I have reviewed Mr*** "Statement of the Problem" provided to me under cover of your letter dated September 6th, I have acted as legal counsel for Mr*** corporation for a number of years in an aggressively contested/defended litigation matterI have done so throughout to good
result, or at least as good result as there has been to get out of this difficult matter, and always with an eye to containment of rising legal costs in the face of increasingly diminishing returnsIndeed, it is for this reason, as well explained to Mr***, that I have kept my activities in dealing with his matter to the minimum necessary to achieve what has already been a much compromised result for him (as, unfortunately, often happens in contested litigation matters, and matters where substantial collection risk is brought to our attention)I understand and appreciate that this has been a matter of significant financial stress for Mr***, and of course frustration at a compromised result with a perceived "scoundrel" in the person of the litigation adversary, and so I am understanding and it is within my experience that this frustration is sometimes expressed towards a party's own counsel, as appears to be the case here, in my view unfairlyWith respect to the on-going civil enforcement proceedings, Mr*** is correct that prior to my departure on holiday for the month of August, our office inadvertently overlooked forwarding to him the Notice of Objection forwarded to my office in turn by Consolidated Civil Enforcement on June 29th, While I am certainly sorry and have apologized to Mr*** for this oversight, and while I certainly appreciate that this might have caused consternation for Mr*** given his anxiousness over the situation, it is to no substantive consequence, as my office continued to deal with the matter in the ordinary course during the month of July, and my file was appropriately diarized for my return to work in the first week of September.I am unable to disclose to you conversations between myself and Mr***, which of course are the subject of solicitor/client privilege, and so I trust you will appreciate that I am not in a position to respond more fully to Mr*** "Statement of the Problem" in terms of the detailed discussions I have had with him over time concerning his matter.My billing for services to Mr*** has been fair and reasonable and consistent with the terms by which I was retained, and I do not have any intention of reducing my invoices as requested, believing all my accounts to have been rendered in good faith and for good value in light of results obtainedWith respect to finishing the matter, given Mr*** unfortunate and apparent loss of trust and confidence in the level of service I have been providing to him, I have recommended to him that he seek new counselThe matter moving forward is a discrete matter that can be taken up by new counsel without any impactful result to Mr*** procedurally or in terms of cost.Yours truly,*** *** *** ***

I am rejecting this response because:Mr*** did not recommend that I seek different counselHe stated in his email that he would no longer represent me in this matterI do not believe that I should be billed for Mr *** to email the bailiff repeatedly for the same information that she provided to him the first time he emailed herI have been billed for services and paid for themThe receipts I have do not add up to the amount I have paidDue to the half hour I am allowed to respond to this matter I can not look up the exact amountI have spent up to three months trying to reach Mr *** by phone, text, and by email, and I don't feel that just because he told me that it was an oversight that I should be expected to believe thatI believe I was being ignored once againI have obtained new counsel this morning to find that he is not impressed how my case has been handled in certain areas, and have had better communication from new counsel this morning than with years of dealing with Mr.***
