Pursuant to the messages I left on your voice mail, I am responding to the above referenced Complaint file with your organization against my client “The Shop, European Auto...

Clinic” (hereinafter “The Shop”) on November 5, 2014. I have read the complaint filed by [redacted]. I am both surprised and angered by her disingenuous averments.I have known Mr. Jesse B[redacted], owner and operator of The Shop for many years. He is both a long time friend and my trusted mechanic. I watched the restoration of this particular vehicle from start to finish and I can assure you that it was done with the utmost care at great expense of time and money.
The Shop put up for sale a 1971 [redacted] E. Type Roadster, a rare and valuable British sports car. [redacted] expressed her interest and desire to have the car inspected. It was SHE that demanded a purchase agreement (See attached E-mail)) to secure her 1st position and remove the car from the market until such time as she had the vehicle inspected. (See attached Emails) [redacted] was represented by legal counsel (Agreement, S K.) who fully explained the purchase agreement to her. The Agreement stated in pertinent part “Failure to pay the balance due for any reason shall result in Seller earning one-third of the down payment.” (See Agreement §B, para 1 (iii) emphasis added) The Complainant signed the Agreement on October 1, 2014.
There is no other issue.
The contract is valid, was reviewed and signed by [redacted] and is being legally enforced. The Shop spent much effort accommodating [redacted] and her “inspector” and stayed well after business hours to accommodate his schedule. The inspector was not only unfamiliar with [redacted] E. Types, he did not even know how the body shells were manufactured.
Consequently, he misreported or just plain out did not know what he was looking at. Mr. B[redacted] offered the services of a neutral inspector who is recognized in the field as an expert on this type of automobile (See E-mails) but was rebuffed. [redacted] is not due a refund, has no legal or other basis to demand the same. Her complaint is fueled by her disappointment but is no fault of my client. Accordingly, there is no additional refund due and her complaint is completely without merit. Any measures taken which in anyway disparage or harm The Shop or its ability to do business will result in legal action.
