I am sending this letter as a response to your letter dated 6/24/ When [redacted] contacted our office, she was being administrated by both her Sales Rep, [redacted] as well as being set up for a preview by myself or the service department I had heard on her message that she was having problems with white spots and moisture which is whyI directed her sales Rep to speak to her, not to sell her a product, rather to introduce her with options for her to look intoI, myself was working through another office girl to set myself up to go out and preview her recent callWe were currently set up for service call for the crewon Thursday, July 3,and I wanted to go there once more to see if there were any other additional items I needed to add to the service crew's work order for the 7/appointmentRealistically, she was being administrated from two departments which may explain the chronological confusion Either way, she is be address in a fast professional manner On Tuesday, June 6/24/2014,met with [redacted] to review her basementI once again explained whatwe w#re doing and why as well as adding a couple additional items to the work orderI explained that her basement was older and had an irregular constructed foundation type and what we were doing was adapting her irregularity to our system, both functionally and cosmeticallyThere were to areas that required additional footage and were added to the work orderWith older basements with pour concrete floors, more work may be required to get them repaired and it may take a good rain to expose such problemsThey have lots of cracks and seams that need to be addressed once the initial system has been installedOur product and service is often times, not a one time installation, rather a forward moving progress to remedy the diversities of every individual homeI did assure her that they would be taken care of under warranty and according to our contract, she simply needs to call and I will gladly make an appointment with her to review any new item in her basement Their plan is to rebuild the lost basement in time and I assured her we would use that interim time to make sure all is well with her basementI also told her that I would set up a follow up service call on 7/3/to see what issues may be leftI also assured her that I would not give up on basement and will be available to advise her as we progressI want nothing more as a company owner to assure the satisfaction of all our customers, I simply enjoy their family and will accept the challenge to make them satisfied with our company I have forwarded a copy of this letter to [redacted] as well and if anyone has any questions regarding this complaint, I would gladly be available to answer themFeel free to keep in touch with any progress updates

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowThey "offered" to do work that I would have to pay them for.I have enclosed photos of the water on my basement floorThe first photo shows a puddle on the pink vinyl tile floor from before the company did any workThe second photo shows that same area of floor in the bedroom, after they installed their system, with a puddle in the same location as before.When their salesman Jack [redacted] came to my home for the first time, I showed him where the water sits (example shown in photo 3)His "professional opinion" was to dig a trench basically along the center line of where the water was consistently showing up and connect that trench to my sump pump to drain the waterHe claimed that I would no longer have water in the basement after that was done, and that the work was guaranteed for the life of the home At NO TIME during that visit did he suggest any other system to solve the problem.I signed the contract for Basement Waterproofing Incto do the work he suggested, as diagrammed by him, and paid them over $4, Within a day or two of them finishing, the water appeared on the floor, same as it always did beforeThe system they installed did NOTHING to correct the situation(Photos 4, 5, & 6)I called them back to the house and THAT is when Jack and Jay started to make excuses, and suggesting more trenching which they expected me to pay another $5,forThe bottom line is: The system that they suggested, installed and guaranteed would eliminate water from coming onto my basement floor, did not do what they promised They have refused to correct the problem without chargeThey have also refused to refund my moneyWhat kind of a "guarantee” are they honoring? It is clear to me that they are unwilling to make this right, and so I request that you revoke their A+ rating on your site and post my photos to show prospective consumers what Basement Waterproofing Inc's work looks likeRegards, [redacted]

