I am rejecting this response because: I sent a detailed message to Shannon Nichols, the Director of Property Management, explaining the terms which would be acceptable at this point. In reference to the two weeks that were paid without receiving a service, the apartment was in no way ready for move in on the 1st or the 15th of August when they actually arrived. Paying for a service without receiving one may have been in the contract however, morally wrong under these circumstances. My son has agreed to a settlement of $650.00. $500for a service not received and $150.00 in restitution for some of the cleaning and supplies they were forced to cover during move in on the 15th.

We are in receipt of the detailed message. A response was sent on 9/12/15 stating we would like to review all of the information and timeline of events.At this time without completing a full review our initial offer of $150.00 which is based on what the cost of having the apartment professionally cleaned would have been plus additional dollars for the inconvenience experienced at the time of move-in. We do not agree with the additional $500.00 concession that is being request- the lease clearly states If resident(s) agree to the $150 concession - we can generate the addendum and have it available in the leasing office for review.

Review: Hello,My name is [redacted] and I live with my husband at the Timbers apartments in [redacted] We have loved living here up until last week. We understand that there is not a rule against smoking at these apartments. A young woman moved in below us last week and is a heavy smoker. Ten minutes after she arrived in her apartment our entire living room smelled like an ash tray. I have asthma and as a result I am allergic to cats, any type of pollen and cigarette smoke. I reached out to management and the only thing they would do is to "seal" off both apartments from each other. These apartments are at least 25 years old and that is not possible. We asked them if we could transfer to an apartment right across the hall and they want us to pay a $350 deposit and get tied into a new year lease. I should not have to pay for someone's smoking and it is my right as a Virginia resident to institute a "no smoking" policy for my household. I cannot breath deeply and I have a constant headache and sick stomach. I can have documented medical proof sent to whomever needs to see that this is a real problem. I am in desperate need of help as I cannot live in this environment any longer. Thank you for taking time to hear my case. Sincerely,[redacted]Desired Settlement: We would like the Timbers to allow us to move in the empty apartment across the hall and we will not pay a security deposit or sign a new lease. We would want to keep our current lease which ends in August.

The Residents that reside at The Timbers Apartments #** contacted the office on 3-27-2015. They complained about the new Residents that had just moved in. They stated they were smokers and they could smell smoke in their apartment. The manager requested that maintenance go down and check the smoke smell. We also visited the apartment on 4-6-2015 once the Revdex.com complaint was received by our office. The Residents were home and “said the smell was not bad today like it usually is”. The manager told them to contact the office if they smell it again so we could inspect. As of today we have not heard back from the Resident in regards to the smell. At The Timbers we do not offer or advertise a smoke free community. They would be able to transfer but we cannot guarantee there would not be a smoker above or below them in another apartment. Review: I am a tenant to this apartment. I moved into apartment on July 28/2015. I noticed a leaking in my bathroom. I reported it. They have not done anything about it. I have to constantly mop the floor everyday after.Desired Settlement: fix it as soon as possible or I will be compelled to move out.

Response:

I have spoken to the property manager, the tech and our tech advisor and the problem has been fixed. We unfortunately did have to go out several times to find the source of the leak. It was confirmed on 8-14-2015 it was a leaking manifold. It did take several applications and products to seal the pipe thread. This did stop the leaky manifold. To our knowledge the Resident is happy with the repair. Please let me know if you need additional information.
