Business

Response:

Mr. [redacted] has maligned my name and integrity of my business of 13 years by making false accusations and wrongly stating the facts. I was hired to refurbish/remodel certain areas of the residence and a payment mode was settled. According to the contract Mr. [redacted] would pay me the last payment prior to the final punch list. All this mess started when I billed him for the last payment on 2nd. January 2013. I am a small business and I make payments to my labor as I am paid. Obviously my labor working to finalize the job is demanding to be paid. ABOVE AND BEYOND THE CALL OF DUTY When we started our work in the Kitchen the plumber pointed out that there was a leakage in the Kitchen wall. As per photos you can see mold/mildew all along the Kitchen wall hanging out from the base plate, because of the water leakage whenever the kitchen faucet was used. This had gone on for 10- 12 yrs., as informed by the family. Insurance Company denied the claim saying it was not covered. Mr. [redacted] wanted me to close it up and leave it as it is. He did not want to pay me more than $2000 for the job which was: 1. Tear off and demolish all sheet rock and kitchen cabinetry from Dish Washer to the other end of the cabinets. 2. Remove all insulation up to the window ceiling level. 3. Remove the infested parts of the Studs and put new studs and clean and the area with chemicals. 4. Dry the entire area by blowing air. It took about 3 weeks to dry. 5. Installed new insulation, [redacted] and sheet rock. 6. Rebuilt the Cabinet Framing and the Cabinets, from The Dish Washer to the end of the Kitchen Bar area. After much consideration of the health condition prevailing in the family, with 2 minor daughters suffering from Asthma and were on prescription treatment; I had no choice but either inform the Health Department of the situation or and take on the project funding the deficit from my own pocket. I could not have lived with my conscience knowing what was lurking between the walls. So I went ahead and did all of the above. As for the Closet Drawers, they were not in the contract and were not paid for. The sinks were bought from [redacted] and and were missing parts. We were asked to install them any ways and we are not responsible for any malfunction after the job, which was duly checked and approved by Mrs. [redacted]. Apart from that Mr. [redacted] and Mr. [redacted] messed my labor badly. I had planned the labor for certain jobs but they pushed them to work on other projects thus making their trip go unfeasible. They misused my labor. They exchanged favors behind my back with my labor, even bribed them. THIS has caused me loss of my labor resources, financial & material and to the reputation of my business. I have proof of all this. Mr. [redacted] never paid me $ 50.000. It is a blatant lie. All the work was performed with consent, approval and CHOICE of the customer including paint on the wall paper in the bathroom. The wall paper was floated and then painted. The water stains are occurring due to the flat paint used on the instructions of the owner. All the accusations in this complaint are denied. The contract is attached herewith. It is self-explanatory. Work was suspended since customer refused to pay invoices. It has resumed after the intervention of mediator who guaranteed that I will be paid. For 13 years we have received many praises and have spread our business through the word of mouth only. Mr. [redacted] was also referred by a satisfied customer. I am personally involved and work with all my customers. Please find attached herewith photographs and copy of the contract.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

Regards,

The stories that Mr [redacted] is replying to Revdex.com is completely false. I have five members of [redacted] which are reputable members of Pakistani community who helps resolves matters of all kinds. They had personally met me and checked all the workmanship that mr [redacted] had hired to do in my house and later they met mr [redacted] and confronted him if the wrong doing to [redacted] residence. More over the murals were not done by mr [redacted] it was done by me with my hands. The pictures that he has submitted serves no justice hence if you come and look at the work you will come to know what kind of work was performed. The missing plumbing is false because he had hired a plumber who did not know how to install the sinks. He himself had claimed that he had never installed a bowl sink and that's why he had messed up the parts. [redacted] is a reputable business and the sellers that I purchased from have a 100 percent positive feed back. I have checks list that proves the facts how much have I paid [redacted] Ali for the work which is performed. Punch list is considered to be final clean up and minor touch ups and as of feb 28 all of our kitchen bathroom and powder room cabinets are still not finished. Missing tiles and marbles not replaced. Bricks on the house over sprayed with paint. Garage door over sprayed with paint. Mr [redacted] had sent his sub contractor Gaberial and he made a List of items which actually was on 8 sheets of paper that I can fax you. When mr [redacted] visited me last I showed him all areas and he had nothing to say but "oh it will be done". Punch list is not considered as incomplete work but as minor touch ups. His workers complained that mr [redacted] does not pay them properly that is not my concern. Mr [redacted] reputation is questionable since he talks all religious and makes false promises and then says that was never included. I have 6 witness that have also talked with mr [redacted] and all agreed that should I file a lawsuit against rali builders I am in a win win situation. But I don't want to do that. The members of pagh who had visited also said that mr [redacted] lies and there is no justification for his punch list and what ever he is stating is completely childish non business ethical. If he wanted to resolve the matter he would have replied to my emails text or phone calls and then only I had to take this step to report him to Revdex.com, [redacted], and other reputable organization. Even in today's date after when we met to resolve the matter mr [redacted] keeps talking about his punch list and his payment of 3k. It's understood that if I paid him almost 50k I am not going to cry for 3k. But the amount of work that's left for punch list is worth way more then 3k. If he didn't finish the work after paying him so much what's the guarantee that he will finish the work after I pay him 3k. My Reno started beginning of November and if he was so concerned about the health of my daughters and his conscience and his reputation he would not have left 40 percent of the work incomplete and not answer calls or text or emails.

The pictures that he has submitted only shows the different colors but does not show the quality. The quality of the work can't be shown on pictures. And mr [redacted] knows the fact that the work is not to the standard that was promised. Infact it looks like it was done by some labor that was picked up from [redacted] lots.
