Wayne has performed a thorough and diligent search of our files and have asked our service providers to do the same with respect to this fueling-station site (formerly known as *** *** *** *** **) and in response to the allegations of MrSingh We are satisfied that we have an
accurate and thorough history of the site, and in view of that information, Wayne respectfully disagrees with the allegations asserted in the complaint, and further disagrees that the complainant, or any owner or operator of the fuel dispensers at the subject location, is entitled to any compensation or damages with respect to such claims
In particular, we note as follows:
• Wayne Ovation™ fuel dispensers are sold with a manufacturer’s warranty that covers the equipment for months from the date of installation, but in no case will such warranty exceed months from the date of shipment;
• The Wayne fuel dispensers at issue in the complaint were not “brand-new” in as the complainant has claimed Instead, they were shipped from the Wayne manufacturing facility on December 19, 2008;
• Wayne received a commissioning report (i.e., indicating calibration and start-up) for the subject fuel dispensers on April 19, 2011, which report included a note that that the equipment actually had been installed by the ASO (Northern Petro-Equipment Services) on April 13, 2009, more than two years earlier, after which the site had gone into default and was taken over by Community Bank & Trust of Sheboygan, Wisconsin; which was the owner of record at the time of commissioning in April 2011;
• Wayne indeed honored the manufacturer’s warranty, which expired on May 19, 2011;
• Wayne received four requests for minor service and maintenance during the active warranty period, and each issue was addressed by Wayne ASOs at no charge to the fueling station;
• Wayne received no service requests and no complaints from this location regarding the fuel-dispensing equipment between June 27, and January
• To be eligible to receive warranty parts and service, Wayne equipment must be commissioned, serviced, and maintained by a Wayne Authorized Service Organization (ASO);
• MrSingh’s complaint references several service providers that performed post-warranty work at the site, one of which providers is identified as “Walt’s Petroleum.” Walt’s Petroleum is not a Wayne ASO, and therefore has not been trained or certified by Wayne to work on Wayne equipment;
As a final note, we have received information that suggests that MrSingh told one Wayne ASO that the dispenser displays about which he has complained had “gone out” during a storm, and that MrSingh had made a claim with his insurance company on that equipment It appears to be doubly disingenuous that he apparently is now seeking compensation from Wayne as well
