I am writing in response to your letter dated March 31, 2014, concerning a complaint filed against The Mane Vendor, LLC by a customer
The Mane Vendor, L.L.C., sells fully stocked extension vending machines, and grants the buyers a license to sell hair extension pieces, which is proprietary to the Company In December 2013, the customer called our Company and ordered a machine on an expedited basis Prior to purchasing the machine, I communicated with the customer several times by email explaining the terms of the sale and subsequent license the Company would grant I also provided her with Company brochures that fully explained our operating policies, including the payment of a monthly license fee of $250.00, without regard to the number of hair pieces sold from the vending machineBoth of us understood that once the vending machine is ordered and custom fitted for a customer, that customer owns the machine
Upon payment of the agreed price of $13,969.00, the Company ordered the vending machine in the customer’s name, which was then custom-built, fully stocked and ready for shipment to the customer within daysAt that point the customer became the equitable owner of the vending machine
Prior to shipment of the vending machine, however, the customer cancelled the order, allegedly because she had “changed her mind”; she also requested a full refund As the Chief Executive Manager of the Company, I explained to her that I am willing to grant her request, but the machine must first be resold I explained to her also that being a small, newly formed Company, we do not have the resources on hand to refund a custom-built machine without first reselling it I also explained to her that the Company would charge her an administrative and processing fee of $ -----to cover expenses incurred by the Company.The Company anticipates that it would be successful in finding a buyer for the vending machine soon which will put us in a position to refund the customer’s money minus the administrative and processing fee I am eager to have this unfortunate resolved by refunding the customer’s money.Sincerely,*** *** ***,Chief Executive ManagerThe Mane Vendor, L.L.CMain Street, #506Fairfax, VA

I am rejecting this response because:The machine isn't tailored to me it's a vending machine. How do I know if she's actively looking for a buyer or have already sold the machine. She told me in via email that she was going to replace her old machine with a current model. She wanted to put me on a 12 month contract for servicing, stocking this machine, that way she could  locked me into some kind of no refund policy, while that machine sits in her shop. She also said in the same email she had a buyer which was one of her hair stylist. [redacted], also told me she had a handful of purchasers lined up. Now it goes to show that she had nobody unless she's lying, who knows! That's my point!
I want to discuss a admin fees ect. What is the fee on this non existence refund policy?
At this point, I want **. [redacted] to start refunding my money back in installments on a agreed set amount until paid in full. I'm trying to work with her. I requested my money back on January 20, 2014, now it's going on 3 months.
I know [redacted] is prolonging this process with cruel intent. That's a lot of money, whether she sell the machine or not it has nothing to do with me and that was not in the policy either.  I would like [redacted] to set up a plan to refunding me so we both can put this behind up.

Review: While becoming a licensee with the Mane Vendor. The owner Marcela E[redacted] was very friendly and professional in regards to the sale of a Hair Extension Vending machine. The machine was ordered and placed in a location chosen by Marcela E[redacted]. The business literature states that a large vending machine should net a profit of $12,000 monthly and that if that machine is not producing the desired profits. The machine would be moved to a more profitable location. Also, the policy stated that any licensee is guaranteed a profitable monthly income per each machine. The machine I purchased from the mane vendor has netted a total profit of $140.00. A far cry from the promised $12,000 monthly profit.

The product in the machine was advertised as being 5A [redacted] Hair, after having several professionals in the hair and beauty industry looked at the product. They stated the product at best is 3A hair products. This company has used so many bait and switch tactics and does not do what they say they are going to do.

The machine had been placed for over 5 months, according to the literature $60,000 profit should have been achieved by this point. It has not, The business uses very uncouth business practices. Someone from within the organization attempted to withdraw an additional $15,000 from my credit card. Fortunately for me, just days before I had transferred all the funds from that account into another account avoiding the potential theft of $15,000 additional dollars.

The current situation is that Marcela E[redacted] and the mane vendor have failed to adhere to their policy of moving the machine to make it profitable. In fact, The Mane Vendor cancelled the Vending license and has yet to return or refund nearly $15,000 for the purchase of the machine. Furthermore, Ms. E[redacted] became very nasty and irate with me. She is not retuning my emails nor accepting my phone calls. I am currently working abroad. I am in Kabul Afghanistan supporting the U.S.Army.

I require your assistance in helping me resolve this issue. And letting the business world know about the uncouth, very unprofessional and shady business practices of Marcela E[redacted] and the Mane Vendor.Desired Settlement: A full return of $14,379 for the purchase of the machine .

I have just received a complaint dated July 2,2014. I am not sure why it was just delivered but I am now responding to this letter. It seems that the only two complaints on our company was from two colleagues that are conspiring to give us a bad name. Nevertheless, I have the response and all of the email correspondence to prove that the claims are false. I am pasting our response below and attaching as well.

In response to [redacted]’s statement, I am writing to dispute his claims. I am also submitting all correspondence between [redacted], and all employees and owner of The Mane Vendor (TMV). I am also including our official letter drafted by The Mane Vendor’s legal counsel to disengage [redacted] as a licensee and no longer conduct business. I will address every statement in [redacted]’s letter and further submit documentation and email correspondence to validate my response.