Thank you for your complaint regarding Mr [redacted] , received on September 12,2014, our company, Basement Waterproofing, Inc is grateful to give a response to any matter presented to us from the Revdex.com Here are the particulars, Mr [redacted] entered into contract with another company on Basement Waterproofing Nationwide of Central New York, Inc, in 4/5/BW Inc, assumed all contracts from the prior company of BWN of CNY, Inc assuming at will the warranties without obligation fiom the BWN of CNY, Inc., mostly stating, most people never realized there was a transition as we honored the warranties from the old company Needless to say, the contracts have a lifetime warranty with Basement Waterproofing Inc and have continued to provide Mr [redacted] with service from that point onPlease keep in mind, that in the State Law of New York State, there is no such thing as a Lifetime Warranty as contracts expire after years from the time of conceptionAny lifetime warranty provided by a company is solely based on the integrity of the companyAs you can see, years later we are still trying to honor the warranty from the previous company Simply put, Mr [redacted] requested a need for service, we requested to install a sub-floor drain system as contracted, however, he wanted to attempt another outside approach whereby we inject a bentonite clayOn Friday, 112014, we went out their to do the reinjection and Mr [redacted] wanted a larger pry bar to be used through his deck boardsMy foreman of plus years, told him that he needed to have the deck boards removed in order to do this workThe reason his deck boards require removal, is simply, there is not a inch dowel plug available to re plug our drilled holes in the deckMr [redacted] was told to have his deck boards removed and we would schedule another time to do the workBW Inc, scheduled, another date for Tuesday, 8/19/to do the work, upon arrival, the deck boards were not removed and Mr [redacted] had called our office prior to the service call and said that he could not remove the deck boards without having to remove the siding from his house and said that we can drill through his deckUpon arrival, he insisted us using his method of the inch pry bar, and that drilling through the deck would not allow us to plug the holes, which was unacceptable to him alsoDrilling through his deck would provide us the standard procedure of using a 1/inch bore so we can re plug our holesHe insisted, that is not what he wanted, the reinjection via % hole and wanted the inch hole with our company removing his deck boardsSimply put, I am not going to allow Mr [redacted] to re-invent our process in providing him with his idea of applicationAfter driving one hour each way to his home on two separate occasions, Mr [redacted] was sent a bill, for $for ow company to come out and perform the service work via standard 1/2" bore hole or have his deck boards removed As you can see, we have not refused service to this man, however, it is ow right to do so My secretary will not speak with him as Mr [redacted] is extremely rude on the phone From this point forward, BW Inc will service Mr [redacted] on our terms, as I will not risk further loss of our company time, nor waste money on a prior contract long past it's term of legal expirationHe can pay his surcharge, and upon reception, we will gladly schedule his reinjection with out standard procedure for a 1/inch hole or he can have his deck removed to accommodate his pipe dream, either way, I will not bore a inch hole to leave a hole that I cannot plug Should you have any questions regarding this matter, feel free to contact ow office at the number listed above [redacted] Basement Waterproofing, Inc

I want to thank you for the opportunity to answer the complaint registered by [redacted] .The contract with Basement Waterproofing, Inc.Was was writte non 10/21/ with [redacted] We were scheduled to perform our contracted warranty work on Thursday, 8/11/ for the full footage amount of feet of their contract Upon arrival, they opted for the partial contract warranty work to be performedThey were explained that there would be a surcharge if we had to go back and perform the additional remaining contracted areaThey understood and our company was happy to do the work that was contractedBasement Waterproofing, Inc is not contracted to basements in foot increments with hour drive time one wayThe house was later sold to [redacted] and in time had water and wanted to have the work doneWhen the warranty transferred, it transferred with any and all remaining conditions, either clean of debtor with any attached contingenciesIn the case of the [redacted] , there was a $ dollar travel surcharge should we have to go back and complete the contract This was explained to the [redacted] 's and in agreement, two service calls were set up to preview the required prep work for the pending installationA date was issued for the installation for Wednesday 11/27/That date was then moved to Saturday, 11/30/The residence is hour minutes from our office and the work was being done on overtime hoursUpon arrival, [redacted] was not prepped and turned our crew away Regardless of reason, even lack of funds, once our truck(s) depart and arrive at the home on a confirmed appointment and then turned away,the lost travel time is assessed to the homeownerIt is considerable money to drive men, hour round trip, gas, tolls, truck usage, overtime labor as well as the loss of the time slot that could have been issued out to another customer, had we received a call to cancelThus the applied surcharge, there was plenty of close date communication to opt out and rescheduleEither way, the surcharge for travel and the and the prior charge from the original warranty transfer will apply with the total payment due to Basement Waterproofing, Inc prior to any new reschedule dates will remain $One last comment is simply this, 1have no contract with [redacted] , and our company drove out to his home on a confirmed scheduled appointment to remedy his homeThere was plenty of opportunity to avert the wasted travel expense occurred by our companyPreferably, I would have rather completed the work as scheduled and wold love to have the time slot returned to accommodate another customerWithout payment, Basement Waterproofing, Inc.has risked all that we are going to at this point Should you have any questions, please feel free to contact our office

I'm in the process of buying a house and needed to get an estimate done for water issues in the basementI set up an appointment, and after finding out I needed something sooner called to try for something soonerI spoke with someone on the who was nice enough to give me pointers and general info by phone and said if I still wanted them to come, to let them knowI called a few days later, and asked if the appointment was still available and was told "Yes, you're still on the calendar"Two weeks later, I met my Realtor at the house and we waited for an hour but no one from Basement Waterproofing showed
We called the next day and I was told there was "some confusion" with getting the appointment setup and they thought I didn't want themAfter reminding her that I called to confirm, I was given some other poor excusesWhen my realtor called she was given misinformation - specifically they claimed to have told me upfront they weren't able to do this work which is absolutely untrueI waited WEEKS for them to show up after telling them this was a time sensitive issueThis was a waste of time, their customer service was terribleI went with another company (who also has a lifetime, transferable warranty) and will be telling everyone I can to NOT work with these peopleSave your time, go somewhere else!!

