They offered to buy our home via a post card in the mail. I call them to act on it and was told it would take 60 days for probate. Instead they put the house on the market to sell. I asked for $45,000 and was only offered $37,500, which would come to $32,000 after probate and expenses. They sold the house for $60,000 and earned a $23,000 profit. There was no probate involved. *** lied throughout the process, told me I could not get out of the contract and now they are not returning phone calls. I have talked to *** (owner) and he said he would call back with "clarity". He has never responded. I have sent texts, emails, phone calls, no one is responding. I gave them a bad review on google then was asked to call them regarding my concerns. They did not respond. Instead I received a letter from an attorney warning me to never contact *** or the company again. I feel like I have been scammed.
We apologize that you feel like your expectations weren't met. We believe it was actually very convenient that the title company did not require a probate, that did save you approximately 2,500-4,000 in selling costs. Our Purchase Agreement & Resale Disclosure in addition to Josh's statements clearly state that we purchase properties with the intent to re-sell for a profit. We did fulfill everything in our agreement as did you. We are sorry, but there is no 'refund' to be given as this was a legal Purchase & Sale of Real Estate. The amount that you are requesting is far more than the actual profit that our company made from the Purchase & Sale of the Real Estate.
Complaint: ***
I am rejecting this response because:
When I initialed #4 on the contract, my understanding was that they could resell the property for a profit after they bought it. They never bought the property. I initially asked for $45,000. We did not receive a fair deal, which is why I have not been receiving a response from the company. *** was very evasive and very misleading on purpose. He knew he was going to put the house on the market for 79,000 when he offered the 37,000. He also told me he has been in the business for 6 years and they have never been able to avoid probate. He also said the probate was 2400.00, not 2500 or $4000. He also said that they work with the same attorney and have done so for years. I sent my death certificates to a title company not an attorney. I am willing to close this complaint if we can get my initial request of 45,000 for the home.
Sincerely
Please see attached where PURCHASED the property at the agreed upon price.
