Review: On 7/9,I paid the parking fee of $5 in advance of parking at [redacted]. I emailed proof of pymt. They are trying to collect $60.

On 7/9, I paid the required posted $5 parking fee at 6:20 a.m. (Ticket receipt #[redacted], S/N# [redacted] # East Machine 46) in advance of parking and proceeded to park my car in the lot between at their property. My parking expired at 11:59 pm that evening. As a regular customer, I routinely leave my receipt on the dash. When I returned to my car after work that evening, there was a parking violation envelope in my driver's side door stating that the penalty for No ticket on dash was $60 (Notice #[redacted] at 1:55 pm). That evening, on 7/9, I promptly sent a photo with proof of payment (the receipt that was in my car)to their contracted recovery service and the violation next to it for reference. Today, 7 days later, I received a response from the 3rd party, not addressing the fact I paid for the service I used before I used it, rather the response stated I could pay $40 for their in-house self-labeled "violation". I paid the $5 required for the service that I used. Assessing an excessive fee of $60 additional is unethical and they arrange for this service. Today, I contacted this business, the owner/manager, of the lot that stated that matter could be resolved through the 3rd party that is not resolving it. I attempted to address this directly with the parking management company and the 3rd party, but they refuse to recognize that I paid for the service I used in advance of using it. Additionally, there is nothing in writing anywhere that receipt that threatens this excessive penalty -$60-rather, on the reverse side of my receipt, it faintly states they accept no responsibility for loss or damage to vehicle or contents. Regardless, I should not have to pay $65 or $45 for something I already paid $5 for.Desired Settlement: Acknowledge that the matter is resolved. I request this Company to resolve my matter directly (Consider this resolved), or, otherwise, contact their contracted service and demand this matter be resolved as I paid - in advance - for the service that I used. Also, in general, I request they stop their unethical practice of assessing excessive fees for $5 parking or contracting with a service that does.

As you know, ABM Parking Milwaukee operates private parking lots in the Milwaukee area. The surface lot which is the subject of the above complaint is operated on an honor system; this lot is not manned, but is set up with a payment machine, and parking customers are expected to pay if they park in this lot. Unfortunately, many parking customers do not pay. In addition, some parking customers even attempt to defraud the parking companies by creating false paid receipts and bank statements, false monthly parking permits, and sharing payment receipts and monthly permits. This is a significant and substantial problem for ABM, as it is for all parking companies who operate surface parking lots.

As you also know, property owners have the right to protect their property from trespassers. Specifically, ABM Milwaukee, as the owner/authorized manager of these private parking lots, has the right to establish terms and conditions under which a customer is permitted to park their vehicle or use the parking lot. A customer is permitted to use the parking lot only if they fully comply with the terms and conditions established by the parking company. ABM Milwaukee has signage posted on their parking lots detailing the terms and conditions of using their lots, including payment rates, rules and general guidelines (pre-paying for the space utilized, displaying paid receipt face up on dash, etc.)
