Complaint: [redacted] I am rejecting this response because: Concerning my chief complaints: #You refused to accept a credit card payment from me, OR my insurance company citing that you thought I or the company would dispute the charges; #you had my vehicle on your truck at the foot of my driveway; #that in less than hours you had jacked the price up to $cash only, again refusing a credit card payment; #that you would charge an additional $per day for storage; #that you claim that my insurance company would not honor my towing coverage for which I pay extra for; #that you refused to give me an invoice or receipt of you towing my vehicle which requires my signatureI really do not want to pursue this further, I hope we can work this out, but this is the last time I will reply to this complaintI have already spent several unpaid hours researching and filing complaints about your actions, The next time it will be in court and include damagesI now quote from the Colorado Revised Statutes as provided me through the Longmont Police Department from the information provided them by the Public Utilities Commission; with the understanding that you have and in fact do take credit card payments: Code of Colorado Regulations Public Utilities Commission CCR 723-Rules: Paragraph B Section If the towing carrier does not advise the owner, authorized operator, or authorized agent of the owner of a motor vehicle of acceptable forms of payment under rule or accept such forms of payment, the towing carrier shall not charge or retain any fees or charges for the services it performsAny money collected must be returned to the owner, authorized operator, or authorized agent of the owner of the motor vehicle Paragraph I NoncomplianceIf a tow is performed in violation of state statute or Commission rules, the towing carrier shall not charge or retain any fees or charges for the services it performsAny motor vehicle that is held in storage and that was towed without proper authorization shall be released to the owner, lien holder, or agent of the owner or lien holder without chargeAny money collected must be returned to the owner, authorized operator, or authorized agent of the owner of a motor vehicle Paragraph A The towing carrier shall immediately accept payment of the drop charge, towing, storage, and release charges if payment is offered in cash or valid major credit cardThe towing carrier may accept other forms of payment but must accept payment by both master card and visaThe towing carrier shall release the vehicle to: the motor vehicle owner, authorized operator, or authorized agent of the owner of the motor vehicle; etc etc Paragraph B Unless the release of the motor vehicle does not comply with the release procedures agreed to between the towing carrier and the applicable law enforcement agency, a towing carrier that accepts for storage a motor vehicle that has been towed as a nonconsensual tow upon the authorization of the property owner shall be available to provide access to or release of the motor vehicle as provided in paragraph (a) to the owner, authorized operator, or authorized agent of the owner of the motor vehicle either: within one hour's notice during all times other than the carrier's business hours that occur within hours of storage; or upon demand during the carrier's business hours Paragraph C Failure to notifyA towing carrier holding a motor vehicle in storage who cannot demonstrate that it has made good faith effort, as set forth in 42-4-and 42-4-2103, CRS., to comply with the notification requirements of parts and of Article of Title 42, CRS., and 42-5-109, CRS., shall release the motor vehicle to the owner, lien holder, or their agents Towing Violations and Civil Penalty AssessmentsParagraph A A violation of any of the following provisions may result in the assessment of a civil penalty of up to $1,for each violation: 40-10-401(1)(a), CRS.; Subparagraph (b)(1), (b)(2), (b)(4), or (b)(6)(D) of rule Paragraph (I) of rule 6511; or paragraphs (d), (e), (g), or subparagraphs (b)(1) or (g)(i)(A) of rule for an overcharge greater than $ (B) A violation of paragraph (d), (e), (g), or subparagraphs (b)(1) or (g)(1)(A) of rule may result in the assessment of a civil penalty as follows for each violation;