Upon the initial exterior clay injection, *** called our office for still having water in his basementI set
and confirmed an appointment with *** for Thursday, 5/1/for contract evaluationUpon arrival
*** was a no showUpon explaining to his wife, I gave a date for the second 1/of his contract and
offered to explain to *** via telephone the procedure of the installation as well as going back out to
assist him in his preparationI did both of these, called and explained and offered to review how and why
in personHe then said that an installer had said we would dig up his exterior wallI explained to him
that that process has never been done by our company, nor has ever been contractedPerhaps the installer,
who is just a paid installer, tried to explain the interior floor system and was mis-interpreted, however, the

remedy his longtime basement seepage issue

on Thursday morning. I will be going out there on Tuesday. 6/24/2014 to preview her

completed as per contract and her basement will be dry for seepage.
Our service crew is scheduled to go to her home on July 3rd, to perform some warranty
work and cosmetic work not required under contact at no charge to her.

I do not accept yet. For clarity purpose, I left a message with the company on June 14th, not the 18th. The Salesman, [redacted], called me back on Tuesday June 17th stating that I should do a "foil test" on my floor to see if the water on my floor was due to humidity. If it was due to humidity they would charge me to come for a service call, since humidity (condensation) is not covered under my warranty. He then told me about a $1200 humidifier I could purchase for condensation. 
I responded that there is water all over the basement, worse than before the job. I was told there would be no more water after the clay injections, and therefore why would condensation even be an issue. I was confused why the sales person was calling me instead of the owner. He told me he would leave a message for the owner.
On Wednesday, the 18th, the secretary Linda called to set up a service call for June 24th. 
I accepted that appointment. 
My main concern is that this job is corrected. It is obvious that the system isn't working properly, and a service appointment doesn't resolve the situation.

foreman of 20 plus years, told him that he needed to have the deck boards removed in
order to do this work. The reason his deck boards require removal, is simply, there is not
a 2 inch dowel plug available to re plug our drilled holes in the deck. Mr. [redacted] was
told to have his deck boards removed and we would schedule another time to do the
work. BW Inc, scheduled, another date for Tuesday, 8/19/2014 to do the work, upon
arrival, the deck boards were not removed and Mr. [redacted] had called our office prior to
the service call and said that he could not remove the deck boards without having to
remove the siding from his house and said that we can drill through his deck. Upon
arrival, he insisted us using his method of the 2 inch pry bar, and that drilling through the
deck would not allow us to plug the holes, which was unacceptable to him also. Drilling
through his deck would provide us the standard procedure of using a 1 1/2 inch bore so
we can re plug our holes. He insisted, that is not what he wanted, the reinjection via 1 %
hole and wanted the 2 inch hole with our company removing his deck boards. Simply
put, I am not going to allow Mr. [redacted] to re-invent our process in providing him with
his idea of application. After driving one hour each way to his home on two separate
occasions, Mr. [redacted] was sent a bill, for $300 for ow company to come out and
perform the service work via standard 1 1/2" bore hole or have his deck boards removed.
As you can see, we have not refused service to this man, however, it is ow right to do so.
My secretary will not speak with him as Mr. [redacted] is extremely rude on the phone.
From this point forward, BW Inc will service Mr. [redacted] on our terms, as I will not risk
further loss of our company time, nor waste money on a prior contract long past it's term

Upon arrival, they opted for the partial contract warranty work to be performed. They
were explained that there would be a surcharge if we had to go back and perform the
additional remaining contracted area. They understood and our company was happy to
do the work that was contracted. Basement Waterproofing, Inc is not contracted to
basements in 5 foot increments with 1.5 hour drive time one way. The house was later
sold to [redacted] and in time had water and wanted to have the work done. When the
warranty transferred, it transferred with any and all remaining conditions, either clean of
debtor with any attached contingencies. In the case of the [redacted], there was a $400
dollar travel surcharge should we have to go back and complete the contract This was
explained to the [redacted]'s and in agreement, two service calls were set up to preview the
required prep work for the pending installation. A date was issued for the installation
for Wednesday 11/27/2013. That date was then moved to Saturday, 11/30/2013. The
residence is 1 hour 25 minutes from our office and the work was being done on overtime
hours. Upon arrival, [redacted] was not prepped and turned our crew away.
Regardless of reason, even lack of funds, once our truck(s) depart and arrive at the home
on a confirmed appointment and then turned away,the lost travel time is assessed to the
homeowner. It is considerable money to drive 4 men, 3 hour round trip, gas, tolls, truck
usage, overtime labor as well as the loss of the time slot that could have been issued out
to another customer, had we received a call to cancel. Thus the applied surcharge, there
was plenty of close date communication to opt out and reschedule. Either way, the
surcharge for travel and the and the prior charge from the original warranty transfer will
apply with the total payment due to Basement Waterproofing, Inc prior to any new
reschedule dates will remain $900.00. One last comment is simply this, 1have no contract
with [redacted], and our company drove out to his home on a confirmed scheduled
appointment to remedy his home. There was plenty of opportunity to avert the wasted
travel expense occurred by our company. Preferably, I would have rather completed the
work as scheduled and wold love to have the time slot returned to accommodate another
customer. Without payment, Basement Waterproofing, Inc.has risked all that we are

