To Whom It May Concern,Approximately two years ago I approached The Car Company in regards to an add I found in the [redacted] This was a listing for a 1999 [redacted] for a sale price of [redacted] Upon arrival I immediately recognized "[redacted]" to be one of my customers, he also knew who I was. We began to discuss the [redacted] from the add, I am very thorough when it comes to purchasing automobiles and I know "[redacted]" recognized this when I pointed out that some of the plastic paneling beneath the radiator was missing. I began asking questions such as "hag it ever been in an accident before" to which his reply was "not that Pm aware of no". I inspected closer, took the car for a test drive and finished up planning to return at a later date. Through the weeks I reviewed several [redacted] in and out of the area, one as far away as Maine. After careful negotiations with The Car Company I decided this was the best [redacted] for me, having had all of my questions answered to my satisfaction. In fact several other questions I had asked were "does the car have a clean title?" [redacted] answered yes and then started an entirely different conversation regarding the fact that the title even reflected the true mileage of the vehicle and this being rare for the age of the car as most older vehicles state TMU (true mileage unknown). The car had remarkably low mileage, one of the main contributing factors to deciding on this car which was one of the most expensive of the ** I reviewed. I also asked to drive the vehicle to a mechanic as is the right of a buyer when looking for a new vehicle, he allowed it and I headed to [redacted] Themechanic put the car on a lift and then brought me into the shop and began to list issues the car had. I took notes then returned to The Car Company and insisted the car under-go repairs before purchase. [redacted] was willing and seemed to be slightly hesitant but understanding and made arrangements for the repairs to be completed. This experience made all the more comfortable with a purchase from The Car Company, the fact that they seemed honest enough that I could trust them. One thing I had noticed this day was that the headlight on the driver side of the vehicle was a different color then the one on the left. In fact the driver side headlight was from the touring edition of the [redacted] and the right was the stock headlamp assembly. I pointed this out to [redacted] who insisted the vehicle had not been in any major accidents to his knowledge. I then asked if he could help me find the correct headlamp for the vehicle if I chose to purchase it and he agreed. Once the car was ready I inspected it noticing that only a small section of the exhaust was addressed although I asked that exhaust system as a whole be repaired or replaced. [redacted], [redacted] assured me the rest of the exhaust was not in need of further repairs. After seeing the underside of the vehicle I knew it had at least been high centered, but nothing else was apparent at that time. As time passed I began to have issues with engine management, [redacted] suggested it may be the ignition coils, I felt as though it could also be the knock sensors. I spent [redacted] on this vehicle in the time that I have owned it, to optimize performance and eliminate issues. The engine management issue is one that still plagues me, another constant issue is the gentle yet noticeable pull to the left. [redacted] agreed to have the alignment done and did so, which helped but did not cure the problem. I purchased lifetime alignment for the car and regularly have the alignment done so much so that the shop I take it to knows my name. I remember [redacted] telling me a story about [redacted] working on the car when they were completing my requests and drilling a screw into a wiring harness under the support beam for the radiator. I felt like this could be the engine management issue and I mentioned it to [redacted] and [redacted] Both are great at deflecting and I am again assured that it should be the ignition coils beginning to fail. In my opinion if it were an ignition coil that was failing it would have failed completely during the course of two years and has not. Regardless the point is that the car was represented as an above average car that sold at an above average price for a** of this year. Now as I write this letter I am feeling deep regret in my decision to do business with such a dishonest organization. I payed off the loan on the Vehicle Tuesday [redacted] and before this date I had never seen the title. When the title was handed to me at [redacted] the first thing I noticed is that the title clearly said "reconstructed" in bold print to the left of the owner information area, with a sub brand of "prior collision". Instantly my heitrt hit the floor as I had planned to soon sell the vehicle and now realized I was not only lied to but now I would never be able to sell the vehicle for the figure I had in mind. I became upset and Yve at [redacted] recognized this. She asked, "you didn't know?" to which I replied "I was assured it was a clean title". We began to explain to me that [redacted] didn't know at the time they finance it either claiming that [redacted] is not licensed to finance "reconstructed vehicles" in the state of [redacted] further explaining that they could have called in the loan at the time they received the title in [redacted] of 2013. She then explained that she called the dealer at that time and had a heated conversation with him about not being told it was a "reconstructed vehicle". I thought to myself "why wasn't I notified of this issue?". Personally I feel that [redacted] acted in their own best interest by not