaville who did an overhaul to the rear differential which cost me $327.00(invoice shown to the customer).
The Blue Book Value on the vehicle with the mileage of XXXXXX at the time of sale was close to $11,000.00 while I sold this Jeep to the customer at the price of $8995.00. On a few occasions prior to the sale that the customer came in to check out my vehicles to make a decision as to which vehicle to buy, she had her eyes mostly on this Jeep since it is a 4 wheel drive. She mentioned that she goes out of town 4 wheeling whenever she gets a chance. As she has mentioned in the complaint, I did take care of her on a couple of occasions that she came in especially when she had a leak on the FRONT differential. Yet, I'm totally puzzled as why she had to have the seals done on both differentials unless the 4 wheeling had been real [redacted] the vehicle. It is noteworthy to mention that my warranty was only for 1000 miles OR 30 days. However, the customer had put close to 2700 miles on the vehicle before having it checked out by Meineke. It is natural for a vehicle especially an older used vehicle to develop some problems especially with heavy usage in a short period of time( almost 2700 miles in less than 2 months time). Having said all that, it should be mentioned that her complaint is not about anything major like a blown engine or a messed up transmission! This means that I have sold her a good vehicle. The minor stuff developed after the expiration of warranty is the responsibility of the owner. Nobody can guarantee every used vehicle they sell indefinitely. That's why in my warranty it is clearly mentioned 30 days or 1000 miles whichever comes first.
As far as taking the vehicle back and refunding her money I should mention that, at the time of sale and after she was done test driving the vehicle and checking it out, she was offered to have the vehicle inspected either on the premises(on the lot) by her mechanic or take it to her mechanic shop as it is clearly POSTED in our office, which she declined. Normal wear and tear and ONLY needed repairs mentioned in the customer's complaint are expected. My offer clearly shows that I still believe in this Jeep and I think it is worth the money. After all, who would pay $6,000.00 for a 16 year old Jeep Wrangler with over XXXXXX miles which the customer thinks is a LEMON?!

September 28,2015. The reason I am saying no is because I want to make sure that the owner of Silicon Motors that he paying me the 6000.00 in a cashiers check. And that I am walking away free and clear with a 6000.00 check in my hands. He is getting a vehicle that has been repaired and in the same condition as I purchased it. I also want to say that I never told him that I go four wheeling as much as possible. If he is willing to pay me the 6000.00 and I am free and clear from him.Then I am willing to close this case.
But if not then we will proceed further.

The customer is very well aware that she has financed this vehicle. In other words, she has a loan on it. This means that the proceeds from the sale of the vehicle must first satisfy the loan. The left over money after satisfying the loan is for the customer to keep.
She has put down $4,000.00 and has, so far, made two monthly payments of $363.00 each. She also gets a credit for the amount $29.00 on DMV fees. Now, how could she walk away with $6,000.00 in hand for a vehicle that she has used for almost 3 months and she hasn't even paid $5,000.00 to us?!(refer to the yellow copy of sale contract provided on the date of sale for the breakdown of the numbers and for terms of the contract)
My offer of purchasing the vehicle back for the amount of $6,000.00, as I mentioned before, is good through 10/9/2015 when the 15 day deadline is up and when the next payment is due. The payoff on this vehicle through 10/9/2015 is $5,571.61. This means that if the customer sells the vehicle for the amount of $6,000.00 to us she will walk away with $428.39 assuming that the customer will not have made a third payment yet. In that case, she will be free and clear from the obligations stipulated in our secured collateral contract dated 7/9/2015. It is necessary to mention that she doesn't necessarily have to sell the vehicle back to us. She can trade it in in another dealership towards another vehicle or just sell it outright to them or a private party. If she decides to sell it outright to a dealership or to a private party the loan on the vehicle must be paid in full before she can transfer the vehicle to the other party. I should mention that being it a Jeep Wrangler 4WD in good shape with almost new tires and with a highly sought-after 6 cylinder engine in it, my estimate is that she should be able to get between low to high $7,000 from a private party easily. I am not accepting this offer due to the fact this man sold me a lemon and he knows it. I have paid him 4727.00. I have put almost 2000.00 into the vehicle.