[redacted] contacted our company and a contract was filled out on 10/13/2014. The
contract included the bentonite injection on the exterior wall to stop water that seeps into
the ground from passing through wall, as well as the installation an interior sub floor
drain system....

Our contract provides warranty for water passing through the wall as
water seeping up from (he ground. We did the initial injection, and a call for service
initiated the necessity of installing the interior sub-floor drain system. We installed the
floor system as required because he needed the floor system. As [redacted] testified, his
sump pump runs 24/7, thus due to water bleeding UP from the water table and is bled
away via his sump pump. We know that water is not perpetually running down the
exterior of his sunken grade and into his sump pump, thus establishing that our system is
working and water entry is beyond the scope of our contract.
Our contracts state that we do not provide warranty for grade and poor structure, as
highlighted. The [redacted];'s read the warranty and understood the warranty and signed for
the warranty. Also, agreed to on the service contract was to make the wall bare and
accessible as necessary, a/so highlighted. Should grade work: be necessary, it can be
added or sub contracted out as necessary. In [redacted]l's case, he would need a
professional concrete mason. We are not asking C. [redacted]l to repair his sunken slab to
honor our warranty, simply stating that the problem remaining is simply due to the poor
grade from his sunken slab. As [redacted]l testified, his pump is running 24/7, we
know that water is not perpetually running down his slab as the source to feed his sump
pump. His sump pump is being fed from the source, water below the floor, and this part
of the contract warranty is working just fine.
For the record, I was at [redacted]l's house twice prior to the installation of the floor
work reviewing the procedure with [redacted] and once prior to that with his wife. We were
reviewing the exterior of the contracted area and it was advised that his sunken slab of 6
inches deep should be addressed and repaired. On the second visit, he was asking more
details as to how it should be fixed and said he was going to repair it. After all, it is
[redacted]l's real estate and my contract does not provide warranty to repair leaking
roofs, leaking washing machines, leaking pipes, condensation, leaking pets, and water
leaking do to a poor neglected grade.
Simply told to [redacted]l, he can remove his wall as to make the wall bare and
accessible as contracted and 1 will provide a panel to flash his above grade problem into
our floor system. This will provide the dryness to his basement so he can rebuild with
confidence, with or without repair to his neglected grade. The lower part of the wall that
was asked to be removed was for the installation of the floor system and such was already
water damaged from his continual problem. We try to minimize what needs to come
down first and as needed, may need to take more down. In taking down his wall so we
can provide the panel to tie in his grade, he then can remove the fiberglass insulation
attached to his wall which is not recommended due to condensation matters. In fact, the
water that currently comes in leaks in above grade, saturates the fiberglass insulation and
drips on the outside of our system. All these items are repairable, and once removed, we
can do our part and [redacted]. [redacted] can do his, repair his home correctly. I am always
available should he have any questions as he progresses. So in answer to his complaint,
Basement Waterproofing, Inc is going to correct his water problem as was told to him as
my last visit, upon removal of his wall as contracted for him to do so.. Once installed, If
he wishes not to repair his slab, it is of no relevance to our company as our panel will be
in place to remedy his problem.
I am not refusing [redacted] service, nor would ever cease to honor our contract and
integrity of our installation. However, [redacted]l, like any homeowner, needs and
should make corrective repairs to his real estate. It is not my problem to remove and
replace a neglected sunken slab, nor was 1 contracted to do so. It certainly should be
seen as an issue of contention and once the wall panels are in place he can continue to
neglect it for another 10 years. However once the panels are installed, he can renovate
his basement and not tell his BBQ guests that the basement is off limits. They can
simply ask him when his is going to repair his sunken slab. Once [redacted] removes
the wall as agreed to under contract, I will panel his wall as necessary. Please note, this
repair is not part of my contract and simply, if is within my contractual right to advise
him to repair his grade and be done with it. I would love nothing more than to provide
[redacted] with a dry basement withing the confines of our contract..