notifying me. I feel that it would make perfect sense from a lender stand point that releasing this information could jeopardize the payoff of the loan. I personally would have recognized it was not the fault of [redacted] and this would have never stopped me from paying off the loan but it would have sparked legal action to be taken much sooner then now. At this point I feel that because [redacted] acted in its own best interested and failed to convey this pertinent information to me that they are partially liable for the situation I am in now and should also be held responsible for the failure to indicate to me, the purchaser, that this was a reconstructed titled car and that I may have been sold a vehicle fraudulently or could have been mislead about the vehicle. I certainly never have and never would have consciously made a decision to purchase a vehicle which had previously been declared a "total loss". I never would have invested [redacted] into a vchicle that simply isn't worth the investment. At the end of the day I feel Cheated and I am now demanding a FULL REFUND OF THE ORIGINAL PURCHASE RICE. Furthermore, upon inspecting my purchasing documents I am now realizing that after the repairs were completed on the car The Car Company had increased the price of the car on the contract to [redacted] which is nearly [redacted] more then the add and the agreed upon price. All of this suddenly makes me realize that I have in fact been cheated. I have approached [redacted] at The Car Company and asked him to purchase the vehicle back, leaving my contact information and allowing several days for a response. Again the purpose of this letter if to formally request a FULL REFUND OF THE ORIGINAL PURCHASE AMOUNT OF [redacted] IN EXCHANGE FOR THE VEHICLE IN RETURN. I have full intention of perusing this matter in court if there is no resolution offered by The Car Company. Please respond appropriately with a resolution, your attention to this matter is greatly appreciated.Sincerely,[redacted]CC: [redacted]Desired SettlementAgain the purpose of this letter if to formally request a FULL REFUND OF THE ORIGINAL PURCHASE AMOUNT OF $[redacted] IN EXCHANGE FOR THE VEHICLE IN RETURN.Business Response I have no idea what caused the vehicle to come up with a "'reconstructed' title. I have a copy of the title showing it was clean. I sent a copy of this title with paperwork to [redacted] in order to finance this vehicle for Mr. [redacted]. [redacted] would not have financed a vehicle with a reconstructed title as it is against their policy.I purchased this car from a private owner and was told, at the time, it had been in a previous accident. I relayed this information to Mr. [redacted] prior to his purchasing the car as he himself noticed two different color headlights, one silver and one black. At this time, and by Mr. [redacted]'s recommendation, I had my son inspect the vehicle for previous damage. My son was only able to find a small dent about 10" long on the bottom of the radiator support.Over the last two years Mr. [redacted] has become a friend and we have done oil changes and other service work that he wanted done. I'm sure he will attest to the fact that he has had no problems with this car since purchasing it. He has driven the car trouble free for two years and probably has put between 15,000 and 20,000 miles on the car in this period of time. I do not feel that anyone can drive for two years and put on that many miles and expect to do this for free. Therefore, I do not feel Mr. [redacted]'s request for a full refund is justified. As to the difference of [redacted] in price between [redacted] and [redacted] I explained to Mr. [redacted] that that was the aquisition fee [redacted] charges. So therefore the fee is added to the purchase price of the vehicle when it is financed.I have answered Mr. [redacted]'s letter and have assured him that if the car is really reconstructed, that I would work with him to solve this issue. In my letter to Mr. [redacted], I have asked him to bring the car to me so I can look at it to try and settle this matter. To the contrary, I told you that the person I bought it from said that it had been. You yourself noticed the two different colored headlights, further enforcing the fact that it had been in an accident at some point. In your defense [redacted], neither one of us thought it was reconstructed.I do not know how the title that was returned to you from [redacted] after payoff of your loan, shows reconstructed because my title copy as well as the one I sent to [redacted] shows a clean title. If I'd had any indication of it being reconstructed, I would not have sold the car to you. I also was never called by [redacted] in regards to this matter.I would like you to bring the car to my lot so I can look at it. I know the reconstructed issue will lower its price, but it is still a very nice car that you have had no problems with in the 2 years you have owned it. All the money you have spent on the car, new oxygen sensors (all 4)twice, front and rear brakes twice and knock sensors was for your own personal satisfaction not because of any problems with the car.[redacted], none of these things have anything to do with the reconstructed issue. You are the one that knows the car better than anyone, therefore, you should be the one to sell the vehicle. I will help you, within reason, for the vehicle being worth less than with a clean title.Also, on more than one occasion, I have explained the difference in the [redacted] and [redacted] pricing of the vehicle. The price was [redacted] plus a [redacted] fee charged by [redacted] which I in turn charged you.Let me know when you can bring the car for me to look at.
